MINUTES TOWN OF PITTSBORO BOARD OF COMMISSIONERS REGULAR MEETING MONDAY, SEPTEMBER 28, 2020 7:00 PM Members Present (Virtual): Mayor Jim Nass, Mayor Pro Tern Pamela Baldwin, Commissioner John Bonitz, Commissioner Jay Farrell, Commissioner Michael Fiocco and Commissioner Kyle Shipp. Staff Present (Virtual): Town Manager Chris Kennedy, Town Attorney Paul S. Messick, Interim Chief of Police Shorty Johnson, Planning Director Jeff Jones, Senior Planner Theresa Thompson, Planner II Kayleigh Mielenz, Town Clerk Cassandra Bullock. Mayor Jim Nass called the meeting to order and asked for a moment of silence PLEDGE OF ALLEGIANCE Pledge of Allegiance was led by Commissioner Farrell. Commissioner Bonitz made a motion to approve the Agenda, seconded by Commissioner Fiocco. Commissioner Fiocco made a motion to table item #1 and item #2 until the October 12, 2020 BOC meeting, seconded by Commissioner Farrell. Code of Ordinance Amendments to Chapter 27 2. Adoption of 2016 North Carolina Department of Natural and Cultural Resources Municipal Records Retention and Disposition Schedule End of Consent Agenda. UPDATES & COMMISSIONER CONCERNS 1. Manager Updates- Town Manager Chris Kenney mentioned that the Us Census every 10 years we tum that in and fill it out correctly. Deadline Sept 30 we are at 54% of North Carolinas completing those Census forms. Chris also advised the Board that the Board will have five sets of minutes to approve for the Board on the October 12 meeting. Explained the delay and the new process. Chris discussed that we could either Hold the Public Hearing open until October 12, 2020 BOC meeting or close the Public Hearing tonight in reference to the Senate Law SLL- 2020-3 you can not have action day of the Public Hearing, you must allow the public to comment up into that meeting, hold the public hearing, close the Public Hearing then provide 24 hours after the Public Hearing for Public comments before making a decision. The earliest the Board could decide is October 12. Chatham Park is also bringing new items to the Board October 26 meeting and we could conduct the Public Hearing tonight and Hold it open until that meeting and move it to Old Business. 2. Mayor Updates- None 3. Commissioner Updates • Boys & Girls Club- Commissioner Shipp advised they have formed the Advisory Board and still looking for members. In close agreements with the Central Carolina Group which and they should be able to accept donations from that group very soon. • Chatham County Arts Council • Chatham County Economic Development Corporation (EDC)- Commissioner Fiocco advised the search is still ongoing for a new president. Consultant has been hired and a committee has been formed. • Climate Change • Downtown • Fairground Association • Human Relations Committee • Main Street Pittsboro (MSPBO)- The Welcome Center has received a certificate of occupy. Can start conducting business. 2 • Parks and Recreation Advisory Board (PARAB)- Stephanie Bass the Chair has advised that she needs to step down from that position, she will stay on the Board. • Pittsboro Business Association (PBA) • Triangle Area Rural Planning Organization (TARPO) • Triangle J Council of Governments (TJCOG)- The Council went into a Closed Session to discuss restructuring the Triangle J. She has sent out general information regarding the programs that are going on. She also mentioned the Summit is still going on because it's five weeks. • Commissioner Concerns- Mayor Pro Tern advised that the parade of Homes was very impressive, and the area looks good. Commissioner Bonitz wanted to acknowledge Mayor Pro Tern for her work with the Chatham County Fair Grounds. Commissioner Shipp wanted an update on the Old Graham zoning? • Jeff Jones advised that they are working with the applicant and meeting with the applicant this week and should be back to the Board by October 12, 2020. • Chris had a good convo with the applicant, and they have talked about some affordable housing components. Commissioner Shipp notice the sidewalks in Town need to be worked on, received calls about citizens falling around Town. • Christ advised the sidewalks are on his radar, he will try and do a short term and fix the hazards and work on the long term. Commissioner Shipp questioned about the Water Quality Task Force, he wanted to is Dr. Birnbaum going join in with them on the reporting? • Chris spoke with Katie today and advised he would have the report on Friday and will have it posted on the Town's website. Dr. Birnbaum is being confirmed for Oct. 12. Commissioner Fiocco advised lights are going up on the trees tonight. Commissioner Bonitz wanted to highlight the correspondence he received from the Potterstone Village HOA concerning the rezoning down zoning from industrial to residential. He would like it to come on an agenda in November for discussion. • Commissioner Shipp and Commissioner Fiocco would be up for discussion. Commissioner Fiocco made a motion to go into Public Hearing, seconded by Commissioner Bonitz. Annexation - A-2020-03 Chatham Park Section 7.1 Residential Subdivision, Phase 1 (Theresa Thompson) ■ Description: Chatham Park Investors, LLC is requesting the approval of a contiguous annexation petition to annex 124.181 acres East of Grant Drive and North of Suttles Road. At the September 14, 2020 Regular Meeting of the Board of Commissioners, the Board set a public hearing for September 28, 2020 to consider the annexation request and directed the Town Clerk to investigate the efficacy of the request. Commissioner Fiocco made a motion to close the Public Hearing and bring it back to the Board on the October 26 BOC meeting, seconded by Commissioner Farrell. Vote: Aye-5 Nay-0 Mayor Nass: NIA Mayor Pro Tern Baldwin: Aye Commissioner Bonitz: Aye Commissioner Farrell: Aye Commissioner Fiocco: Aye Commissioner Shipp: Aye Motion passed. CITIZEN MATTERS 1. Public Comment- Public Comment was held and no one chose to speak under Public Comment. OLD BUSINESS 1. Rezoning - REZ-2020-02 - Luke Starritt (Kayleigh Mielenz) ■ Description: The petitioner is requesting to rezone Parcel 8155 on Thompson Street from R-10 to O&1-CZ. The parcel is 3.75 acres. The Board of Commissioners held a Public Hearing to Consider this request on August 24, 2020. The Planning Board reviewed this request at their September 9, 2020 meeting. 4 Discussion with Commissioner Fiocco and Luke Starritt and Chad Abbott about Commissioner Fiocco 's conditions and the conditions that the applicant has proposed. Both applicants have agreed to the making the changes to the conditions. Jeff Jones advised that the Planning Department will need to do a consistency statement, along with an adjusted ordinance and Attorney Paul Messick will assist and bring it back to the Board October 12, 2020 for approval. Commissioner Fiocco made a motion to approve the request with the consistency of land use plan, seconded by Commissioner Farrell. Commissioner Fiocco made a motion to approve the Conditional Zoning with the added 12 conditions presented tonight and with addition of the December 31, 2020 time frame for the Greenway Rights to be granted, seconded by Commissioner Farrell. Site Plan - SP-2020-04 Northwood Lowes Food (Kayleigh Mielenz) ■ Description: The site plan depicts the design for the construction of a 50,000 SF grocery store, an 8,000 SF multi-tenant retail space, and a fuel station in the Northwood MUPD. The Planning Board reviewed this request at their September 9, 2020 meeting. Commissioner Bonitz had discussion on if they could add a third space with a Compost Bin, and he will encourage the company to speak with applicant. 5 Commissioner Fiocco made a motion to approve plan, seconded by Mayor Pro Tern Baldwin. Sewer Allocation Request-Eco CP Partners, LLC & Eco Northwood MUPD, LLC (Chris Kennedy) • Description: The developers of Mosaic and Northwood Landing are requesting the approval of a sewer allocation request in the amount of 42,968 Gallons per Day (GPD). Town Manager Chris Kennedy provided an overview of request, but he would like to also request we reserve some for Town Hall if the Board approves the Allocation. Kirk Bradley the Manager of Northwood MUPD & Mosaic project. He gave his overview on what is coming and why they are needing the Sewer Allocation. Dan Morse with Triple A Homes likes to be in a smaller Town like Pittsboro. He advised he would like to share some of that Sewer Allocation, he would only need about 13,000 gallons to get his project started. Commissioner Fiocco made a motion to table until October 26, 2020 meeting, seconded by Commissioner Bonitz.
