MINUTES TOWN OF PITTSBORO BOARD OF COMMISSIONERS REGULAR MEETING MONDAY, FEBRUARY 8, 2021 7:00PM Members Present (Virtual): Mayor Pro Tern Pamela Baldwin, Commissioner John Bonitz, Commissioner Jay Farrell, Commissioner Michael Fiocco and Commissioner Kyle Shipp. Members Absent: Mayor James Nass. Call to Order - Mayor Pro Tern Baldwin Mayor Pro Tern Baldwin called the meeting to order. Invocation - Moment of Silence Mayor Pro Tern Baldwin asked for a moment of silence. UPDATES & COMMISSIONER CONCERNS 1. Manager Updates Town Manager Chris Kennedy advised the Board that Senior Planner Theresa Thompson has accepted the title of Interim Planning Director and that she has been doing a great job so far. Mr. Kennedy also advised the Board of a few adjustments to the proposed Consent Agenda, including the removal of a budget amendment to the Pittsboro Boys & Girls Club. 2. Commissioner Updates ■ Boys & Girls Club Commissioner Shipp provided a general status update of the progress in opening the Pittsboro Boys & Girls Club and he stated that fundraising continues to raise the necessary funds to open the Club. • Chatham County Arts Council ■ Chatham County Economic Development Corporation (EDC) Commissioner Fiocco advised that the Chatham EDC will meet tomorrow, February 9, for its regular meeting. ■ Climate Change • Downtown Commissioner Fiocco stated that the NCDOT project for the downtown traffic circle project continues and is progressing ahead of schedule. ■ Fairground Association ■ Human Relations Committee ■ Main Street Pittsboro (MSPBO) Commissioner Fiocco advised that Main Street Pittsboro has designed and purchased fifteen (15) signs alerting traffic that downtown shops remain open for business despite the detours for the NCDOT project. Commissioner Fiocco stated that the signs will be installed in the corning days and will be placed adjacent to the NCDOT detour message boards and signage. Commissioner Fiocco also mentioned that Main Street Pittsboro is preparing to submit their Fiscal Year 2021-22 budget request to the Town Manager for consideration. • Parks and Recreation Advisory Board (P ARAB) Commissioner Fiocco advised that the PARAB discussed its budget requests for Fiscal Year 2021- 22 and submitted those requests to the Town Manager for review. • Pittsboro Business Association (PBA) Commissioner Fiocco advised that the next PBA meeting is Wednesday, February 10. • Triangle Area Rural Planning Organization (T ARPO) • Triangle J Council of Governments (TJCOG) • Other MISCELLANEOUS 1. Discussion of Fast-Track Advanced Treatment Methods and Project Implementation for Fast-Track Advanced Water Treatment Town Manager Chis Kennedy provided an overview of the recent developments with this project and led the discussion regarding the treatment alternatives. Mr. Kennedy described and detailed the project and the associated budget requests listed under Miscellaneous #2 and #3. 2 On behalf of CDM Smith, Reed Barton and William Dowbiggin were present and also discussed the treatment alternatives and the project with the Board. Questions from the public submitted into the Zoom Chat during the meeting: Casey Mann: "What is the estimated cost for GAC per year once in operation at lMGD?" Jessica Merricks: "with such small doses of PFAS causing long term health issues. is 90% really acceptable for the public? replacement of household RO systems are yearly instead of quarterly. RO removal is higher as well[.] did Pittsboro look into the water infrastructure finance and innovation act? several cities were able to apply" 2. Budget Amendment for Fast-Track Advanced Treatment Project Design & Permitting Commissioner Shipp made a motion to approve the amount to amend the Budget Ordinance to Increase Line Item for Permitting Design by $400,000, seconded by Commissioner Bonitz. Budget Amendment for Fast-Track Advanced Water Treatment Materials Commissioner Fiocco made a motion to approve the amount to amend the Budget Ordinance to Increase Line Item for Materials/Supplies/Equipment by $800,000, seconded by Commission Bonitz. Ducka Kelly - 735 Russet Run, Pittsboro, NC 27312 "Dear Cassie, As a resident of North Woods Neighborhood, I am asking that Pittsboro and Chatham County help us out to find another alignment for the North Chatham Park Way. This road is really to benefit Chatham Park and therefore it really should be on their land about 200 yards east of the proposed alignment. We know this road is to benefit Chatham Park since in the 404 and DOT land use report it states that the primary purpose of the Project R-3930 is to support the economic development of Chatham Park (page 9) and that travel savings using the Park Way instead of 15-501 to get from North to South of Pittsboro is projected to save less than 1 minute (page 3 & 19). we are asking that Pittsboro and Chatham County sand behind their residents to help get this road realigned back on to Chatham Park land. Ironically there is another neighborhood names Northwood in Chapel Hill. This neighborhood was also in danger of being cut apart by a highway in 2018. Turns out Chapel Hill and Orange County stood behind their residents and a different alignment of the road was figured out. The neighborhood was able to remain intact. Best, Ducka Kelly" 2. Diana Dalsimer- 60 Haven Road, Pittsboro, NC 27312 "Pittsboro Town Meeting, Monday, Feb.8th, 2021 Statement for submission By Diana Dalsimer My name is Diana Dalsimer. I'm a resident of North Woods. Thank you for giving me the opportunity to speak and for you to hear my concerns. North Woods is an established rural hamlet consisting of 200 acres and 17 family homes. It will soon be surrounded by the development of Chatham Park's North Village. We live with nature here and are part of a balanced ecosystem. This type of community is becoming increasingly rare in Chatham County and will someday become obsolete if not protected. We need to safeguard this neighborhood from the high density development that will surround it. North Woods is a place for surface water to seep into the earth, for animals to find food and shelter and for plants to cover the land. Once destroyed it will be gone forever. As you are aware, the NCDOT in partnership with Chatham park are proposing to run North Chatham Park Way through a portion of our neighborhood. The alignment of North Chatham Park Way in 2015 has shifted to the west utilizing more private land and encroaching deeper into our neighborhood. My husband and I along with our three children have lived here for seven years. When we bought this property we were aware of the growth and development that was to come with the evolution of Chatham Park. I understood the landscape surrounding our neighborhood 4 would be transitioning from rural to high density development. I realize within the next few years my property will abutt high density housing. With Chatham Park's 7,000 acres, I never dreamed that portions of our neighborhood could be taken to build North Chatham Parkway. I had faith in the NCDOT and the developers of Chatham Park to build responsibly. I am still hoping they will walk their talk. This means working in close partnership with the community in order to achieve and preserve a healthy and balanced environment in which to live. Chatham Park and it's investors will be the greatest benefactors of this road project. This thoroughfare will be the main artery running through Chatham Park. Proposed intersections will be built along the parkway. One of the intersections is proposed in our neighborhood. The auxiliary road stemming off this intersection will become the second road to run through our neighborhood destroying additional properties. Chatham Park's encroachment onto private lands would be bleak for the future of North Woods. There's ongoing concern that the neighborhood's private gravel, dead end road will connect to the parkway. Greenways are being planned to run through multiple private properties. Chatham Park should utilize the 7,000 acres of undeveloped land they have acquired and not use small parcels of their neighbors lands. Destroying unique neighborhoods such as North Woods would be a poor example of the trust that needs to be forged between Chatham Park and the Pittsboro community. We are asking for the NCDOT in partnership with Chatham Park to re-evaluate the current alignment of North Chatham Park Way. Create a model that utilizes as much Chatham Park land as possible while preserving established neighborhoods and private parcels. The people of Pittsboro are watching and they are making their voices heard. Using private property for Chatham Park Way should be a last resort and not a convenient solution for developers." 3. Roy and Deborah Fesel - 280 Haven Road, Pittsboro, NC 27312 "Dear Town Commissioners and fellow Pittsboro residents, Please do all that is in your power to prevent the NCDOT from needlessly taking land from the neighbors in Northwoods community to build the chatham parkway bypass and convince the Chatham Park planners it will be in their best interest to build it on Chatham Park Property. We have some beautiful unspoiled small homesteads that are priceless to all who live here and for wildlife moving out of Northwoods high area that has been deforested. We see more and more of them daily. This is a haven for them and our families if you can keep it just the way it is for as long as humanly possible. Thank you, Roy and Deborah Fesel and family." 4. Mark Pavao -421 Haven Road, Pittsboro, NC 27312 "Comments submitted by Mark Pavao to Pittsboro BOC Meeting on February 8, 2021 My name is Mark Pavao, my address is 421 Haven Rd, Pittsboro and I would like to share my concern about North Chatham Park Way. My house is in the North Woods 5 neighborhood, on Haven Creek downstream from the Mosaic development, surrounded by land acquired by Chatham Park over the years. My daddy and I bought our place 23 years ago and named it Peacock Haven Farm, which is a play on our last name and Haven Creek. In December, my neighbors and I received a DOT mailing that announced that Pittsboro, Chatham Park Investors and DOT are partnering on North Chatham Park Way, and that the proposed alignment cuts through and divides our neighborhood and my land. The proposed section on my land is about 200 yards west ofland owned by Chatham Park. This proposed alignment surprised me because the 2015 Pittsboro Transportation Plan showed the North South road, as it was then called, on Chatham Park land. According to the NCDOT Land Use Scenario Assessment Report from April 2020, the primary purpose of North Chatham Park Way is to support the economic development of Chatham Park (page 9). Interestingly, the report also states their assessment that the North Village would be developed with or without construction of North Chatham Park Way (Page 31). Last week, my neighbors and I attended the public information session organized to discuss the North Village Small Area Plan. We focused on the transportation plan which describes the road system for the North Village. We had extensive conversation with Chuck Smith, VP of Design at Preston Development and representatives from Kimley Horn, the engineering firm supporting the project. Kimley Horn has developed a transportation proposal that meets the requirement of the DOT's Transportation Model for the year 2045. We learned that a major consideration in the design was to avoid stream crossings, and that the current proposal crosses 13 streams while earlier proposals crossed over 40 streams. We also heard from Chatham Park that the road was shifted into our neighborhood to avoid 3 small streams. This data can be found in the Small Area Plan (SAP Pages 60-62). So, what's the impact? The current proposal will take about 10 acres of private land from three neighbors and divides the North Woods neighborhood, which will strand 4 neighbors and about 30 acres on the other side of this limited access road. We met today with DOT and learned that they have not develop a scenario that avoids North Woods, so we asked them to run that scenario, because it makes no sense, and it's not fair, to build the Park Way through a private neighborhood for the benefit of Chatham Park, when the road can be built 200 yards to the east on Chatham Park land. I respectfully urge the Pittsboro Planning Department and Pittsboro town leadership to require that Chatham Park and NCDOT find an alignment for North Chatham Park Way that meets the goals of the 2045 Transportation Model and does not divide the North Woods neighborhood. I hope this email finds you well and hope you are having a good day. I am emailing you because I am a resident of Pittsboro that lives off 64 business on Roberson creek. My street is not far from the agriculture center. I am reaching out because of our situation with internet access. My family, as well as the rest of the street I live on have struggled during the pandemic to stay connected when connection virtually was the they only way. I graduated college and tried to complete college during a pandemic with no internet. It was quite literally impossible. We have Century link, which is to say the nicest way possible, dial up. I'm emailing you because I am not sure who else I need to email or talk to you about this matter. We live a quarter of a mile away from the agriculture 6 center where there is fiber Internet, to where my road is with essentially none. I'm not sure that this has anything to do with your office or your role but I was hoping that you can help considering you're an elected official for the town I live in. Rezoning - REZ-2017-04-A0l - Northwood MUPD Planner 1 Kayleigh Mielenz presented the staff report and provided an overview of the proposed amendments to the rezoning. Ms. Mielenz stated that the rezoning was initially approved in 2018 and the current application seeks to adjust the layout and seeks to add acreage to the project. Kirk Bradley, representing Eco Northwood MUPD, LLC, spoke as the developer along with Mark Ashness of CE Group, the design firm for the project. Discussion ensured amongst the Board. Commissioner Shipp asked for clarification on the tree retention proposed for Lot 26 as well as if any direct access was planned for Lot 26 to US 15-501 . Planner 1 Kayleigh Mielenz described the tree save proposal and the proposed tree coverage area. Kirk Bradley stated that Lot 26 will not connect directly to US 15-501 as NCDOT confirmed that a driveway permit would not be granted for access. Commissioner Bonitz expressed additional concerns regarding the Tree Coverage Area (TCA). Further discussion ensued amongst the Board. Commissioner Fiocco made a motion to close the Public Hearing and to hold off on voting on REZ-2017-04-A0l to the next Board of Commissioners Regular Meeting on February 22, 2021 to allow for the 24-hour comment period to occur between the closing of the public hearing and vote pursuant to NCGS 166A-90.20, seconded by Commissioner Shipp. Vote: Aye-5 Nay-0 Mayor Nass: Absent Mayor Pro Tern Baldwin: Aye 8 Commissioner Bonitz: Aye Commissioner Farrell: Aye Commissioner Fiocco: Aye Commissioner Shipp: Aye Motion passed. 2. Zoning Text Amendment - ZTA-2021-01 - Accessory Dwelling Units & Secondary Ingress and Egress - Town of Pittsboro Planning Department Interim Planning Director Theresa Thompson presented the staff report and provided an overview of the request. Ms. Thompson discussed setbacks for accessory dwelling units, parking requirements, square footage requirements and the like. Ms. Thompson then discussed the concepts for secondary ingress and egress, including the ability for the Board to deviate from the standards suggested as necessary. Discussed ensued amongst the Board. Commissioner Fiocco made a motion to forward ZTA-2021-01 to the Planning Board, seconded by Commissioner Bonitz. After the closing of the public hearing, and within the 24-hour statutorily defined time window, the Town received the following public comments on ZTA-2021-01: 9 "I can't properly zoom in to speak at the public hearing and would like to submit a written comment. Firstly, regarding a secondary entrance: In the language about waivers, I'd like to point out that in spite of a sprinkler system, emergency access can be needed for circumstances besides fire. Also would it be better to change "and/or a sprinkler system to "and a sprinkler system." Otherwise this would allow buildings etc to get a waiver from a second entrance even where one could be provided, as long as there's a sprinkler system. Rather waivers should only be able to be requested when a secondary access can't be provided, and only granted if there's a sprinkler system. Regarding ADUs: these are supposed to be backyard cottages, garage flats, attached granny or housekeeper flat. They are valuable, when kept relatively small as an additional source of affordable rental housing. I would urge you to reduce the maximum size to 800 sq ft which is actually quite generous. 1200 SQ FT can be room enough for a 3 BR home and that is not what this provision should be for or allow. Liz Cullington 390 Rocky Hills Road Pittsboro NC 27312" "Additional comment re ADUs, and limiting the size to 800 or 850 sq ft. Hearing: ZTA-2021-01 I understand that allowing ADUs in all zoning districts was done to increase the stock of affordable rental housing. A larger unit such as 1200 sq ft. would be much less affordable. There is no other source of aditional housing at the size and price range of an approx. 800 sq ft or so ADU. Developers are not going to build it. 1200 sq ft is like the minimum size of a small townhouse. I also recall that ADUs are allowed throughout Chatham Park. We need to ensure that a size limit (and a small size limit) will also apply there, and ought to be included in the Small Area Plan, to be sure. With the smaller lots and setbacks and dense development that is proposed for the North Village, one would think that only granny flats or garage apts would fit as an ADU on those lots, but the size needs to be limited to approx. 800 sq. ft to ensure that. These ADUs could be the only significant source of affordable rental housing in that size and price range in Chatham Park. There is a serious lack of these smaller rental units in town and in the county, and if this is the purpose of allowing ADUs then that is what they should be limited to . There are a large number of single people (or single parents or couples) of all ages who simply cannot find an affordable place to live, in this size and price range, many of who therefore have longer commutes. There are other ways of allowing additional larger ADU dwellings where appropriate, such as subdivision, or getting a waiver. Since it was stated that ADUs would be on the same water and sewer account as the primary dwelling, an ADU is not the mechanism for adding a larger dwelling as an infill project in town. (Out in the ETJ there would be all kinds of other issues re well and or septic and I believe that subdivision would be required for anything beyond a 1 BR ADU for a 3 BR home with 4 BR septic, for example.) 10 Liz Cullington 390 Rocky Hills Road Pittsboro NC 27312" OLD BUSINESS 1. None. NEW BUSINESS 1. Town of Pittsboro Town Hall Site Plan Interim Planning Director Theresa Thompson presented requests for Site Plan approval, Sanitary Sewer Allocation and authorization to allow Hobbs Architects to go to bid with these plans on behalf of the Town of Pittsboro. Ms. Thompson stated that the submitted formal request for Sanitary Sewer Allocation was in the amount of 985 gallons per day (GPD) to serve the new Pittsboro Town Hall Building that will be located at 50 W. Salisbury Street. Taylor Hobbs with Hobbs Architects and Ana Wadsworth with Wooten briefly spoke on the applications and the project. Commissioner Fiocco made a motion to approve the Site Plan, the Sanitary Sewer Allocation of 985 gallons per day and to authorize Hobbs Architects to go to bid with this set of drawings, seconded by Commissioner Shipp. Vote: Aye-5 Nay-0 Mayor Nass: Absent Mayor Pro Tern Baldwin: Aye Commissioner Bonitz: Aye Commissioner Farrell: Aye Commissioner Fiocco: Aye Commissioner Shipp: Aye Motion passed. 2. Resolution in Support of Federal Carbon Fee and Dividend Policy Town Manager Chris Kennedy reminded the Board that this item, New Business #2, is formerly Consent Agenda Item #8. Commissioner Bonitz thanked the Board for its consideration of the resolution and provided an overview of the policy and the impact of the request. Commissioner Bonitz further stated that this draft Resolution is predicated on a Resolution from this Board supporting a similar effort in December 2017. 11 Commissioner Farrell advised that he would not be in support of the Resolution if there is a fee involved. Commissioner Bonitz offered that he will provide the Board and Town Manager with a link supporting the "pros" and "cons" on having a policy adopted. Town Manager Chris Kennedy suggested that if the Board is not ready to make a decision tonight, that in conjunction with Commissioner Bonitz's offer to provide additional information, that the Board may wish to table this discussion until the February 22, 2021 Regular Meeting of the Board. The Board agreed and elected to table any action on the Resolution until the February 22, 2021 Regular Meeting of the Board. Final Board of Commissioner Comments & Adjournment Commissioner Shipp advised that he has uploaded the recordings of past Board meetings to the Town of Pittsboro Y ouTube channel and that he is also working on doing the same for past Planning Board meetings. Commissioner Shipp stated the County's affordable housing committee met last week and the committee discussed the process for how money will begin to come back into their fund . Commissioner Fiocco wanted to thank Theresa Thompson and welcome her into her new role as Interim Planning Director. Commissioner Fiocco would like the Share Point to be in sequential order according to the Agenda for better ease of use. Commissioner Fiocco requested confirmation that Town is paying for the betterment of the waterline projects discussed include an upsizing of a 6" waterline to an 8" waterline for the Eagles convenience store project and the upsizing of a 2" waterline to a 12" waterline as part of the NCDOT traffic circle project and that these waterlines will interconnect. Town Manager Chris Kennedy confirmed yes, and that he and staff have been working with Kimley-Hom to design the 2" to 12" waterline portion of the project. Commissioner Shipp also inquired about Nooe Park and waterline service connections in this area for these connection points. Town Manager Chris Kennedy stated that new service connections are being planned for Nooe Park and the other users in this area. Commissioner Farrell thanked the Board and staff for their support provided during his wife's illness. Commissioner Bonitz asked Town Manager Chris Kennedy whether he had received the necessary affirmation of the Board's support for the Town of Pittsboro to be the official sponsor of the 250 Chatham County Founding Day event in April. 12 Town Manager Chris Kennedy advised that he had not to date, but the request was just delivered earlier today. Mr. Kennedy stated that the sponsorship would be in the amount of $500 and if so approved, the Town of Pittsboro would be the official sponsor of Chatham 250's Founding Day. Mr. Kennedy also mentioned that the event is set to be held on the site of the new Town Hall. The Board unanimously agreed to move forward with the contribution. Commissioner Bonitz mentioned that the old US Highway 64 bridge along the CCCC walking trail that crosses the creek by the boy scout hut, was built 100 years ago this year. Commissioner Bonitz asked if the Board would be okay with him contacting the Chatham County Historical Association and asking if they would like to sponsor an essay contest for students to write about this bridge. Discussion ensued and the Board consented to allow Commissioner Bonitz to pursue this effort. Commissioner Bonitz stated that he would follow up with Town Attorney Paul Messick who is also involved in local history and the boy scouts. Commissioner Bonitz made a motion to Adjourn, seconded by Commissioner Fiocco at 10:03pm.
