TOWN OF PITTSBORO BOARD OF COMMISSIONERS AUGUST 28, 2023 REGULAR MEETING MINUTES PAGE 1 OF 4 TOWN OF PITTSBORO The Pittsboro Board of Commissioners met in Regular Session on Monday, August 28, 2023, at 7:00pm in the meeting room at the Chatham County Agriculture and Conference Center with Mayor Cindy Perry presiding. The meeting was called to order at 7:02pm. Mayor Perry requested a moment of silence with the recitation of the Pledge of Allegiance led by Commissioner Farrell. ELECTED TOWN OFFICIALS PRESENT: Mayor Cindy S. Perry, Mayor Pro Tern Pamela Baldwin, Commissioners Jay Farrell, Kyle Shipp, and James Vose. ELECTED TOWN OFFICIALS ABSENT: Commissioner John Bonitz. TOWN STAFF PRESENT: Town Manager Jonathan Franklin, Town Attorney Paul S. Messick, Assistant Town Manager/Director of Engineering Kent Jackson, Chief of Police Shorty Johnson, Downtown Development Director Theresa Thompson, Public Information Officer/Emergency Management Coordinator Colby Sawyer, Director of Planning Randy Cahoon-Tingle, Senior Planner Molly Boyle, Finance Director Heather Meacham, Public Works Director Daniel Snipes, Project Engineer Morgan DeWit and Town Clerk Carrie Bailey. ADOPTION OF THE AGENDA Mayor Perry called for a motion to either approve or modify the agenda as proposed. Commissioner Shipp made a motion to approve the Regular Agenda, seconded by Commissioner Vose. Vote: Aye-4 Nay-0 Motion carried unanimously. CITIZEN MATTERS 1. Manager Updates Town Manager Jonathan Franklin updated the Board that operational meetings continue between Sanford and Pittsboro staff regarding the merger details, new hires have been made in the last month, PIO/Emergency Management Coordinator Colby Sawyer recently graduated from the National Emergency Management Advanced Academy who is one of thirteen hundred in the country and provided the graduation speech to his class. 2. Mayor and Commissioner Updates and Concerns Mayor and Board members gave updates on the committees and boards on which they serve. 3. The Consent Agenda contained the following items: 1. PB-23-289-Turkey Creek Conditional Zoning Request Set Public Hearing for September 11 , 2. PB-23-306-Bellemont Station MUPD Amendment Request Set Public Hearing for September 11,2023 3. PB-23-310-264 Rock Springs Church Road Conditional Rezoning Request Set Public Hearing for September 11, 2023 Commissioner Farrell made a motion to approve the Consent Agenda, seconded by Mayor Pro Tem Baldwin. Vote: Aye-5 Nay-0 Motion carried unanimously. PUBLIC HEARINGS 1. None. OLD BUSINESS 1. Chatham Park North Village Small Area Plan-1 st Amendment Senior Planner Molly Boyle shared a copy of the draft resolution with staff recommended language. Public Comment a. Susan Crate, 235 Bynum Church Road, Pittsboro, NC 27312 presented concerns of aquatic plants, animals, and vegetation impacted by sediment pollution by using curb and gutters, based on previous erosion control citations issued to Chatham Park. b. Elaine Chiosso , 1076 Rock Rest Road , Pittsboro, NC 27312 shared the last ten years Chatham Park has made verbal reassurances and promises about minimizing the impact development will have on the environment but stressed verbal assurances do not count. c. Liz Cullington, 390 Rocky Hills Road, Pittsboro, NC 27312 urged the Board to not ignore the many issues related to park design, spending , scheduling , amenities and other issues identified in written comments submitted earlier. d. Carol Hewitt, 424 Johnny Brook Road , Pittsboro, NC 27312 stated she is neither for or against Chatham Park and stated she owns a home in Chatham Park but shared a concern of who other than the developers will benefit from the proposed Small Area Plan? Chuck Smith, Chatham Park Investors, answered questions and concerns of the Board. Commissioner Shipp made a motion to approve the Small Area Plan amendments with following additional amendments, the Spine Road will be more than 300 feet from the Haw River, the tree coverage planning areas will equal the elevated shown on previous of 2  TOWN OF PITTSBORO BOARD OF COMMISSIONERS AUGUST 28, 2023 REGULAR MEETING MINUTES PAGE 3 OF 4 I twenty-three versus the current shown of seventeen, that the developer will not connect to Bynum Beach Road unless the Town requires them to, the various typo's identified will be corrected, the conditions about parks and recreation in Appendix A will be added where appropriate, seconded by Commissioner Bonitz. Vote: Aye-4 Nay-1 Commissioner Bonitz Motion carried. Commissioner Shipp made a motion for a ten-minute recess, seconded by Commissioner Bonitz. Vote: Aye-5 Nay-0 Motion carried unanimously. Mayor Perry called the meeting back to order. NEW BUSINESS 1. Budget Amendment for Fiscal Year 2023-2024-Xtreme Vac Assistant Town Manger/Director of Engineering Kent Jackson presented the item. Mayor Pro Tem Baldwin made a motion to approve the budget amendment, seconded by Commissioner Bonitz. Vote: Aye-5 Nay-0 Motion carried unanimously. FOR DISCUSSION ONLY 1. Tuition Reimbursement Assistance Program Policy Human Resources Director Jennifer Eakes presented the item. 2. Ordinance to Enact Chapter 16 of The Pittsboro Code of Ordinance: Social District Downtown Development Director Theresa Thompson presented the item. CLOSED SESSION 1. None. ADJOURNMENT Commissioner Bonitz made a motion to adjourn at 9:57pm, seconded by Commissioner Vose.
