TOWN OF PITTSBORO BOARD OF COMMISSIONERS SEPTEMBER 11, 2023 REGULAR MEETING MINUTES PAGE 1 OF 5 TOWN OF PITTSBORO The Pittsboro Board of Commissioners met in Regular Session on Monday, September 11, 2023, at 7:00pm in the meeting room at the Chatham County Agriculture and Conference Center with Mayor Cindy Perry presiding . The meeting was called to order at 7:01 pm . Mayor Perry requested a moment of silence, followed by the recitation of the Pledge of Allegiance led by Commissioner Farrell. ELECTED TOWN OFFICIALS PRESENT: Mayor Cindy S. Perry, Commissioners John Bonitz, Jay Farrell, Kyle Shipp, and James Vose. ELECTED TOWN OFFICIALS ABSENT: Mayor Pro Tern Pamela Baldwin . TOWN STAFF PRESENT: Town Manager Jonathan Franklin, Assistant Town Manager/Director of Engineering Kent Jackson, Town Attorney Paul S. Messick, Chief of Police Shorty Johnson, Downtown Development Director Theresa Thompson, Public Information Officer/Emergency Management Coordinator Colby Sawyer, Planning Director Randy Cahoon- Tingle, Finance Director Heather Meacham, Director of Parks and Recreation Katy Keller, Project Engineer Morgan DeWit and Town Clerk Carrie Bailey. ADOPTION OF THE AGENDA Mayor Perry called for a motion to either approve or modify the agenda as proposed . Mayor Pro Tern Baldwin arrived at 7:02pm. Commissioner Shipp made a motion to approve the Regular Agenda, seconded by Commissioner Vose. Vote: Aye-5 Nay-0 Motion carried unanimously. CITIZEN MATTERS 1. Manager Updates Town Manager Jonathan Franklin shared he and Randy Cahoon-Tingle attended the strategic planning process for affordable housing with Chatham County. Downtown brickwork was done to eliminate trip hazards with long-term goal of larger sidewalk project repairs in the future. Assistant Town Manager/Director of Engineering Kent Jackson shared the up-to-date schedule for DOT. Eastern side of Pittsboro loop from Sanford Road up to north of Russell Chapel Road to be completed at the end of year 2027. Dot is combining the Hillsboro Street project expansion of Launis Street to Powell Place and downtown Pittsboro with a new bid date of in April 2026. NCDOT has added a sidewalk between Thomspon Street and Launis Street which would provide a continuous sidewalk from Thompson Street to Powell Place. Mayor and Commissioner Updates and Concerns Mayor and Board members gave updates on the committees and boards on which they serve. 3. Public Comment Ron Hadley, 24 Roy Hadley Road, Pittsboro , asked the Board to consider the health, safety.welfare, to honor the environment and the public at large when making decisions related to zoning requests. CONSENT AGENDA Mayor Perry called for action on the Consent Agenda . The Consent Agenda contained the following items: 1. Minutes of the August 14, 2023 Regular Meeting of the Board of Commissioners 2. Minutes of the August 28, 2023 Regular Meeting of the Board of Commissioners 3. Tuition Reimbursement Assistance Program Policy 4. Budget Amendment for Fiscal Year 2023-2024-Donation 5. Budget Allocation Change for Fiscal Year 2023-2024-Downtown Department Commissioner Farrell made a motion to approve the Consent Agenda, seconded by Commissioner Vose. Vote: Aye-5 Nay-0 Motion carried unanimously. PUBLIC HEARINGS 1. PB-23-218 Chatham Park Landscaping Element Text Amendments Mayor Pro Tern Baldwin made a motion to enter into Public Hearing for PB-23-218, seconded by Commissioner Bonitz. Vote: Aye-5 Nay-0 Motion carried unanimously. Planning Director Randy Cahoon-Tingle presented the item to the Board. Mr. Patrick Bradshaw from Bradshaw Robinson Slawter & Rainer LLP shared clarification of the proposed landscaping amendment changes. Mayor Pro Tern Baldwin made a motion to exit Public Hearing for PB-23-218, seconded by Commissioner Vose. Vote: Aye-5 Nay-0 Motion carried unanimously. PB-23-310-Oldham Conditional Zoning Request Mayor Pro Tem Baldwin made a motion to enter into Public Hearing for PB-23-310, seconded by Commissioner Vose. Vote: Aye-5 Nay-0 Motion carried unanimously. Planning Director Randy Cahoon-Tingle presented the item to the Board. Nick Robinson of Bradshaw Robinson Slawter & Rainer LLP shared the proposed rezoning to Multi-Family residential conditional zoning which is consistent with the Land Use Plan . Gareth Avant of WithersRavenel presented an overview of the proposed request MR-1 single family, townhomes and small scales apartments/condos, and MR-2 includes single family and townhomes. Commissioner Bonitz made a motion to continue Public Hearing for PB-23-310 on September 25th, seconded by Commissioner Vose. Vote: Aye-5 Nay-0 Motion carried unanimously. 3. PB-23-289 Turkey Creek Conditional Zoning Request Commissioner Shipp made a motion to enter into Public Hearing for PB-23-289, seconded by Commissioner Vose. Vote: Aye-5 Nay-0 Motion carried unanimously. Planning Director Randy Cahoon-Tingle presented the item to the Board. Public Hearing Comments- a. Vickie and Robert Roberson, 285 Callie's Haven Way, Moncure, NC 27559 requested zoning for their property to be changed to residential agriculture to allow for additional housing construction for family members on the family farm . Commissioner Bonitz made a motion to continue Public Hearing for PB-23-289 on November 13th, seconded by Commissioner Vose. Vote: Aye-5 Nay-0 Motion carried unanimously. 4. PB-23-306-Bellemont Station MUPD Amendment Request Planning Director Randy Cahoon-Tingle requested the item to be withdrawn from the agenda and will be resubmitted after a series of meetings this week. Charter Amendment to Change Mayor Term from Two-Year to Four-Year Town Attorney Paul Messick presented the item to the Board. Commissioner Shipp made a motion to approve the ordinance that is subject to the referendum petition option, seconded by Commissioner Farrell. Vote: Aye-5 Nay-0 Motion carried unanimously. 2. Ordinance to Enact Chapter 116 of the Pittsboro Code of Ordinances: Social District Downtown Development Director Theresa Thompson presented the item to the Board . The Board provided additional thoughts and suggestions on the item. Commissioner Shipp made a motion to table until September 25th, seconded by Vose. Vote: Aye-5 Nay-0 Motion carried unanimously. NEW BUSINESS 1. Planning Board Member Appointment Mayor, Board and staff discussed the appointment process for selection of advisory board members. Discussion was to make a motion to table the item allowing review of all applications. No formal motion was made. 2. American Rescue Plan Act (ARPA) Grant Application-Pittsboro Elementary School Road Culvert Assistant Town Manager/Director of Engineering Kent Jackson presented the item to the Board. Mayor Pro Tem Baldwin made a motion to authorize Town Manager to execute and file an ARPA grant application, seconded by Vose. Vote: Aye-5 Nay-0 Motion carried unanimously. 3. Police Cadet Positions and Job Descriptions Police Chief Shorty Johnson presented the item to the Board. Commissioner Shipp made a motion to approve the Police Cadet positions and job description, seconded by Vose. Vote: Aye-5 Nay-0 Motion carried unanimously. 4. The closed session centered around items pursuant to N.C.G.S. 143-318.11 (a)(1) closed-session minutes, (a)(3) attorney client privilege discussion and (a)(6) personnel. Commissioner Shipp made a motion to enter into closed session pursuant to N.C.G.S. 143-318.11 (a)(1), (a)(3), and (a)(6), seconded by Commissioner Vose. Vote: Aye-5 Nay-0 Motion passed unanimously. Commissioner Farrell made a motion to exit closed session, seconded by Commissioner Vose. Vote: Aye-5 Nay-0 Motion passed unanimously.
