TOWN OF PITTSBORO BOARD OF COMMISSIONERS OCTOBER 9, 2023 REGULAR MEETING MINUTES PAGE 1 OF 3 TOWN OF PITTSBORO The Pittsboro Board of Commissioners met in Regular Session on Monday, October 9, 2023, at 7:00pm in the meeting room at the Chatham County Agriculture and Conference Center with Mayor Cindy Perry presiding . The meeting was called to order at 7:01 pm . Mayor Perry requested a moment of silence with the recitation of the Pledge of Allegiance led by Commissioner Farrell. ELECTED TOWN OFFICIALS PRESENT: Mayor Cindy S. Perry, Mayor Pro Tern Pamela Baldwin, Commissioners John Bonitz, Jay Farrell, Kyle Shipp, and James Vose. TOWN STAFF PRESENT: Town Manager Jonathan Franklin, Assistant Town Manager/Director of Engineering Kent Jackson, Town Attorney Paul S. Messick, Police Chief Shorty Johnson, Finance Director Heather Meacham, Public Works Director Daniel Snipes, Public Information Officer/Emergency Management Coordinator Colby Sawyer and Town Clerk Carrie Bailey. ADOPTION OF THE AGENDA Mayor Perry called for a motion to either approve or modify the agenda as proposed. Mayor Pro Tern Baldwin made a motion to approve the Regular Agenda as indicated, seconded by Commissioner Vose. Vote: Aye-5 Nay-0 Motion carried unanimously. Mayor Perry delivered the 2023 Great Trails State Day Proclamation. CITIZEN MATTERS 1. Manager Updates Town Manager Jonathan Franklin updated the Board that the strategic plan development is progressing with a draft to be made available in the next few weeks. On October 20th , the Haw River Assembly will be installing a Trash Trout in Roberson Creek to reduce litter. Franklin shared Hugh Harrington's term expires in December for ABC Board and encourages anyone interested to apply. The ABC Board is requesting a liaison to represent from the Board of Commissioners. Assistant Town Manager/Engineering Director Kent Jackson shared updates of the 1, 4 Dioxane contamination from Burlington back in September. The City of Burlington are fairly sure of the source due to high levels of 1,4 Dioxane that was sampled in the industry's trunk line. City of Burlington has issued a notice of violation to the company for exceeding the pH limits in their discharge and have met with the company and NCDEQ . City of Burlington is working on an industrial user permit for the company which will require continuous monitoring of 1,4 Dioxane. Jackson shared the State has imposed a requirement for weekly testing at the South Burlington Wastewater Treatment Plant for 1,4 Dioxane and monthly testing at both the South and East Wastewater Treatment locations in Burlington. 1 TOWN OF PITTSBORO BOARD OF COMMISSIONERS OCTOBER 9, 2023 REGULAR MEETING MINUTES PAGE 2 OF 3 2. Mayor and Commissioner Updates and Concerns Mayor and Board members gave updates on the committees and boards on which they serve. 3. Public Comment Emily Sutton, Haw River Assembly, shared the City of Asheboro is challenging their wastewater permit issued by NCDEQ which protects watersheds with a limit of 0.35ug/L for 1,4 Dioxane based on the Toxic Substances Act and would require notification of exceedance to NCDEQ and downstream communities. Haw River Assembly is asking the Town of Pittsboro to intervene in this case on behalf of NCDEQ. Vicki and Bobby Roberson , 285 Callie's Haven Way , shared updates on staff and Town Attorney discussions regarding requested zoning changes of M-2 to R-A to their parcels to allow building of permanent residence for their family members. Mr. and Mrs. Roberson shared documentation with the Board regarding bona fide farm status for zoning . CONSENT AGENDA Mayor Perry called for action on the Consent Agenda. The Consent Agenda contained the following items: 1. Minutes of the September 21 , 2023 Special Meeting of the Board of Commissioners 2. Minutes of the September 25, 2023 Regular Meeting of the Board of Commissioners 3. Budget Amendment for SDF Payment-Carry Over 4. FY 2022 State and Local Cybersecurity Grant Program Acceptance 5. Budget Amendment for State and Local Cybersecurity Grant Program (SLCGP) Grant Funds 6. A-2023-02 Voluntary Contiguous Annexation Petition for Chatham Park lnvestors-PB-23-483 7. Amend Fiscal Year 2023-2024 Budget Ordinance to Remove Deposit Fee for Shelter Rentals 8. Budget Amendment for Western Intake Partnership Regionalization Study-ARPA Grant 9. Amend Board of Commissioners Regular Meeting Schedule CY 2023 Commissioner Farrell made a motion to approve the Consent Agenda, seconded by Commissioner Vose. Vote: Aye-5 Nay-0 Motion carried unanimously. PUBLIC HEARINGS Commissioner Bonitz made a motion to enter Public Hearing, seconded by Commissioner Vose. Vote: Aye-5 Nay-0 Motion carried unanimously. 1. Community Development Block Grant (CDBG) for Economic Development for Gilero LLC Town Manager Jonathan Franklin presented the item to the Board . 2 TOWN OF PITTSBORO BOARD OF COMMISSIONERS OCTOBER 9, 2023 REGULAR MEETING MINUTES PAGE 3 OF 3 There was no one signed to speak for this public hearing. Commissioner Shipp made a motion to exit Public Hearing, seconded by Commissioner Vose. Vote: Aye- 5 Nay-0 Motion carried unanimously. Mayor Pro Tem Baldwin made a motion to authorize Mayor Perry to sign closeout forms and to congratulate Gilero for their fine improvements, seconded by Commissioner Vose. Vote: Aye- 5 Nay-0 Motion carried unanimously. OLD BUSINESS 1. None. NEW BUSINESS 1. None. FOR INFORMATION ONLY 1. Pittsboro ABC Update CLOSED SESSION 1. None.
