TOWN OF PITTSBORO BOARD OF COMMISSIONERS SEPTEMBER 25, 2023 REGULAR MEETING MINUTES PAGE 1 OF 5 TOWN OF PITTSBORO The Pittsboro Board of Commissioners met in Regular Session on Monday, September 25, 2023, at 7:00pm in the meeting room at the Chatham County Agriculture and Conference Center with Mayor Cindy Perry presiding. The meeting was called to order at 7:03pm. Mayor Perry requested a moment of silence with the recitation of the Pledge of Allegiance led by Commissioner Farrell. ELECTED TOWN OFFICIALS PRESENT: Mayor Cindy S. Perry, Mayor Pro Tern Pamela Baldwin, Commissioners John Bonitz, Jay Farrell, Kyle Shipp, and James Vose. TOWN STAFF PRESENT: Town Manager Jonathan Franklin, Assistant Town Manager/Director of Engineering Kent Jackson, Town Attorney Paul S. Messick, Deputy Chief Troy Roberson , Planning Director Randy Cahoon-Tingle, Downtown Development Director Theresa Thompson , Public Works Director Daniel Snipes, Public Information Officer/Emergency Management Coordinator Colby Sawyer and Town Clerk Carrie Bailey. ADOPTION OF THE AGENDA r Mayor Perry called for a motion to either approve or modify the agenda as proposed . Commissioner Farrell made a motion to approve the Agenda as set, seconded by Commissioner Vose. Vote: Aye-5 Nay-0 Motion carried unanimously. CITIZEN MATTERS 1. Manager Updates Town Manager Jonathan Franklin attended the community lunch on Thursday at St. Bartholomew's Church while Terry Transue shared in year 2022 the church provided twenty-three thousand (23,000) meals and trending this year to provide thirty thousand (30 ,000) meals. Franklin recently walked the grounds with Lyle Estill at The Plant and County Health Director Mike regarding building a path from The Plant to downtown. Franklin shared an update that 1, 4 dioxane numbers are getting better and anticipates an update tomorrow with the Town's most recent numbers. 2. Mayor and Commissioner Updates and Concerns Mayor and Board members gave updates on the committees and boards on which they serve. 3. The Consent Agenda contained the following items: 1. Minutes of September 11, 2023 Regular Meeting of the Board of Commissioners 2. Budget Amendment for Sanford Water Treatment Plant Expansion-Carry Over 3. Amend Fiscal Year 2023-2024 Budget Ordinance to Add Outsource Review Fee 4. Ordinance Establishing Special Event Road Closures and Alcohol Premises for the Pittsboro Rotary Club Pittsboro Street Fair 2023 5. Budget Amendment for Fire Station Location Analysis and Planning 6. Donation Acceptance/Solicitation Policy Commissioner Shipp made a motion to approve the Consent Agenda, seconded by Commissioner Vose. Vote: Aye-5 Nay-0 Motion carried unanimously. PUBLIC HEARINGS Commissioner Shipp made a motion to open Public Hearing, seconded by Commissioner Vose. Vote: Aye- 5 Nay-0 Motion carried unanimously. 1. PB-23-310 Oldham Conditional Zoning Request Planning Director Randy Cahoon-Tingle presented the item to the Board. Nick Robinson of Bradshaw, Robinson, Slawter and Ranier, 28 Hillsboro Street, representing Chatham Park Investors shared follow-up items to the Board. Public Hearing Comment Jamie Saunders, 126 Bynum Road, Pittsboro, NC 27312 shared she is happy to hear that Chatham Park is not planning to connect to Hearne Road or Bynum Beach Road. A request was made to disallow logging trucks and heavy haulers through the Hearne Road neighborhood. Mayor Perry asked Nick Robinson if Chatham Park Investors had a plan for construction traffic in the area of Hearn Road and Bynum Beach Road. Nick Robinson stated that construction equipment would not be on Hearne Road but would access through the southern part when Chatham Parkway is being constructed . 2 TOWN OF PITTSBORO BOARD OF COMMISSIONERS SEPTEMBER 25, 2023 REGULAR MEETING MINUTES PAGE 3 OF 5 Robbie Oldham of WithersRavenel, shared a greenway map to address questions from the Board. Commissioner Bonitz made a motion to close the Public Hearing, seconded by Commissioner Vose. Vote: Aye- 5 Nay-0 Motion carried unanimously. Commissioner Bonitz made a motion to send the Oldham rezoning back to staff for more thorough work and additional conditions as staff deem appropriate. The motion did not receive a second. Commissioner Shipp made a motion to approve the request with the additional conditions that were added this evening, seconded by Commissioner Vose. Vote: Aye-4 Nay-1 Commissioner Bonitz Motion carried. OLD BUSINESS 1. Ordinance to Enact Chapter 116 of the Pittsboro Code of Ordinances: Social District Downtown Development Director Theresa Thompson presented minor updates for a Social District to the item to the Board. Commissioner Shipp made a motion to approve the ordinance with the hours noted with the addition of the Saturday hours for holidays if they occur, seconded by Commissioner Vose. Vote: Aye- 3 Nay-2 Mayor Pro Tem Baldwin and Commissioner Farrell. Motion carried. NEW BUSINESS 1. Planning Board Member Appointment Planning Director Randy Cahoon-Tingle presented the item to the Board. Mayor Perry asked the Board of Commissioners for nominations for Pittsboro Planning Board. Commissioner Benitz made a motion nominate Linda Batley for ETJ Alternate, seconded by Mayor Pro Tern Baldwin. Commissioner Farrell made a motion to nominate Terry Herndon for ETJ-Alternate, seconded by Commissioner Shipp. Commissioner Vose made a motion to nominate Matthew Hayes for ETJ Alternate, seconded by Commissioner Shipp. 3 TOWN OF PITTSBORO BOARD OF COMMISSIONERS SEPTEMBER 25, 2023 REGULAR MEETING MINUTES PAGE 4 OF 5 Mayor Pro Tern Baldwin made a motion to close nominations, seconded by Commissioner Vose. Vote: Aye- 5 Nay-0 Motion carried unanimously. Mayor Perry asked for votes for Linda Batley. Mayor Pro Tem Baldwin and Commissioner Bonitz made a show of hands. Mayor Perry asked for votes for Terry Herndon. Commissioner Farrell made a show of hands. Mayor Perry asked for votes for Matthew Hayes. Commissioner Vose and Commissioner Shipp made a show of hands. Mayor Perry shared there would be a runoff between Linda Batley and Matthew Hayes. Mayor Perry asked for votes for Linda Batley for ETJ Alternate Representative. Mayor Pro Tem Baldwin and Commissioner Bonitz made a show of hands. Mayor Perry asked for votes for Matthew Hayes for ETJ Alternate Representative. Commissioner Vose, Commissioner Farrell and Commissioner Shipp made a show of hands. Mayor Perry stated Matthew Hayes will become the ETJ Alternate Representative for the Pittsboro Planning Board. Mayor Perry asked the Board of Commissioners for nominations for Pittsboro Planning Board lntown Representative. Commissioner Shipp made a motion to nominate Corey Forrest, seconded by Commissioner Farrell. Commissioner Vose made a motion to nominate Jay Walden, seconded by Commissioner Farrell. Mayor Pro Tern Baldwin made a nomination for Christina Piard, seconded by Commissioner Vose. Mayor Pro Tern Baldwin made a motion to close nominations, seconded by Commissioner Vose. Vote: Aye- 5 Nay-0 Motion carried unanimously. Mayor Perry asked for votes for Corey Forrest. Commissioner Shipp and Commissioner Farrell made a show of hands. Mayor Perry asked for votes for Jay Walden. Commissioner Vose made a show of hands. Mayor Perry asked for votes for Christina Piard. Mayor Pro Tem Baldwin and Commissioner Bonitz made a show of hands. 4 TOWN OF PITTSBORO BOARD OF COMMISSIONERS SEPTEMBER 25, 2023 REGULAR MEETING MINUTES PAGE 5 OF 5 Mayor Perry shared there would be a runoff between Corey Forrest and Christina Piard. Mayor Perry asked for votes for Corey Forrest. Commissioner Shipp, Commissioner Vose and Commissioner Farrell made a show of hands. Mayor Perry asked for votes for Christina Piard. Mayor Pro Tem Baldwin and Commissioner Bonitz made a show of hands. Mayor Perry stated Corey Forrest will become the lntown Alternate Representative for the Pittsboro Planning Board. CLOSED SESSION 1. The Board of Commissioners wish to hold a Closed Session pursuant to N.C.G.S. § 143-318.11 . (a)(3).
