TOWN OF PITTSBORO BOARD OF COMMISSIONERS NOVEMBER 13, 2023 REGULAR MEETING MINUTES PAGE 1 OF 6 TOWN OF PITTSBORO The Pittsboro Board of Commissioners met in Regular Session on Monday, November 13, 2023, at 6:00pm in the meeting room at the Chatham County Agriculture and Conference Center with Mayor Cindy Perry presiding . The meeting was called to order at 6:00pm. Mayor Perry requested a moment of silence with the recitation of the Pledge of Allegiance led by Commissioner Farrell. ELECTED TOWN OFFICIALS PRESENT: Mayor Cindy S. Perry, Mayor Pro Tern Pamela Baldwin, Commissioners John Bonitz, Jay Farrell, Kyle Shipp, and James Vose. TOWN STAFF PRESENT: Town Manager Jonathan Franklin , Assistant Town Manager/Director of Engineering Kent Jackson, Town Attorney Paul S. Messick, Chief of Police Shorty Johnson, Finance Director Heather Meacham, Planning Director Randy Cahoon-Tingle, Downtown Development Director Theresa Thompson , Public Works Director Daniel Snipes, Public Information Officer/Emergency Management Coordinator Colby Sawyer, Parks & Recreation Director Katy Keller, Planner II Eric Sanchez and Town Clerk Carrie Bailey. ADOPTION OF THE AGENDA Mayor Perry called for a motion to either approve or modify the agenda as proposed. Mayor Pro Tem Baldwin made a motion to modify the agenda under the information for preliminary plat to move item #11 and #12 to Old Business #1, seconded by Commissioner Vose. Vote: Aye-5 Nay-0 Mayor Perry presented a Resolution Recognizing Community Feed Programs Commissioner Shipp made a motion to approve the Resolution, seconded by Commissioner Vose. Vote: Aye-5 Nay-0 CITIZEN MATTERS 1. Manager Updates Town Manger Jonathan Franklin shared with the Board Homecoming event will be held Saturday November 18th , the tree lighting event will be held at 3:30 to 6:30pm on November 19th with the tree lighting at 5pm and Small Business Saturday will be November 25 th to support the Town's small businesses. Franklin acknowledged Town Attorney Paul Messick was correct in the ability to table items without naming the date on which the item should be brought back for discussion. 2. Public Comment 1. Ms. Connolly Walker and Ms. Kathie Russell of Pittsboro Rotary Club shared their appreciate of the Town of Pittsboro, Pittsboro Police, Theresa Thompson, Sam Bradburn and Public Works Department for support and sponsorship for the Pittsboro Street Fair and with one hundred thirty-five (135) vendors and three to five thousand (3000-5000) people in attendance this year. Ms. Walker shared next year's Pittsboro Street Fair will be held on Saturday October 26th . 2. Sarah Destefano of Circle City Merchants extended appreciation for the Town of Pittsboro's support of the second annual Treasure Quest event held on September 30th which had in attendance twenty (20) teams and twenty-eight (28) merchant stops. PB-23-541/A-2023-03 Voluntary Non-Contiguous Annexation Petition for Friendship Road, LLC-45 Whites Way Commissioner Shipp made a motion to approve the amended Consent Agenda, seconded by Commissioner Vose. PB-23-173 Reeves Farm Conditional Zoning Request Mayor Pro Tem Baldwin made a motion to enter into Public Hearing, seconded by Commissioner Vose. Vote: Aye- 5 Nay-0 Planning Director Randy Cahoon-Tingle presented the item to the Board. Patrick Bradshaw of Bradshaw Robinson Slawter and Rainer LLP, added further information for Board consideration. Jodi Leidolf 481 Bennett Mountain Trace shared detailed and overview maps of the project. There were no individuals requested to speak during this public hearing. Mayor Pro Tem Baldwin made a motion to exit Public Hearing, seconded by Commissioner Bonitz. Vote: Aye- 5 Nay-0 Commissioner Farrell made a motion to approve the conditional rezoning for Reeves Farm project, seconded by Mayor Pro Tem Baldwin. Vote: Aye- 5 Nay-0 Commissioner Farrell made a motion to approve the conditional rezoning request with amendments to the conditions discussed tonight for Reeves property, seconded again by Mayor Pro Tem Baldwin. Vote: Aye- 5 Nay-0 2. PB-23-289 Turkey Creek Conditional Rezoning Request Commissioner Shipp made a motion to enter into Public Hearing, seconded by Commissioner Vose. Vote: Aye- 5 Nay-0 Planning Director Randy Cahoon-Tingle presented the item to the Board. Nil Gosh of Morningstar Law Group, 700 West Main Street, Durham, shared project updates to the Board. Jeremy Medlin of GreenHawk Corporation, shared charging station information for the Board. There were no individuals requested to speak during this public hearing. Commissioner Bonitz made a motion to exit Public Hearing, seconded by Commissioner Vose. Vote: Aye- 5 Nay-0 Commissioner Bonitz made a motion for approval of the map amendment as submitted along with acceptable deletions 4K and 4Q and inclusion of the other items discussed, seconded by Commissioner Farrell. 3  TOWN OF PITTSBORO BOARD OF COMMISSIONERS NOVEMBER 13, 2023 REGULAR MEETING MINUTES PAGE4 OF 6 Town Manager Jonathan Franklin stated an amendment need to be added to mark out by the Board of Commissioners on P. The deletion of K, Q, the correction on P and then the two added as discussed of 18 and 19. Commissioner Bonitz made the motion, seconded by Commissioner Farrell. Vote: Aye- 5 Nay-0 3. PB-23-486 Text Amendment to UDO Section 3.2.4 and Add Section 3.2.5 Mayor Pro Tem Baldwin made a motion to enter into Public Hearing, seconded by Commissioner Vose. Vote: Aye- 5 Nay-0 Planning Director Randy Cahoon-Tingle presented the item to the Board . Janet Nichols shared the request is congruent with Land Use Plan. There were no individuals requested to speak during this public hearing. Commissioner Shipp made a motion to exit Public Hearing, seconded by Commissioner Vose. Vote: Aye- 5 Nay-0 Commissioner Bonitz made a motion for acceptance of the proposed text amendments including the single typographical addition, seconded by Commissioner Farrell. Vote: Aye- 5 Nay-0 4. PB-23-306 Bellemont Station MUPD Revision Request Mayor Pro Tem Baldwin made a motion to enter into Public Hearing, seconded by Commissioner Vose. Vote: Aye- 5 Nay-0 Planning Director Randy Cahoon-Tingle presented the item to the Board with updated proposed changes. Mark Ashness of CE Group, 367 Freedom Parkway, presented the revisions to the Board. Randy Voller and Candace Hunziker, representatives of Chatham Forest HOA, shared their confidence in the CE Group. Voller mentioned concerns of continued erosion control, concerns of a road over the area of old Town dump, blue line stream care, shared the approval of Bellmont Station connection to Chatham Forest and traffic calming considerations. Commissioner Bonitz made a motion to exit Public Hearing, seconded by Commissioner Vose. Vote: Aye- 5 Nay-0 Commissioner Shipp made a motion to table this item, seconded by Commissioner Vose. Vote: Aye- 5 Nay-0 Planning Director Randy Cahoon-Tingle presented the item to the Board . There were no individuals requested to speak during this public hearing. Commissioner Vose made a motion to exit Public Hearing, seconded by Commissioner Shipp. Vote: Aye- 5 Nay-0 Commissioner Shipp made a motion to approve the annexations, seconded by Commissioner Vose. Vote: Aye- 5 Nay-0 NEW BUSINESS 1. ABC Board Applications Town Manager Jonathan Franklin presented the item to the Board requesting an appointment of a board member to serve a three-year term beginning January 1, 2024. Commissioner Shipp made a motion to nominate Jonathan Franklin to serve in the open spot effective January 1, seconded by Commissioner Farrell. Vote: Aye- 5 Nay-0 Commissioner Shipp made a motion to appoint Jamie Fiacco as Chairman of the ABC Board effective January 1, seconded by Mayor Pro Tem Baldwin. Vote: Aye- 5 Nay-0 Town Manager Jonathan Franklin suggested staff present a letter to the Board to request increasing the ABC Board from three to five members. 2. The Board of Commissioners wish to hold a Closed Session pursuant to N.C.G.S. § 143-318.11. (a)(3). Commissioner Bonitz made a motion to exit closed session, seconded by Commissioner Vose. Vote: Aye- 5 Nay-0 OLD BUSINESS 1. Asheboro NPDES Permit Discussion Mayor Perry shared the item is being continued from the October 23 rd meeting with no additional disclosures with respect to the permit and the administrative law judge has not ruled. Commissioner Bonitz made a motion to table the matter indefinitely pending further updates from staff, seconded by Commissioner Vose. Vote: Aye- 5 Nay-0 Commissioner Shipp made a motion to increase the size of the ABC Board from three to five, seconded by Commissioner Bonitz.
