Vice Chair Carter called the meeting to order at 6:00 p.m. and the Pledge of Allegiance to the

Environmental Quality Act (CEQA) pursuant to California Code of Regulations, Title 14,
Chapter 3, §15060(c)(2) and §15060(c)(3); Location: Citywide; Applicant: City-

Associate Planner Hunter presented the Staff Report dated June 4, 2024.
In a single motion, Commissioner Lepper, seconded by Commissioner Smith, moved to approve
Zone Change (ZC) 2024-02 as presented; and to:
I. Adopt as part of the public record the June 4, 2024 Staff Report for Zone Change 24-
02.
II. Recommend that the City Council:
1. Find that the draft text amendments to Title 10 of the City Code, under Zone
Change 24-02, are exempt from the California Environmental Quality Act under
§15060(c)(2) and §15060(c)(3) of the CEQA Guidelines as the activity is not a
‘project’ as defined in Section 15378 of the CEQA Guidelines and has no potential
for resulting in a physical change to the environment.
2. Recommend that the City Council approve Zone Change 24-02, amending City Code
§10-5-15: Commercial Zone as described in Attachment 1 of Staff’s June 4, 2024

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLACERVILLE AMENDING TITLE 10
(ZONING), CHAPTER 5 (ZONING ORDINANCE), SECTION 15 (COMMERCIAL ZONE) OF THE
PLACERVILLE CITY CODE TO CLARIFY SUBSECTION (B), PERMITTED USES, AND SUBSECTION (C),
CONDITIONAL USES, WITH REGARDS TO A PLACE OF ENTERTAINMENT AND NEW AND USED
RETAIL SALES (Zone Change (ZC) 24-02).
THE CITY COUNCIL OF THE CITY OF PLACERVILLE DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Environmental Assessment: The amendment to Title 10 to eliminate the inconsistency
within Section 10-5-15, Commercial Zone, is exempt from the California Environmental Quality
Act (CEQA) pursuant to California Code of Regulations, Title 14, Chapter 3, Section 15060 (c)(2)
and 15060(c)(3) in that the activity is not a ‘project’ as defined in Section 15378 of the CEQA
Guidelines and has no potential for resulting in direct or indirect physical change to the
environment.
SECTION 2. Amend Placerville City Code Section 10-5-15: Commercial Zone, as follows. Proposed
language to be added is shown with double underlines; language to be removed is shown with
strikethrough.

(B)8: “Professional or business office bank, studio, place of entertainment and new and
used retail sales and retail service when fully enclosed in a building, eating or drinking
establishments, retail service, exclusive of fast-food restaurants and automobile sales or
service.”
(C)8: “Place of entertainment, new and used retail sales and retail service not fully
enclosed in a building.”
SECTION 3. Severability Clause: Should any section, clause, or provision of this Ordinance be
declared by the Courts to be invalid, the same shall not affect the validity of the Ordinance as a
whole, or parts thereof, other than the part so declared to be invalid.
SECTION 4. Effective Date: This Ordinance shall take effect thirty days from passage and adoption
under California Government Code Section 36937.
SECTION 5. Certification: The City Clerk shall certify the passage and adoption of this ordinance
and shall cause the same to be published or posted according to California Government Code
Section 36933.
The above ordinance was introduced at a regular meeting of the City Council of the City of

10.2. Zone Change (ZC) 24-03: Family Daycare Homes. Consideration of a request from the
City of Placerville to: (1) Amend Title 10 (Zoning) of the Placerville City Code to address
required 2021-2029 Housing Element Implementation Program B-7 (Family Daycare
Homes) to comply with California Health and Safety Code §1597.45; (2) Find that the
project is exempt from the California Environmental Quality Act (CEQA) pursuant to
California Code of Regulations, Title 14, Chapter 3, §15060(c)(2) and §15060(c)(3);
Location: Citywide; Applicant: City-Initiated. Staff: Kristen Hunter.
Associate Planner Hunter presented the Staff Report dated June 4, 2024. Director Rivas and
Associate Planner Hunter answered questions of the Commission.
In a single motion, Commissioner Lepper, seconded by Commissioner Smith, moved to approve
Zone Change (ZC) 2024-03 as amended; and to:

THE CITY COUNCIL OF THE CITY OF PLACERVILLE DOES HEREBY ORDAIN AS FOLLOWS:

SECTION 1. Environmental Assessment: The amendments to Title 10 to bring the City into
compliance with State laws for family daycare homes is exempt from the California Environmental
Quality Act (CEQA) pursuant to California Code of Regulations, Title 14, Chapter 3, Section 15060
(c)(2) and 15060(c)(3) in that the activity is not a ‘project’ as defined in Section 15378 of the CEQA
Guidelines and has no potential for resulting in direct or indirect physical change to the
environment. Further, CEQA does not apply to the establishment or operation of large family
daycare homes pursuant to CEQA §15274.
SECTION 2. Amend Placerville City Code Section 10-1-4: Definitions, as follows, inserted in
alphabetical order. Proposed language to be added is shown with double underlines; language to
be removed is shown with strikethrough.
10-1-4: DEFINITIONS: Certain words and phrases, when used in this Ordinance are defined
as follows; unless the context of a particular provision clearly requires a different
definition:
FAMILY DAY CARE A home which regularly provides care, protection and supervision of
DAYCARE HOME: twelve (12) fourteen (14) or fewer children for periods of less than
twenty four (24) hours per day while the parents or guardians are
away and includes the following:
Small Family Day Care Daycare Home: A home which
provides family day care to six (6) or fewer children including
children who reside at home. Facility that provides care,
protection, and supervision for eight or fewer children,
including children under ten (10) years of age who reside at
the home.
Medium Family Day Care Home: A home which provides
family day care to seven (7) to twelve (12) children inclusive
including children who reside at home.
Large Family Day Care Daycare Home: A home which
provides family day care to greater than twelve (12) children
including children who reside at home. Facility that provides
care, protection, and supervision for seven (7) to fourteen
(14) children, inclusive, including children under ten (10)
years of age who reside at the home.
SECTION 3. Amend Placerville City Code Section 10-5-4: RE, Estate Residential, as follows.

13. MATTERS FROM COMMISSIONERS AND STAFF
13.1. Staff Reports:
Associate Planner Hunter informed the Commission the next meeting is scheduled for
June 18, 2024. Associate Planner informed the Special Committee that in order to get
the revised report into the June 18, 2024 Agenda Packet, Staff would require the
document by Monday, June 10, 2024.
Associate Planner Hunter confirmed attendance for the July 2, 2024 scheduled
meeting.
Associate Planner Hunter informed the Commission that there would not be a meeting
on August 6, 2024 due to National Night Out.
Director Rivas provided an update to the Commission regarding the status of Mallard
and Middletown Affordable Housing Projects. Staff anticipates building permits within
three (3) weeks.
Director Rivas informed the Commission that Staff will be meeting with the realtor
representing the owner of the Office Max building.
Director Rivas informed the Commission that Rite Aid on Fair Lane is to be a Grocery
Outlet.

This item is for staff to update those in attendance of the status of upcoming meetings; recent
actions taken by City Council on items previously considered by the Commission; the status or
completion of City and community projects; of community-wide activities and events (e.g.
National Night Out, Wagon Train, etc.).
13.2. Planning Commission Matters:
For Commission Members this time is for updating other Members of sub-committee work
(when applicable); of updating other Members of topics and issues learned at land use and
planning conferences, workshops, webinars; general comments regarding planning and land use
within Placerville, or other items which may be within the purview of the Planning Commission.
13.2.1. Special Committee Report(s): Report by the Historic Review Special Committee
to the Planning Commission.
14. ADJOURNMENT
The Planning Commission normally ends its meetings by 10:00 pm. Items remaining on the agenda
after 10:00 PM will be continued to the next Planning Commission Meeting. The Commission meets
regularly on the first and third Tuesday of each month at Town Hall in the City Council Chambers;
additional meetings may be scheduled as needed.

GOVERNING RECULATIONS AND RULES: The Commission conducts all meetings in accordance with the
"Ralph M. Brown Act" (California Government Code Sections 54950, et seq.), per the City's Committee,
Commissions & Board Policy Manual (City Council Resolution No. 7578), and the Planning Commission
Bylaws.
MEETING ACCESS: The City of Placerville wishes to make all of its public meetings accessible to the public.
Upon request, this agenda will be made available in appropriate alternative formats to persons with
disabilities, as required by 42 U.S.C. §12132 of the Americans with Disabilities Act of 1990. Any person
with a disability who requires a modification or accommodation in order to participate in a meeting should
direct such request to the City Clerk (530) 642-5531 at least 72 hours before the meeting, if possible.

OPPORTUNITY TO APPEAL: Any aggrieved person or persons dissatisfied with a Planning Commission
decision may appeal that decision to the City Council within 10 calendar days per Government Code
Section 65009. Appeals can be made by any interested party by submittal of a written appeal request and
appeal fee to the Placerville City Clerk, 3101 Center Street, Placerville, California, 95667.
PUBLIC COMMENT: Speakers shall step up to the podium microphone to address the Commission and are
limited to a presentation of three (3) minutes, unless otherwise determined by the Chair. Groups or
organizations are encouraged to select a spokesperson to speak on their behalf.
WRITTEN COMMENT: You may submit your comments by e-mail to pv.planning@gmail.com, or in-person
at the Development Services Department, City Hall – 2nd Floor, 3101 Center Street, Placerville, CA 95667.
Interested parties are encouraged to provide written materials at least seven (7) days prior to the public
hearing to allow distribution with the Planning Commission’s agenda and provide adequate time for
review by the Planning Commission. Written comments received after the Tuesday prior to the public
hearing will be provided to the members of the Planning Commission and will be placed on the back table
for public review as part of the full agenda packet.
