Award of a Three Year Contract to Badawi & Associates for Independent Audit of the City and City Agencies for Fiscal Years Ending June 30, 2023, 2024, and 2025 It is recommended that the City Council take the following actions: 1) Award of a three year contract to Badawi & Associates for a total of $216,015 to perform an Independent Audit of the City and City Agencies for the Fiscal Years ending June 30, 2023, 2024, and 2025; and 2) Authorize the City Manager or his designee to execute the contract on behalf of the City. 7. Award of Construction Contract to All American Asphalt in the Amount of $4,119,411 It is recommended that the City Council take the following actions: 1) Award a construction contract to All American Asphalt for “Philadelphia Street Rehabilitation - From San Antonio Avenue to East City Limit (ECL),” Project No. 428- 2590-XXXXX-68577; “Buena Vista Avenue Rehabilitation - Mission Boulevard to 9th Street,” Project No. 428-2590-XXXXX-68576; and “Mission Boulevard Rehabilitation - White Avenue to Towne Ave,” Project No. 428-2590-XXXXX-68574 (All Base Bids) in the amount of $4,119,411; 2) Find that the project(s) referenced about is (are) categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301(c) and that the proposed project(s) will not have a significant effect on the environment; and 3) Authorize the City Manager, or his designee, to execute the construction contract/agreement, and related documents (permits, etc.). 11. Authorize the City Manager to Execute Future Energy Agreements on Behalf of Pomona Choice Energy It is recommended that the City Council authorize the City Manager to execute future energy agreements through FY 2022-23. 15. Consideration of a Memorandum of Understanding with the Southern California Association of Governments (SCAG) for the City of Pomona Regional Early Action Planning (REAP) Grant Transformative Climate Communities (TCC) Pomona Technical Assistance Project It is recommended that the City Council approve the Memorandum of Understanding (MOU) with SCAG and authorize the City Manager to execute the agreement on behalf of the City. 16. Mandated Biennial Review of the City’s Conflict of Interest Code It is recommended that the City Council direct staff to review the City ’s current Conflict of Interest Code. 21. Approve a Rate Increase for Five (5) Law Firms, Modify the Specialty of One (1) Law Firm and Change the Name of One (1) Law Firm on the Special Legal Panel It is recommended that the City Council take the following actions: 1) Approve rate increases for the law firms of Carpenter, Rothans and Dumont, McCune and Harber; Lagerlof, LLP, Liebert Cassidy Whitmore and Atkinson, Andelson, Loya, Rudd & Romo effective July 1, 2022; 2) Expand the Primary Specialty for Smith Law Offices, LLP to add Police Liability; 3) Approve the name change of Lagerlof, Senecal, Gosneyy & Kruse, LLP to Lagerlof, LLP; and 4) Authorize the City Manager to execute retainer agreements and /or amendments consistent with these actions. American Rescue Plan Act (ARPA) Policies and Procedures It is recommended that the City Council review and approve the Proposed ARPA Policies and Procedures. 27. Discussion on Potential Moratorium and Other Strategies to Address Cumulative Impacts From Warehousing Development in the City of Pomona It is recommended that the City Council take the following actions: 1) Engage in a Discussion on a potential moratorium and other strategies to address cumulative impacts from warehousing developments in the City of Pomona; and 2) Direct Staff to prepare necessary ordinances, procedures and studies to pursue the four strategies recommended. 28.
