Planning Commission Meeting – March 25, 2019 A meeting of the Planning Commission was held on Monday evening, March 25, 2019 at Village Justice Courtroom, 350 North Main Street, Port Chester, NY at 7:00 p.m. with Chairman Anthony Baxter presiding. Present in addition to Chairman Baxter were Commissioners Coperine, Espinoza, Montesano, Passarelli, Scarola, and Summa Also present was Village Planning Director Eric Zamft, and Assistant Planner Adam Pisarkiewicz. A building permit application has been filed but more information is needed for various aspects of the project. Aldo Vitagliano, Esq. represented this matter for the applicant. Mr. Vitagliano said that they have received the NYS DOT Permit for the work that needs to be done relative to North Main Street. Demolition permits have been filed for electrical and plumbing disconnects. Some additional work is needed on the flood panels. The Grant application from NY State used a lot of the existing time. In order to cover any additional time that is needed with the various aspects of the project an extension request is requested. On the motion of Commissioner Scarola, which was seconded by Commissioner Espinoza, the applicant was granted a 12 month extension. Mr. Vitagliano said since the last time they were before the Commission a lot of things have happened. The Zoning Board of Appeals has granted the requested variance, (lot area per dwelling unit). Additional plans were submitted on March 11th (an updated traffic report), a table of apartment sizes, revised site plan drawings and a letter from the Fire Chief which was a result of many meetings. Question from the Commission were also answered and the INI matter was resolved. Assistant Planner Adam Pisarkiewicz said that the questions requested from the commission and answered by the applicant have all been incorporated into the staff report. Many conditions were discussed last month and they are also listed in the staff report. (see below) Potential Site Plan Conditions: Post-build traffic study. (Need a specific timeline as to when this should occur) Reports from each meeting with Applicant and MTA sent to Village Staff and Planning Commission. Invite Village Engineer to MTA meetings/share info. Construction staging/phasing plan? (Should be a Building Dept. requirement post-Site Plan approval.) Installation of a green roof. Installation of internal bike-share system. Two parking spaces reserved for car-sharing service(s). Street lighting improvements. (More details required from Planning Commission.) Off-Site improvements: Planning Commission Minutes Page 8 March 25, 2019 Intersection upgrades at Pearl Street & New Broad Street intersection. (Narrowing of drive isle w/ new curbing, grass area, paint, and crosswalk.) New sidewalks along the site frontage between the Civil War Monument Park and East William Street, as well as the south side of East William Street. New Broad Street and William Street intersection - Curb bump-out on the southeast corner, new high-visibility crosswalks on the east and south legs, and new ADA pedestrian curb ramps with detectable warning strips at the. Westchester Avenue and New Broad Street Intersection – Implement leading pedestrian intervals (LPIs), install new high visibility crosswalks, and install new ADA pedestrian curb ramps with detectable warning strips. Pearl Street and Boston Post Road intersection – Adjust signal timings to improve the Pearl Street approach operations. Sharrow installation along New Broad Street. “Bicycles May Use Full Lane” Signage installed in four specific locations along New Broad Street. Entry way to Civil War Monument Park along New Broad Street will be re-routed with a new walkway and set of stairs. Obtain Entry Permit from MTA to clean out catch basin located on MTA property No wireless telecommunications facilities on roof of building. Scott Gance one of the partners on this application provided a walkthrough of the project and provided renderings of the project along with a night view as requested by the Commission After an in depth question and answer session the Commission and the applicant agreed that along with the specific conditions for site that upon 50 percent occupancy the Commission will do another review of the site for compliance.(traffic and engineering) Village Engineer Vincent Masucci said there are a couple of items that require some attention and now is a good time for those items that were addressed in his report to be taken care of. A major concern is the grease lines and the blockage preventive measures. On the motion of Commissioner Scarola, which was seconded by Commissioner Espinoza, the Public Hearing was closed. Armentano of Farrell Fritz, PC of behalf of Home Depot for property located at 150 Midland Avenue, Port Chester, NY known and designated as Section 142.61, Block 1, Lot 2 to consider a request for an amendment to Site Plan for seasonal and permanent outdoor storage of materials The applicant for this matter requested an adjournment to the March 25thth meeting while they continue to work with Village staff on outstanding issues. Because this was a Public Meeting no vote was required and the matter was adjourned to April 29, 2019 _________________________ Anthony Baxter, Chairman Planning Commission Minutes Page 11 March 25, 2019 Case #2018-0172 – Continued Public Meeting an application submitted by John Colangelo, Esq, on behalf of 305 Midland Avenue Realty Corp. on property located at 305 Midland Avenue, Port Chester, NY known and designated as Section 142.61, Block 1, Lot(s) 8 to consider request for: Renovation of existing one story repair shop; removal of existing service bays and construct convenience store with office; replace & relocate existing pumps & add 2 additional pumps. The applicant has requested an adjournment of this matter to the April 29, 2019 meeting. Because this was a Public Meeting no vote was required and the matter was adjourned to April 29, 2019 _________________________ Anthony Baxter, Chairman Planning Commission Minutes Page 12 March 25, 2019 Case #2018-0175 - Continued Public Meeting an application submitted by Daniel Mayet, AIA on behalf of Luis Lopez for property located at 7 Willow Street, Port Chester, NY known and designated as Section 141.38, Block 2, Lot 47 to consider request to: convert existing space (formerly cabaret) into a new restaurant. This matter was represented by Mario DeMarco for the applicant. Mr. DeMarco said after meeting with staff which was very helpful, the applicant has requested that the Planning Commission respectfully refer the matter to the Zoning Board of Appeals before presenting the matter before the Commission Planning Director Eric Zamft said that the biggest issue with this application is the parking which they have been discussing over the past several months. Mr. Zamft has no issues with the matter being referred to the Zoning Board of Appeals for parking variances. On the motion of Commissioner Summa, which was seconded by Commissioner Espinoza, the matter was referred to the Zoning Board of Appeals. Roll Call Member Motion Second Yes No Abstain Absent Baxter x Coperine x Espinoza x x Montesano x Passarelli x Scarola x Summa x x Wallach x _________________________ Anthony Baxter, Chairman Planning Commission Minutes Page 13 March 25, 2019 Case #2018-0186 – New Public Meeting Notice is hereby given that the Planning Commission of the Village of Port Chester, New York will hold a PUBLIC MEETING on March 25, 2019 at 7:00 pm, at the Court Room, Police Headquarters Building, 350 North Main Street, Port Chester, New York to review an application submitted by Anthony Gioffre III, Esq. of Cuddy & Feder on property located at 108 South Main Street, Port Chester, NY known and designated as Section 142.38, Block 1, Lot(s) 35, 37 to consider request for: Special Exception Use and Site Plan approvals to construct a 9 story mixed use building, with ground floor retail, second story office, 115 residential units, 104 parking spaces & residential amenity spaces Anthony Gioffre Esq. of Cuddy & Feder represented this matter for the applicant Mr. DeLaurentis, along with Phil Fructer Architect for the project. Mr. Gioffre began by saying this proposal seeks Site Plan and Special Exception Use. This is a gateway project and along with this proposal is a multi-family building with retail at grade and will have working amenity space within the building. In addition the streetscape at this intersection will be revamped. This will be a very positive and transit development oriented site as a gateway to this corner of Port Chester. Mr. Gioffre said that Mr. Fructure would walk the Board through the site plan drawings after which the applicant will be asking for referrals to other Boards.(Zoning Board of Appeals, Architectural Board of Review and to the Board of Trustees for special exception use. Mr. Fructure walked the Commission through the submitted site plan drawing and provided the Commission with rendering of the proposed sight. He answered the Boards questions with regard to the submitted documents. As part of this proposal a house on East William Street will be demolished. East William Street will be the entrance for the 3 levels of parking associated with the site. There is open amenity space on the roof of the building which will be a 3600 sq. ft. green roof. 103 parking spaces will be provided. In addition a bus shelter will be moved but will not be approved by the County until approvals are received. Mr. Masucci, Village Engineer said he did receive revised plans that responded to previous comments. The Engineering Company said that the development will not result in a significant change to impervious surfaces and the onsite retention system will reduce the amount of storm water impacting the infrastructure. The paper street Minetta Place will be maintained because the site encompasses 3 sides of the road. On the motion of Commissioner Michael Scarola, which was seconded by Commissioner Summa, the matter was referred to The Board of Trustees, The Zoning Board of Appeals and the Architectural Review Board. Member. This matter was also reviewed by the traffic Consultant which examined proposed trip generation and traffic volumes. It was proposed that a high visibility crosswalk be added at East William Street along South Main Street to provide for the additional pedestrians generated at the site. B. Hernandez, architect represented this matter for the applicant. He began by saying this is an addition to the snack shop at Mortimer and Willett Avenue which is an existing gas station which has been in place since 1925. This is a C1 Commercial District and adjacent is a residential district and across the street is the Fire Station. There is an existing snack shop of about 300 square feet and what they are proposing is to extend the sop to the rear and have a mezzanine level. When completed it will be 100 to 1200 square feet. Mr. Hernandez said this matter was before the Board under a previous owner and received Site Plan approval but no action was taken by the owner. Mr. Hernandez said that this application takes into account those items that were previously requested by the Board. The existing snack shop is in the front and they would like to extend to the back. No variances will be needed with this application. An ADA bathroom will be added in the back and a small staircase leading up to the second floor office. There will be new glass in the front and the outer facade will be stucco. There will also be 8 parking spaces one of which s ADA compliant. The vacuum and air pump will be relocated along the southern wall of the convenience store. Arborvitaes (37) will be provided along the northern and western sides of the property. Propane will be stored (must be added to the site plan) Village Engineer Vincent Masucci provided said the site plan needs more work as related to the retention pumps (10 ft. from the property line in addition the drainage plans call for a design under the 25 year storm event whereas the Building Department may require a design for the 100 year design storm. a. Where are the gasoline underground tanks located? Will they be affected by the new construction and underground retention? b. Show pitch of ramp and compliance with landing and door swing clearance under ADA regulations. Show on elevation drawings. c. Structural cover over retention system for truck/car loads to be checked. Vehicle parking is being placed over these units. Are they designed for these loads? d. Show areas of new pavement. Indicate new area of pavement being added to site. e. Provide survey of property. f. Energy Code compliance will be required by Building Department. Planning Commission Minutes Page 16 March 25, 2019 The traffic consultant provided the following recommendations for the site 1. Revise the site plan to show the correct existing curb strip and curb cut locations 2. Include directional pavement markings to indicate vehicle circulation paths in the vicinity of the curb cuts 3. Provide parking space dimensions and, if necessary, widen the parking spaces to 9 feet wide 4. Eliminate the northernmost curb cut in the proposed site plan to avoid conflict with parked vehicles 5.
