REGULAR PORT COMMISSION MEETING Tuesday, May 17, 2022, at 10:00 AM City Council Chambers | 202 N. Virginia Street, Port Lavaca TX 77979 MINUTES STATE OF TEXAS § COUNTY OF CALHOUN § CITY OF PORT LAVACA § On this the 17th day of May 2022, the Port Commission of the City of Port Lavaca, Texas, convened in regular session at 10:03 a.m. in the regular meeting place in City Council Chambers at City Hall, 202 North Virginia Street, Port Lavaca, Texas, with the following Commissioners in attendance: ROLL CALL: Alex Davila Chairman David Roberts Commissioner Mike McGuire Commissioner Sue Traylor Commissioner Mickael Kovarek Commissioner Jamie O'Neil Commissioner Larry Nichols Commissioner CALL TO ORDER: Chairman Davila called the meeting to order and presided at 10:03 a.m. COMMENTS FROM THE PUBLIC - Limited to 3 minutes per individual unless permission to speak longer is received in advance. You may make public comments as you would at a meeting on Zoom by logging on with your computer and/or smart phone as described in the zoom invitation below or on Facebook Live through the comment section, which will be monitored and answered. As appropriate. • No Comments from the Public. CONSENT AGENDA 1. APPROVAL OF MINUTES a) MINUTES OF APRIL 19TH, 2022 - REGULAR MEETING. Motion made by Commissioner Traylor NOW THEREFORE, LET IT BE RESOLVED BY THE PORT COMMISSION OF THE CITY OF PORT LAVACA, TEXAS: THAT, the minutes of the Port Commission regular meeting held on April 19, 2022, are hereby approved. Port Lavaca, TX REGULAR PORT COMMISSION MEETING May 17, 2022 Seconded by Commissioner Roberts Motion passed by the following vote: Voting Aye: Alex Davila, David Roberts, Mike McGuire, Sue Traylor, Mickael Kovarek, Larry Nichols, Jamie O'Neil. Voting Nay: None 2. RECEIVE HARBOR MASTER'S INSPECTION / MAINTENANCE REPORT ▪ A copy of these reports, in their entirety, can be found in the Port Commission's meeting packet. Agenda item discussed. No Action necessary and none taken. REPORTS 3. RECEIVE FINANCIAL REORTS OF PORT REVENUE FUND a) Tariff Report b) Account Aging Report c) Payment Report d) Revenue and Expenditure Report e) Balance Sheet f) Profit and Loss Cash Flow Report ▪ A copy of these reports, in their entirety, can be found in the Port Commission's meeting packet. Motion made by Commissioner McGuire NOW THEREFORE, LET IT BE RESOLVED BY THE PORT COMMISSION OF THE CITY OF PORT LAVACA, TEXAS: THAT, in accordance with recommendation by Port Commission hereby request that the names of the Account Holder be restored to the Account Aging Report. Seconded by Commissioner Roberts Motion passed by the following vote: Voting Aye: Alex Davila, David Roberts, Mike McGuire, Sue Traylor, Mickael Kovarek. Voting Nay: Jamie O'Neil, Larry Nichols Port Lavaca, TX REGULAR PORT COMMISSION MEETING May 17, 2022 ACTION ITEMS: RECEIVE STATUS REPORTS 4. ACTION ITEM - RECEIVE STATUS REPORTS a) Repair of hill at Scully's - Presenter Jim Rudellat ▪ Comments from Jim Rudellat, project was completed on April 24, 2022. b) Renovations to Nautical Landing Marina Breakwater - Presenter Matt Glaze ▪ Comments from Jim Rudellat, there are no new updates. C) CDBG-MIT Coastal Resilience Project / Restore Grant - Presenter Jody Weaver ▪ Interim City Manager Weaver advised Commissioners, there is no new information to report except that the engineering contract with Mott McDonald has been executed for the CDBG-MIT project. We are awaiting the date for a kick-off meeting with the engineer. 5. ACTION ITEM - RECEIVE STATUS REPORTS ON SPECIAL PROJECTS a) Voluntary Restoration of Harbor of Refuge Tract 16 - Presenter Jody Weaver ▪ Interim City Manager Weaver advised Commissioners; Lester Contracting has completed the restoration project. I also received a call from the Corps of Engineers that they changed their minds, and they will NOT require us to plant any Spartina grass. Matt Glaze and I are working to submit the proper documentation to TCEQ to close this project out. b) CRG Limited Phase II Environmental Site Assessment of Harbor of Refuge Tracts 16, 17, and 17A - Presenter Jody Weaver ▪ Interim City Manager Weaver advised Commissioners; there is no new information to report except that the CRG invoice of $27,704.00 for the additional work has been paid. This was slightly under their proposal amount, as they didn't need all the analytical time that had been budgeted. We now await TCEQ's response. 6. ACTION ITEM - RECEIVE HARBOR MASTER'S OPERATIONS, PROMOTION/DEVELOPMENT ACTIVITY REPORT a) City Harbor ▪ Marvelous Gardens completed laying sod behind Scully’s April 24th. b) Nautical Landings Building ▪ G&W Engineering is working on scope for electrical upgrade. Port Lavaca, TX REGULAR PORT COMMISSION MEETING May 17, 2022 c) Nautical Landings Marina ▪ In the process of auctioning Dominic Diodato sailboat. ▪ Matt Estes - City Attorney awaiting probate. ▪ Abandon boat – No updates ▪ Horizon Environmental has been onsite five (5) times since last PC meeting. d) Smith Harbor ▪ Dredge spoils waiting for it to dry out before moving. e) Harbor of Refuge ▪ Need council approval before cleaning up trash on Track 16. ▪ Alcoa should start hauling mulch in 3 to 4 weeks. ▪ Contracted Gonzales Contracting to make repairs to the gun range road, should start the week of 16th May 2022. 7. ACTION ITEMS - CONSIDER RENTAL RATES & TERMS FOR LEASES a) Rental Track 9 & 10 - Presenter Jim Rudellat ▪ Interim City Manager Weaver advised Commissioners Tract 9 is ready to bid. ▪ Tract 10, City Attorney is gathering information to identify the boundaries, once received both Tracts 9 & 10 can go out for bid together. b) Workshop for Leases - Presenter Jim Rudellat ▪ Chairman Alex Davila announced that Port Commission would like to schedule a Special Meeting the second week of June 2022. CLOSED SESSION 8. ANNOUNCEMENT BY THE CHAIRMAN THAT THE PORT COMMISSION WILL RETIRE TO CLOSED SESSION Chairman Alex Davila, announced that Port Commission would “Pass” on closed session No Action necessary and none taken. 9. RETURN TO OPEN SESSION AND TAKE ANY ACTION NECESSARY ON ITEM DICUSSED IN CLOSED SESSION Chairman Alex Davila announced that there would be no action taken. No Action necessary and none taken. 10. COMMENTS FROM COMMISSIONERS Agenda item discussed. No Action necessary and none taken.
