On this the 17th day of May 2022, the Port Commission of the City of Port Lavaca, Texas, convened in regular
session at 10:03 a.m. in the regular meeting place in City Council Chambers at City Hall, 202 North Virginia
Street, Port Lavaca, Texas, with the following Commissioners in attendance:

CALL TO ORDER:
Chairman Davila called the meeting to order and presided at 10:03 a.m.

1. APPROVAL OF MINUTES
a) MINUTES OF APRIL 19TH, 2022 - REGULAR MEETING.
Motion made by Commissioner Traylor
NOW THEREFORE, LET IT BE RESOLVED BY THE PORT COMMISSION OF THE CITY OF
PORT LAVACA, TEXAS:
THAT, the minutes of the Port Commission regular meeting held on April 19, 2022, are hereby
approved.

2. RECEIVE HARBOR MASTER'S INSPECTION / MAINTENANCE REPORT

Motion made by Commissioner McGuire
NOW THEREFORE, LET IT BE RESOLVED BY THE PORT COMMISSION OF THE CITY OF
PORT LAVACA, TEXAS:
THAT, in accordance with recommendation by Port Commission hereby request that the names of the
Account Holder be restored to the Account Aging Report.

a) Repair of hill at Scully's - Presenter Jim Rudellat
▪ Comments from Jim Rudellat, project was completed on April 24, 2022.
b) Renovations to Nautical Landing Marina Breakwater - Presenter Matt Glaze
▪ Comments from Jim Rudellat, there are no new updates.
C) CDBG-MIT Coastal Resilience Project / Restore Grant - Presenter Jody
Weaver
▪ Interim City Manager Weaver advised Commissioners, there is no new information
to report except that the engineering contract with Mott McDonald has been
executed for the CDBG-MIT project. We are awaiting the date for a kick-off
meeting with the engineer.
5. ACTION ITEM - RECEIVE STATUS REPORTS ON SPECIAL PROJECTS
a) Voluntary Restoration of Harbor of Refuge Tract 16 - Presenter Jody Weaver
▪ Interim City Manager Weaver advised Commissioners; Lester Contracting has
completed the restoration project. I also received a call from the Corps of Engineers
that they changed their minds, and they will NOT require us to plant any Spartina grass.
Matt Glaze and I are working to submit the proper documentation to TCEQ to
close this project out.
b) CRG Limited Phase II Environmental Site Assessment of Harbor of Refuge
Tracts 16, 17, and 17A - Presenter Jody Weaver
▪ Interim City Manager Weaver advised Commissioners; there is no new information to
report except that the CRG invoice of $27,704.00 for the additional work has been paid.
This was slightly under their proposal amount, as they didn't need all the analytical
time that had been budgeted. We now await TCEQ's response.
6. ACTION ITEM - RECEIVE HARBOR MASTER'S OPERATIONS,
PROMOTION/DEVELOPMENT ACTIVITY REPORT
a) City Harbor
▪ Marvelous Gardens completed laying sod behind Scully’s April 24th.
b) Nautical Landings Building
▪ G&W Engineering is working on scope for electrical upgrade.

c) Nautical Landings Marina
▪ In the process of auctioning Dominic Diodato sailboat.
▪ Matt Estes - City Attorney awaiting probate.
▪ Abandon boat – No updates
▪ Horizon Environmental has been onsite five (5) times since last PC meeting.
d) Smith Harbor
▪ Dredge spoils waiting for it to dry out before moving.
e) Harbor of Refuge
▪ Need council approval before cleaning up trash on Track 16.
▪ Alcoa should start hauling mulch in 3 to 4 weeks.
▪ Contracted Gonzales Contracting to make repairs to the gun range road, should start
the week of 16th May 2022.
7. ACTION ITEMS - CONSIDER RENTAL RATES & TERMS FOR LEASES
a) Rental Track 9 & 10 - Presenter Jim Rudellat
▪ Interim City Manager Weaver advised Commissioners Tract 9 is ready to bid.
▪ Tract 10, City Attorney is gathering information to identify the boundaries, once
received both Tracts 9 & 10 can go out for bid together.
b) Workshop for Leases - Presenter Jim Rudellat
▪ Chairman Alex Davila announced that Port Commission would like to schedule a
Special Meeting the second week of June 2022.

8. ANNOUNCEMENT BY THE CHAIRMAN THAT THE PORT COMMISSION
WILL RETIRE TO CLOSED SESSION
Chairman Alex Davila, announced that Port Commission would “Pass” on closed session

PUBLIC NOTICE OF MEETING
The following item will be addressed at this or any other meeting of the Port Commission upon the
request of the chairman, any member(s) of Port Commission and/or the City Attorney:
Announcement by the Chairman that Port Commission will retire into closed session for
consultation with City Attorney on matters in which the duty of the attorney to the Port
Commission under the Texas disciplinary rules of professional conduct of the state bar of Texas
clearly conflicts with the open meetings act (title 5, chapter 551, section 551.071(2) of the
Texas government code).
(All matters listed under the Consent Agenda item are routine by the Port Commission and will be
enacted by one motion. There will not be separate discussion of these items. If discussion is desired,
that item will be removed from the Consent Agenda and will be considered separately.)
