All agenda items are subject to action. The City Council Reserves the right to meet in closed session on any agenda item should the need arise and if applicable, pursuant to Chapter 551 of the Texas Government Code. ____________________________________________________________________________ AGENDA Call to Order Certification of Quorum Invocation and Pledge Moment of silence for the PVAMU student that lost his life last week in our city Citizens Comments: Citizens must complete a Comment Card and submit the card to the City Secretary before the meeting to address City Council. Limit your comments to three (3) minutes. City Council will listen to the comments, but cannot discuss or respond to the comments during the meeting. The matter may be referred to a department head, Mayor, or City Council may direct that the matter be placed on the next regular City Council Agenda. If a written response is desired from the City please request in writing. Regular Agenda 1. Consider and take action for approval of the Meeting Minutes for the Regular City Council Meeting on August 27th, 2018. 2. Consider and take action for approval of the Meeting Minutes for the Special City Council Meeting on August 18th, 2018. 3. Discuss, consider, and take action on RFP’s returned submitted to the City for consideration of the open City Attorney services. (Mayor Allen) 1 4. Status and current Planning and Zoning Applications and the next meeting. (Mr. Harrison) 5. Discuss, consider, and take action on moving the Public Tax Hearing set for September 11th at 6:00 PM at City Hall to September 17th 6:00 PM at City Hall. (JJ Johnson) From TML: September 29 – Must adopt tax rate no later than this date. TAX CODE § 26.05 (or 60th day after receipt of appraisal roll, whichever is later. If the city uses the 60 day rule, almost every date in this memo would need to be recalculated). The city council must separately approve the maintenance and operations component and the debt service component of the tax rate. TAX CODE § 26.05(a). The motion to adopt a tax rate that exceeds the effective rate must be made precisely as follows: “I move that the property tax rate be increased by the adoption of a tax rate of (specify tax rate), which is effectively a (insert percentage by which the proposed tax rate exceeds the effective tax rate) percent increase in the tax rate.” S.B. 1760 (2015) provides that if the tax rate will exceed the effective tax rate, the vote on the ordinance setting the tax rate must be a record vote and must be approved by at least 60 percent of the members of the governing body. TAX CODE § 26.05(b). Tax Code Section 26.05 contains several other precise requirements regarding notice in the tax rate ordinance itself that must be complied with if the city adopts a rate exceeding the effective tax rate Departmental Reports A. Tax Collections Report from Waller ISD City Council Reports Pursuant to Texas Government Code § 551.0415, City Council Members and City Staff may present written reports and make reports about items of community interest during a meeting of the governing body without having given notice of a report. Discuss the proposed Property Tax Rate for 2018. (Mr. Johnson) 7. Discuss, consider, and take action to create a link on the website to search for the building permit requirements. (CC Randle) 8. Discuss, consider, and take action on the City’s Contract and adopting the development process that Bureau Veritas uses with other Cities. (CC Rowland) 9. Discuss, consider, and take action on creation of a Charter Committee, to examine new recommendations for updates to the City’s Charter. (CC Randle) Executive Session (Recess Regular Session and Convene Executive Session). Consultation with Attorney as authorized by the Texas Government Code, Section 551.071. Reconvene Regular Session The Mayor and City Council Members may request that certain items be scheduled for future agenda. Requesting that items be placed on future agenda does not exclude other agenda items being added. New Business (Future Agenda Items) Adjourn The City of Prairie View City Council reserves the right to adjourn into Executive Session at any time during the course of this meeting to discuss, as authorized by Texas Government Code Sections 551.071 (Consultation with Attorney), 551.072 (Deliberations about Real Property), 551.073 (Deliberations about Gifts and Donations), 551.074 (Personnel Matters), 551.076 (Deliberations about Security Devices), and 551.086 (Economic Development). I, the undersigned authority do hereby certify that the above Notice and Agenda of the Regular Meeting of the governing body of the City of Prairie View is a true and correct copy of said Notice and said Notice was posted on the City Hall front door, a place convenient and readily accessible to the general public at all times; said Notice was posted on Friday, September 7th, 2018 by 5:00 p.m., and remained so posted continuously for at least 72 hours preceding the scheduled time for said meeting.
