CITY OF RAHWAY NEW JERSEY MUNICIPAL COUNCIL AGENDA: COMBINED MEETING March 8 ~ 7:00 P.M. “Each person addressing the Council shall first give their name and address to the Clerk. In addition, copies of notice were posted on the bulletin board in the Municipal Building and filed in the Office of the City Clerk. Notices on the bulletin board have remained continuously posted. Proper notice having been given the City Clerk is directed to include this statement in the minutes of this meeting. 4. The City of Rahway, in the County of Union, State of New Jersey (the "City") is hereby authorized to acquire new additional or replacement equipment and machinery, and a new automotive vehicle and a new fire rescue truck, including original apparatus and equipment, in, by and for said City, as more particularly described in Section 4 hereof. The cost of the improvements includes all work, materials and appurtenances necessary and suitable therefor. Section 2. There is hereby appropriated to the payment of the cost of making the improvements described in Sections 1 and 4 hereof (hereinafter referred to as "purposes"), the respective amounts of money hereinafter stated as the appropriation for said respective purposes. Said appropriation shall be met from the proceeds of the sale of the bonds authorized and the down payment appropriated by this ordinance. Said improvements shall be made as general improvements and no part of the cost thereof shall be assessed against property specially benefited. O-08-21 1 of 6 City of Rahway Section 3. It is hereby determined and stated that the making of such improvements is not a current expense of said City. Section 4. The several purposes hereby authorized for the financing of which said obligations are to be issued are set forth in the following "Schedule of Improvements, Purposes and Amounts" which schedule also shows (1) the amount of the appropriation and the estimated cost of each such purpose, and (2) the amount of each sum which is to be provided by the down payment hereinafter appropriated to finance such purposes, and (3) the estimated maximum amount of bonds and notes to be issued for each such purpose, and (4) the period of usefulness of each such purpose, according to its reasonable life, computed from the date of said bonds: SCHEDULE OF IMPROVEMENTS, PURPOSES AND AMOUNTS A. Acquisition of a new fire rescue truck, including original apparatus and equipment. Appropriation and Estimated Cost $230,000 Down Payment Appropriated $ 11,000 Bonds and Notes Authorized $219,000 Period of Usefulness 10 years B. Acquisition of new additional or replacement equipment and machinery consisting of fire hose for the use of the Fire Department. Acquisition of a new automotive vehicle, including original apparatus and equipment, consisting of an aerial bucket truck for the use of the Department of Public Works. Appropriation and Estimated Cost $260,000 Down Payment Appropriated $ 14,000 Bonds and Notes Authorized $246,000 Period of Usefulness 5 years --------------------------------------------------- Aggregate Appropriation and Estimated Cost $700,000 Aggregate Down Payment Appropriated $ 35,000 Aggregate Amount of Bonds and Notes Authorized $665,000 Section 5. The cost of such purposes, as hereinbefore stated, includes the aggregate amount of $35,000 which is estimated to be necessary to finance the cost of such purposes, including architect's fees, accounting, engineering and inspection costs, legal expenses and other expenses, including interest on such obligations to the extent permitted by Section 20 of the Local Bond Law (Chapter 2 of Title 40A of the New Jersey Statutes Annotated, as amended; the "Local Bond Law"). Section 6. It is hereby determined and stated that moneys exceeding $35,000, appropriated for down payments on capital improvements or for the capital improvement fund in budgets heretofore adopted for said City, are now available to finance said purposes. The sum of $35,000 is hereby appropriated from such moneys to the payment of the cost of said purposes. Section 7. To finance said purposes, bonds of said City of an aggregate principal amount not exceeding $665,000 are hereby authorized to be issued pursuant to the Local Bond Law. Said bonds shall bear interest at a rate per annum as may be hereafter determined within the limitations prescribed by law. All matters with respect to said bonds not determined by this ordinance shall be determined by resolutions to be hereafter adopted. O-08-21 3 of 6 City of Rahway Section 8. To finance said purposes, bond anticipation notes of said City of an aggregate principal amount not exceeding $665,000 are hereby authorized to be issued pursuant to the Local Bond Law in anticipation of the issuance of said bonds. In the event that bonds are issued pursuant to this ordinance, the aggregate amount of notes hereby authorized to be issued shall be reduced by an amount equal to the principal amount of the bonds so issued. If the aggregate amount of outstanding bonds and notes issued pursuant to this ordinance shall at any time exceed the sum first mentioned in this section, the moneys raised by the issuance of said bonds shall, to not less than the amount of such excess, be applied to the payment of such notes then outstanding. Section 9. Each bond anticipation note issued pursuant to this ordinance shall be dated on or about the date of its issuance and shall be payable not more than one year from its date, shall bear interest at a rate per annum as may be hereafter determined within the limitations prescribed by law and may be renewed from time to time pursuant to and within limitations prescribed by the Local Bond Law. Each of said bond anticipation notes shall be signed by the Mayor and by a financial officer and shall be under the seal of said City and attested by the City Clerk or Deputy City Clerk. Said officers are hereby authorized to execute said notes in such form as they may adopt in conformity with law. The power to determine any matters with respect to said notes not determined by this ordinance and also the power to sell said notes, is hereby delegated to the Chief Financial Officer who is hereby authorized to sell said notes either at one time or from time to time in the manner provided by law. Section 10. It is hereby determined and declared that the average period of usefulness of said purposes, according to their reasonable lives, taking into consideration the respective amounts of bonds or notes authorized for said purposes, is a period of 6.64 years computed from the date of said bonds. It is hereby determined and stated that the Supplemental Debt Statement required by the Local Bond Law has been duly made and filed in the office of the City Clerk of said City, and that such statement so filed shows that the gross debt of said City, as defined in Section 43 of the Local Bond Law, is increased by this ordinance by $665,000 and that the issuance of the bonds and notes authorized by this ordinance will be within all debt limitations prescribed by said Local Bond Law. Section 12. Any funds received from private parties, the County of Union, the State of New Jersey or any of their agencies or any funds received from the United States of America or any of its agencies in aid of such purposes, shall be applied to the payment of the cost of such purposes, or, if bond anticipation notes have been issued, to the payment of the bond anticipation notes, and the amount of bonds authorized for such purposes shall be reduced accordingly. Section 13. The City intends to issue the bonds or notes to finance the cost of the improvements described in Sections 1 and 4 of this bond ordinance. If the City incurs such costs prior to the issuance of the bonds or notes, the City hereby states its reasonable expectation to reimburse itself for such expenditures with the proceeds of such bonds or notes in the maximum principal amount of bonds or notes authorized by this bond ordinance. Section 14. The full faith and credit of the City are hereby pledged to the punctual payment of the principal of and the interest on the obligations authorized by this ordinance. Said obligations shall be direct, unlimited and general obligations of the City, and the City shall levy ad valorem taxes upon all the taxable real property within the City for the payment of the principal of and interest on such bonds and notes, without limitation as to rate or amount. Section 15. The capital budget is hereby amended to conform with the provisions of this ordinance to the extent of any inconsistency therewith and the resolutions O-08-21 5 of 6 City of Rahway promulgated by the Local Finance Board showing full detail of the amended capital budget and capital program as approved by the Director, Division of Local Government Services, is on file with the City Clerk and is available for public inspection. Section 16. This ordinance shall take effect twenty days after the first publication thereof after final passage. O-08-21 6 of 6 City of Rahway ORDINANCE CITY OF RAHWAY, NEW JERSEY No. O-09-21 ORDINANCE AMENDING CHAPTER 401 OF THE CODE OF THE CITY OF RAHWAY (VEHICLES AND TRAFFIC) - HANDICAPPED PARKING BE IT ORDAINED, by the Mayor and the Municipal Council of the City of Rahway, County of Union, State of New Jersey the following chapter be amended as follows: 401-80 Schedule XXI: Handicapped Parking Add: In front of 1179 Fulton Street East Side – From the apex of E Emerson Ave heading south 168’ and extending to a point 22’ south thereof. ALL ORDINANCES OR PARTS OF ORDINANCES INCONSISTENT WITH THE PROVISIONS OF THIS ORDINANCE ARE HEREBY REPEALED. THIS ORDINANCE SHALL TAKE EFFECT UPON FINAL PASSAGE AND PUBLICATION AS PROVIDED BY LAW O-10-21 1 of 1 City of Rahway RESOLUTION CITY OF RAHWAY, NEW JERSEY No. AR-83-21 RESOLUTION APPOINTING A CITY CLERK FOR THE CITY OF RAHWAY WHEREAS, the City Clerk, Rayna E. Harris, having accepted the full-time position as Administrator in the Borough of Fanwood on January 1, 2021, will leave a vacancy in the office of City Clerk; and WHEREAS, the City of Rahway extends their appreciation to Rayna E. Harris for her commitment to service as the City Clerk; and WHEREAS, Rayna E. Harris agreed to perform the duties of municipal clerk on a part-time basis for the City until a successor is appointed and qualified; and WHEREAS, the City wishes to confirm Rayna Harris’ resignation from the City of Rahway as City Clerk effective March 31, 2021; and WHEREAS, the City Council has determined to appoint Jeffrey Jotz as the City Clerk effective April 1, 2021. NOW, THEREFORE, BE IT RESOLVED by the Municipal Council of the City of Rahway, County of Union, State of New Jersey that Jeffrey Jotz is hereby appointed, effective April 1, 2021, to the position of City Clerk for the City of Rahway, and that Mr. Jotz shall assume the full-time duties of City Clerk no later than May 1, 2021 AR-83-21 1 of 1 City of Rahway RESOLUTION CITY OF RAHWAY, NEW JERSEY No. AR-84-21 RESOLUTION OF THE CITY OF RAHWAY INCREASING THE BID THRESHOLD FOR CONTRACTS SUBJECT TO PUBLIC BIDDING UNDER THE LOCAL PUBLIC CONTRACTS LAW TO $44,000 WHEREAS, the City has created the position of Qualified Purchasing Agent pursuant to N.J.S.A. 40A:11-9 to 9.1 and the regulations promulgated pursuant thereto at N.J.A.C. 5:34-5.1 to 5.5; and WHEREAS, N.J.A.C. 5:34-5.4 provides that a government unit which employs a Qualified Purchasing Agent can take advantage of the higher bid threshold of $44,000.00 pursuant to N.J.S.A. 40A: 11-3(a) and grants the authorization to negotiate and award such contracts below the bid threshold; and WHEREAS, the City of Rahway desires to take advantage of the increased bid threshold. NOW THEREFORE, BE IT RESOLVED by the Municipal Council of the City of Rahway, County of Union, State of New Jersey that the City of Rahway hereby increases the bid threshold for award of public contracts by the City from $40,000 to $44,000. AR-84-21 1 of 1 City of Rahway RESOLUTION CITY OF RAHWAY, NEW JERSEY No. AR-85-21 RESOLUTION AWARDING A CONTRACT FOR CUTTING AND CONTROL OF VEGETATION ON THE RAHWAY FLOOD CONTROL LEVEE WHEREAS, the City of Rahway has a need to contract for the cutting and control of vegetation on the Rahway flood control levee; and WHEREAS, the anticipated term of this contract is (4/1/2021 thru 12/01/2021); NOW THEREFORE, BE IT RESOLVED by the Municipal Council of the City of Rahway, County of Union, State of New Jersey that it hereby authorizes the Mayor, or the Business Administrator as his designee, and the Municipal Clerk to enter into a service contract with Sam Bonaccorso & Sons Landscape Contractor, 809 Featherbed Lane, Clark, NJ 07066 to cut and control vegetation on the Rahway flood control levee in the amount not to exceed $32,000.00. AR-95-21 1 of 1 City of Rahway RESOLUTION CITY OF RAHWAY, NEW JERSEY No. AR-96-21 RESOLUTION AUTHORIZING AN APPLICATION FOR MAIN STREET NEW JERSEY DESIGNATION AND TO ACCEPT GRANT FUNDING ON BEHALF OF THE RAHWAY ARTS AND BUSINESS PARTNERSHIP WHEREAS, Main Street New Jersey has opened submissions for designation through the New Jersey Department of Community Affairs to provide technical assistance and development support to create high-quality places and build stronger communities through preservation-based economic development across the State of New Jersey; and WHEREAS, the Main Street New Jersey program requires that the applicant, Rahway Arts and Business Partnership, show at least $100,000 in funding each year for the next three years, and this funding can come from a municipal budget, in-kind contributions, and/or other outside sources; and WHEREAS, Rahway Arts and Business Partnership is submitting an application to support economic and community development, and the Rahway Arts and Business Partnership budget comes primarily from businesses within City of Rahway. AR-107-21 2 of 2 City of Rahway ORDINANCE CITY OF RAHWAY, NEW JERSEY No. O-03-21 CAPITAL ORDINANCE OF THE CITY OF RAHWAY, IN THE COUNTY OF UNION, NEW JERSEY APPROPRIATING AN ADDITIONAL SUM OF $500,000 FOR THE UNDERTAKING OF VARIOUS IMPROVEMENTS TO MADDEN FIELD IN, BY AND FOR THE CITY AND PROVIDING THAT SUCH ADDITIONAL SUM SO APPROPRIATED SHALL BE RAISED FROM A STATE GRANT. WHEREAS, the City Council of the City of Rahway, in the County of Union, New Jersey (the "City"), has heretofore authorized the undertaking of various field and amenity improvements to Madden Field in, by and for the City and appropriated the sum of $2,250,000 therefor pursuant to ordinance no. 0-26-17 adopted by the City Council of said City on September 11, 2017 (the "Prior Ordinance"); and WHEREAS, the City Council now finds and determines that the additional sum of $500,000 is required for such improvement and that a $500,000 State grant is available to pay the additional cost of such improvement, NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Rahway, in the County of Union, New Jersey, as follows: Section 1. The additional sum of $500,000 is hereby appropriated to the payment of the cost of the improvement authorized and described in the Prior Ordinance (hereinafter referred to as "purpose"). Said appropriation shall be raised from a State grant, as hereinafter provided. The sum of $500,000 received or to be received as a grant from the State of New Jersey Department of Environmental Protection Green Acres Program is hereby appropriated to the payment of the cost of said purpose. Section 2. Said improvement is a lawful capital improvement of the City having a period of usefulness of at least five (5) years. Said improvement has been and shall be made as a general improvement, no part of the cost of which shall be assessed against property specially benefited. Section 3. The capital budget is hereby amended to conform with the provisions of this capital ordinance to the extent of any inconsistency therewith and the resolutions promul¬gated by the Local Finance Board showing full detail of the amended capital budget and capital program as approved by the Director, Division of Local Government Services, is on file with the City Clerk and is available for public inspection. O-03-21 1 of 1 City of Rahway ORDINANCE CITY OF RAHWAY, NEW JERSEY No. O-04-21 BOND ORDINANCE TO AUTHORIZE THE 2021 ROAD AND SIDEWALK IMPROVEMENT PROGRAM IN, BY AND FOR THE CITY OF RAHWAY, IN THE COUNTY OF UNION, STATE OF NEW JERSEY, TO APPROPRIATE THE SUM OF $2,550,000 TO PAY THE COST THEREOF, TO MAKE A DOWN PAYMENT, TO AUTHORIZE THE ISSUANCE OF BONDS TO FINANCE SUCH APPROPRIATION AND TO PROVIDE FOR THE ISSUANCE OF BOND ANTICIPATION NOTES IN ANTICIPATION OF THE ISSUANCE OF SUCH BONDS. BE IT ORDAINED by the City Council of the City of Rahway, in the County of Union, State of New Jersey, as follows: Section 1. The City of Rahway, in the County of Union, State of New Jersey (the "City") is hereby authorized to undertake the 2021 Road and Sidewalk Improvement Program at various locations in, by and for the City. The roads to be improved are set forth on a list on file or to be placed on file with the City Clerk and hereby approved as if set forth herein in full and available for public inspection during regular business hours. Depending upon the contract price and other exigent circumstances, and upon approval by the City Council, there may be additions to or deletions from the aforesaid list. It is hereby determined and stated that said roads being improved are of "Class B" or equivalent construction as defined in Section 22 of the Local Bond Law (Chapter 2 of Title 40A of the New Jersey Statutes Annotated, as amended; the "Local Bond Law"). Said improvements shall include all work, materials and appurtenances necessary and suitable therefor. Section 2. The sum of $2,550,000 is hereby appropriated to the payment of the cost of making the improvements described in Section 1 hereof (hereinafter referred to as "purpose"). Said appropriation shall be met from the proceeds of the sale of the bonds authorized and the down payment appropriated by this ordinance. Said improvements shall be made as general improvements and no part of the cost thereof shall be assessed against property specially benefited. Section 3. It is hereby determined and stated that (1) said purpose is not a current expense of said City, and (2) it is necessary to finance said purpose by the issuance of obligations of said City pursuant to the Local Bond Law, and (3) the estimated cost of said purpose is $2,550,000, and (4) $125,000 of said sum is to be provided by the down payment hereinafter appropriated to finance said purpose, and (5) the estimated maximum amount of bonds or notes necessary to be issued for said purpose is $2,425,000, and (6) the cost of such purpose, as hereinbefore stated, includes the aggregate amount of $500,000 which is estimated to be necessary to finance the cost of such purpose, including architect's fees, accounting, engineering and inspection costs, legal expenses and other expenses, including interest on such obligations to the extent permitted by Section 20 of the Local Bond Law. Section 4. It is hereby determined and stated that moneys exceeding $125,000, appropriated for down payments on capital improvements or for the capital O-04-21 1 of 3 City of Rahway improvement fund in budgets heretofore adopted for said City, are now available to finance said purpose. The sum of $125,000 is hereby appropriated from such moneys to the payment of the cost of said purpose. Section 5. To finance said purpose, bonds of said City of an aggregate principal amount not exceeding $2,425,000 are hereby authorized to be issued pursuant to the Local Bond Law. Said bonds shall bear interest at a rate per annum as may be hereafter determined within the limitations prescribed by law. All matters with respect to said bonds not determined by this ordinance shall be determined by resolutions to be hereafter adopted. Section 6. To finance said purpose, bond anticipation notes of said City of an aggregate principal amount not exceeding $2,425,000 are hereby authorized to be issued pursuant to the Local Bond Law in anticipation of the issuance of said bonds. In the event that bonds are issued pursuant to this ordinance, the aggregate amount of notes hereby authorized to be issued shall be reduced by an amount equal to the principal amount of the bonds so issued. If the aggregate amount of outstanding bonds and notes issued pursuant to this ordinance shall at any time exceed the sum first mentioned in this section, the moneys raised by the issuance of said bonds shall, to not less than the amount of such excess, be applied to the payment of such notes then outstanding. Section 7. Each bond anticipation note issued pursuant to this ordinance shall be dated on or about the date of its issuance and shall be payable not more than one year from its date, shall bear interest at a rate per annum as may be hereafter determined within the limitations prescribed by law and may be renewed from time to time pursuant to and within limitations prescribed by the Local Bond Law. Each of said bond anticipation notes shall be signed by the Mayor and by a financial officer and shall be under the seal of said City and attested by the City Clerk or Deputy City Clerk. Said officers are hereby authorized to execute said notes in such form as they may adopt in conformity with law. The power to determine any matters with respect to said notes not determined by this ordinance and also the power to sell said notes, is hereby delegated to the Chief Financial Officer who is hereby authorized to sell said notes either at one time or from time to time in the manner provided by law. Section 8. It is hereby determined and declared that the period of usefulness of said purpose, according to its reasonable life, is a period of ten years computed from the date of said bonds. Section 9. It is hereby determined and stated that the Supplemental Debt Statement required by the Local Bond Law has been duly made and filed in the office of the City Clerk of said City, and that such statement so filed shows that the gross debt of said City, as defined in Section 43 of the Local Bond Law, is increased by this ordinance by $2,425,000 and that the issuance of the bonds and notes authorized by this ordinance will be within all debt limitations prescribed by said Local Bond Law. Section 10. Any funds received from private parties, the County of Union, the State of New Jersey or any of their agencies or any funds received from the United States of America or any of its agencies in aid of such purpose, shall be applied to the payment of the cost of such purpose, or, if bond anticipation notes have been issued, to the payment of the bond anticipation notes, and the amount of bonds authorized for such purpose shall be reduced accordingly. The capital budget is hereby amended to conform with the provisions of this ordinance to the extent of any inconsistency therewith and the resolutions promulgated by the Local Finance Board showing full detail of the amended capital budget and capital program as approved by the Director, Division of Local Government Services, is on file with the City Clerk and is available for public inspection. Section 12. The City intends to issue the bonds or notes to finance the cost of the improvements described in Section 1 of this bond ordinance. If the City incurs such costs prior to the issuance of the bonds or notes, the City hereby states its reasonable expectation to reimburse itself for such expenditures with the proceeds of such bonds or notes in the maximum principal amount of bonds or notes authorized by this bond ordinance. Section 13. The full faith and credit of the City are hereby pledged to the punctual payment of the principal of and the interest on the obligations authorized by this ordinance. Said obligations shall be direct, unlimited and general obligations of the City, and the City shall levy ad valorem taxes upon all the taxable real property within the City for the payment of the principal of and interest on such bonds and notes, without limitation as to rate or amount. Section 14. This ordinance shall take effect twenty days after the first publication thereof after final passage. O-04-21 3 of 3 City of Rahway ORDINANCE CITY OF RAHWAY, NEW JERSEY No. O-06-21 AN ORDINANCE AMENDING CHAPTER 53: LAND USE PROCEDURES OF THE CODE OF THE CITY OF RAHWAY NOW, THEREFORE, be it ordained, by the City Council of the City of Rahway, County of Union, State of New Jersey, as follows: Section 1. § 53-33 – Applications: form; information required The following text shall replace § 53-33 in its entirety. Article V Application for Development Procedures § 53-33 Application Procedure. A. An application for development is required for all development as defined in this chapter, except that subdivision or individual lot applications for detached single-family and two- family dwelling units and their accessory buildings shall be exempt from site plan review and approval. No building permit shall be issued until approval has been given by the municipal agency for those applications requiring approval. B. A development application may take the form of a request for site plan approval, conditional use, subdivision, variance from the standards of Chapter 421, Zoning, or a combination of any of the above. C. All development applications as defined in this Chapter shall be submitted to the Administrative Officer for referral to the respective Technical Review Committee of each Board, with the exception of one-and-two-family dwellings. All applications shall conform to the requirements included in the respective Board application packets, and submission checklists in §53-34. Requests for waiver of any of the requirements of the submission checklists shall be submitted to the Administrative Officer as part of the application. D. Technical Review Committee (TRC). (1) Purpose. The Technical Review Committee is established to streamline and make the development process more cost efficient by providing assistance to applicants to address technical issues prior to applications reaching the respective Board. (2) The Technical Review Committee shall review all development applications to be presented to the Planning Board and Zoning Board of Adjustment, with the O-06-21 1 of 4 City of Rahway exception of one-and two-family dwellings. The Technical Review committee provides feedback pertaining to technical items. The Technical Review Committee’s recommendations are non-binding and do not guarantee Board Approval. The Board may request additional information or modifications to submitted applications. (3) Members. The Technical Review Committee shall be chaired by the Business Administrator or his or her designee, and consist of the Director of Community Development, the City Engineer, the City Planner, the Construction Official, the Planning or Zoning Board’s engineering and planning consultants, the Planning or Zoning Board’s attorney, and representatives from the City’s emergency services, as needed. Other officials or consultants may be required on a specific application based on their particular expertise. (4) Powers and duties. The Technical Review Committee shall: (a) Determine the completeness of all applications presented before it in accordance with the checklists and application requirements of the City. (b) Determine the adequacy of application materials provided to address technical standards set forth in the City Zoning Ordinance. (c) Determine compliance with technical standards set forth in the City Zoning Ordinance. (d) Consider and approve waivers of specific checklist requirements for completeness purposes. The Board may request additional information or modifications to submitted applications. (e) Recommend whether an environmental impact assessment, traffic impact assessment, or any other special studies should be provided. (f) Recommend whether other agency permits, or approvals should be provided. (5) Application submission and review procedure. (a) Submission. Applications shall be submitted to the City at least 15 days in advance of the scheduled Technical Review Committee meeting. (b) Reviews. The Technical Review Committee members will each issue, when appropriate, a preliminary review indicating the adequacy of the provided materials, and to provide recommended changes to the proposed project. Preliminary reviews shall be provided prior to the applicant’s scheduled meeting with the Technical Review Committee. Determinations for completeness shall be certified within 45 days of the date of submission, pursuant to the Municipal Land Use Law. O-06-21 2 of 4 City of Rahway (c) Meetings. The Technical Review Committee shall meet on the third Wednesday of the month. Minutes will be kept during TRC meetings and made available to the applicant and all TRC members. At the City’s discretion, additional or special meetings may be scheduled, based on need. (d) Applications for development shall not be scheduled for review by the Planning Board or Zoning Board of Adjustment until the Technical Review Committee has deemed the application complete in writing and indicated that all technical items have been addressed. If the TRC determines that the plans are incomplete or do not adequately address the technical standards set forth in the City Zoning Ordinance, additional meetings and the resubmission of revised plan sets may be required before the TRC can deem an application complete. Once the application has addressed all technical items and has been deemed complete, the application may proceed to the appropriate Board. At that time, the Board professionals will issue a review letter based on the Board submission. E. Applications in Redevelopment Areas. Prior to submission of formal development review by the Technical Review Committee and the Planning Board, each redeveloper shall submit detailed plans to the Rahway Redevelopment Agency (RRA) for its review. The RRA’s approval of such submission shall be based on whether the plans conform to the Redevelopment Plan and Redevelopment Agreement, if one exists at the time of conceptual review. If the RRA determines that the plans are non-conforming, RRA shall advise the Redeveloper of the issues that give rise to such non-conformance. The Redeveloper shall then revise and resubmit the plans as many times as necessary to receive approval from the RRA. If the RRA deems the submitted plans consistent with the Redevelopment Plan, a copy of that plan set shall be included in the Planning Board application, as well as any review letter or approving document created by the RRA or its professionals. Prior to review or submission in front of the Planning Board, any redevelopment application shall go through the TRC process as detailed in subsection D above. F. Review and approval of site plans and subdivisions for any property having frontage on a county road shall be required for commercial, industrial or multifamily structures containing four or more units or any land development for the above uses that require off- street parking or that produce surface runoff in excess of county standards. The municipal agency shall condition any approval that it grants upon timely receipt of a favorable report or approval by the County Planning Board's failure to report thereon within 30 days. G. At the request of the developer, the Planning Board shall grant an informal review of a concept plan for a development for which the developer intends to prepare and submit an application for development. The developer shall not be required to submit any fees for such an informal review. The developer shall not be bound by any concept plan for which review is requested, and the Planning Board shall not be bound by any such review. O-06-21 3 of 4 City of Rahway H. It is hereby determined and stated that moneys exceeding $35,000, appropriated for down payments on capital improvements or for the capital improvement fund in budgets heretofore adopted for said City, are now available to finance said purposes. The sum of $35,000 is hereby appropriated from such moneys to the payment of the cost of said purposes. Section 7. To finance said purposes, bonds of said City of an aggregate principal amount not exceeding $665,000 are hereby authorized to be issued pursuant to the Local Bond Law. Said bonds shall bear interest at a rate per annum as may be hereafter determined within the limitations prescribed by law. All matters with respect to said bonds not determined by this ordinance shall be determined by resolutions to be hereafter adopted. O-08-21 3 of 6 City of Rahway Section 8. To finance said purposes, bond anticipation notes of said City of an aggregate principal amount not exceeding $665,000 are hereby authorized to be issued pursuant to the Local Bond Law in anticipation of the issuance of said bonds. In the event that bonds are issued pursuant to this ordinance, the aggregate amount of notes hereby authorized to be issued shall be reduced by an amount equal to the principal amount of the bonds so issued. If the aggregate amount of outstanding bonds and notes issued pursuant to this ordinance shall at any time exceed the sum first mentioned in this section, the moneys raised by the issuance of said bonds shall, to not less than the amount of such excess, be applied to the payment of such notes then outstanding. Section 9. Each bond anticipation note issued pursuant to this ordinance shall be dated on or about the date of its issuance and shall be payable not more than one year from its date, shall bear interest at a rate per annum as may be hereafter determined within the limitations prescribed by law and may be renewed from time to time pursuant to and within limitations prescribed by the Local Bond Law. Each of said bond anticipation notes shall be signed by the Mayor and by a financial officer and shall be under the seal of said City and attested by the City Clerk or Deputy City Clerk. Said officers are hereby authorized to execute said notes in such form as they may adopt in conformity with law. The power to determine any matters with respect to said notes not determined by this ordinance and also the power to sell said notes, is hereby delegated to the Chief Financial Officer who is hereby authorized to sell said notes either at one time or from time to time in the manner provided by law. Section 10. It is hereby determined and declared that the average period of usefulness of said purposes, according to their reasonable lives, taking into consideration the respective amounts of bonds or notes authorized for said purposes, is a period of 6.64 years computed from the date of said bonds. It is hereby determined and stated that the Supplemental Debt Statement required by the Local Bond Law has been duly made and filed in the office of the City Clerk of said City, and that such statement so filed shows that the gross debt of said City, as defined in Section 43 of the Local Bond Law, is increased by this ordinance by $665,000 and that the issuance of the bonds and notes authorized by this ordinance will be within all debt limitations prescribed by said Local Bond Law. Section 12. Any funds received from private parties, the County of Union, the State of New Jersey or any of their agencies or any funds received from the United States of America or any of its agencies in aid of such purposes, shall be applied to the payment of the cost of such purposes, or, if bond anticipation notes have been issued, to the payment of the bond anticipation notes, and the amount of bonds authorized for such purposes shall be reduced accordingly. Section 13. The City intends to issue the bonds or notes to finance the cost of the improvements described in Sections 1 and 4 of this bond ordinance. If the City incurs such costs prior to the issuance of the bonds or notes, the City hereby states its reasonable expectation to reimburse itself for such expenditures with the proceeds of such bonds or notes in the maximum principal amount of bonds or notes authorized by this bond ordinance. Section 14. The full faith and credit of the City are hereby pledged to the punctual payment of the principal of and the interest on the obligations authorized by this ordinance. Said obligations shall be direct, unlimited and general obligations of the City, and the City shall levy ad valorem taxes upon all the taxable real property within the City for the payment of the principal of and interest on such bonds and notes, without limitation as to rate or amount. AR-88-21 2 of 2 City of Rahway RESOLUTION CITY OF RAHWAY, NEW JERSEY No. AR-89-21 RESOLUTION AUTHORIZING THE EXECUTION OF A CONTRACT BETWEEN THE CITY OF RAHWAY AND CME ASSOCIATES FOR ADDITIONAL PROFESSIONAL ENGINEERING SERVICES ASSOCIATED WITH ALLEN STREET CULVERT RETAINING WALL REPAIRS WHEREAS, the City of Rahway requires professional engineering services to address failing retaining walls adjacent to the culvert crossing Allen Street within the City of Rahway; and WHEREAS, by Resolution No. AR-23-21 CME Associates was pre-qualified to provide general engineering services to the City; and WHEREAS, by Resolution No. AR-102-20 CME Associates was approved to provide professional engineering services related to the culvert replacement and repairs at the crossing on Allen Street; and WHEREAS, the City Engineer has determined that additional repairs are required to stabilize the area; and WHEREAS, CME Associates has submitted a proposal dated September 25, 2020 to perform the aforementioned services; and WHEREAS, the City desires to award a contract to CME Associates to provide the supplementary engineering services for additional retaining wall repairs associated with the Allen Street culvert. AR-95-21 1 of 1 City of Rahway RESOLUTION CITY OF RAHWAY, NEW JERSEY No. AR-96-21 RESOLUTION AUTHORIZING AN APPLICATION FOR MAIN STREET NEW JERSEY DESIGNATION AND TO ACCEPT GRANT FUNDING ON BEHALF OF THE RAHWAY ARTS AND BUSINESS PARTNERSHIP WHEREAS, Main Street New Jersey has opened submissions for designation through the New Jersey Department of Community Affairs to provide technical assistance and development support to create high-quality places and build stronger communities through preservation-based economic development across the State of New Jersey; and WHEREAS, the Main Street New Jersey program requires that the applicant, Rahway Arts and Business Partnership, show at least $100,000 in funding each year for the next three years, and this funding can come from a municipal budget, in-kind contributions, and/or other outside sources; and WHEREAS, Rahway Arts and Business Partnership is submitting an application to support economic and community development, and the Rahway Arts and Business Partnership budget comes primarily from businesses within City of Rahway. NOW THEREFORE, BE IT RESOLVED by the Municipal Council of the City of Rahway, County of Union, State of New Jersey that it hereby supports the Rahway Arts and Business Partnership grant application to Main Street New Jersey and intends to provide funding for this economic and community development program in the amount of $100,000 per year for three years. That the compensation for such Agreement shall be in an amount of $175.00 per patient not to exceed $12,000.00. 3. AR-107-21 2 of 2 City of Rahway ORDINANCE CITY OF RAHWAY, NEW JERSEY No. O-03-21 CAPITAL ORDINANCE OF THE CITY OF RAHWAY, IN THE COUNTY OF UNION, NEW JERSEY APPROPRIATING AN ADDITIONAL SUM OF $500,000 FOR THE UNDERTAKING OF VARIOUS IMPROVEMENTS TO MADDEN FIELD IN, BY AND FOR THE CITY AND PROVIDING THAT SUCH ADDITIONAL SUM SO APPROPRIATED SHALL BE RAISED FROM A STATE GRANT. WHEREAS, the City Council of the City of Rahway, in the County of Union, New Jersey (the "City"), has heretofore authorized the undertaking of various field and amenity improvements to Madden Field in, by and for the City and appropriated the sum of $2,250,000 therefor pursuant to ordinance no. 0-26-17 adopted by the City Council of said City on September 11, 2017 (the "Prior Ordinance"); and WHEREAS, the City Council now finds and determines that the additional sum of $500,000 is required for such improvement and that a $500,000 State grant is available to pay the additional cost of such improvement, NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Rahway, in the County of Union, New Jersey, as follows: Section 1. The additional sum of $500,000 is hereby appropriated to the payment of the cost of the improvement authorized and described in the Prior Ordinance (hereinafter referred to as "purpose"). Said appropriation shall be raised from a State grant, as hereinafter provided. The sum of $500,000 received or to be received as a grant from the State of New Jersey Department of Environmental Protection Green Acres Program is hereby appropriated to the payment of the cost of said purpose. Section 2. Said improvement is a lawful capital improvement of the City having a period of usefulness of at least five (5) years. Said improvement has been and shall be made as a general improvement, no part of the cost of which shall be assessed against property specially benefited. Section 3. The capital budget is hereby amended to conform with the provisions of this capital ordinance to the extent of any inconsistency therewith and the resolutions promul¬gated by the Local Finance Board showing full detail of the amended capital budget and capital program as approved by the Director, Division of Local Government Services, is on file with the City Clerk and is available for public inspection. Section 4. This ordinance shall take effect at the time and in the manner provided by law. O-03-21 1 of 1 City of Rahway ORDINANCE CITY OF RAHWAY, NEW JERSEY No. O-04-21 BOND ORDINANCE TO AUTHORIZE THE 2021 ROAD AND SIDEWALK IMPROVEMENT PROGRAM IN, BY AND FOR THE CITY OF RAHWAY, IN THE COUNTY OF UNION, STATE OF NEW JERSEY, TO APPROPRIATE THE SUM OF $2,550,000 TO PAY THE COST THEREOF, TO MAKE A DOWN PAYMENT, TO AUTHORIZE THE ISSUANCE OF BONDS TO FINANCE SUCH APPROPRIATION AND TO PROVIDE FOR THE ISSUANCE OF BOND ANTICIPATION NOTES IN ANTICIPATION OF THE ISSUANCE OF SUCH BONDS. BE IT ORDAINED by the City Council of the City of Rahway, in the County of Union, State of New Jersey, as follows: Section 1. The City of Rahway, in the County of Union, State of New Jersey (the "City") is hereby authorized to undertake the 2021 Road and Sidewalk Improvement Program at various locations in, by and for the City. The roads to be improved are set forth on a list on file or to be placed on file with the City Clerk and hereby approved as if set forth herein in full and available for public inspection during regular business hours. Depending upon the contract price and other exigent circumstances, and upon approval by the City Council, there may be additions to or deletions from the aforesaid list. It is hereby determined and stated that said roads being improved are of "Class B" or equivalent construction as defined in Section 22 of the Local Bond Law (Chapter 2 of Title 40A of the New Jersey Statutes Annotated, as amended; the "Local Bond Law"). Said improvements shall include all work, materials and appurtenances necessary and suitable therefor. Section 2. The sum of $2,550,000 is hereby appropriated to the payment of the cost of making the improvements described in Section 1 hereof (hereinafter referred to as "purpose"). Said appropriation shall be met from the proceeds of the sale of the bonds authorized and the down payment appropriated by this ordinance. Said improvements shall be made as general improvements and no part of the cost thereof shall be assessed against property specially benefited. Section 3. It is hereby determined and stated that (1) said purpose is not a current expense of said City, and (2) it is necessary to finance said purpose by the issuance of obligations of said City pursuant to the Local Bond Law, and (3) the estimated cost of said purpose is $2,550,000, and (4) $125,000 of said sum is to be provided by the down payment hereinafter appropriated to finance said purpose, and (5) the estimated maximum amount of bonds or notes necessary to be issued for said purpose is $2,425,000, and (6) the cost of such purpose, as hereinbefore stated, includes the aggregate amount of $500,000 which is estimated to be necessary to finance the cost of such purpose, including architect's fees, accounting, engineering and inspection costs, legal expenses and other expenses, including interest on such obligations to the extent permitted by Section 20 of the Local Bond Law. Section 4. It is hereby determined and stated that moneys exceeding $125,000, appropriated for down payments on capital improvements or for the capital O-04-21 1 of 3 City of Rahway improvement fund in budgets heretofore adopted for said City, are now available to finance said purpose. The sum of $125,000 is hereby appropriated from such moneys to the payment of the cost of said purpose. Section 5. To finance said purpose, bonds of said City of an aggregate principal amount not exceeding $2,425,000 are hereby authorized to be issued pursuant to the Local Bond Law. Said bonds shall bear interest at a rate per annum as may be hereafter determined within the limitations prescribed by law. All matters with respect to said bonds not determined by this ordinance shall be determined by resolutions to be hereafter adopted. Section 6. To finance said purpose, bond anticipation notes of said City of an aggregate principal amount not exceeding $2,425,000 are hereby authorized to be issued pursuant to the Local Bond Law in anticipation of the issuance of said bonds. In the event that bonds are issued pursuant to this ordinance, the aggregate amount of notes hereby authorized to be issued shall be reduced by an amount equal to the principal amount of the bonds so issued. If the aggregate amount of outstanding bonds and notes issued pursuant to this ordinance shall at any time exceed the sum first mentioned in this section, the moneys raised by the issuance of said bonds shall, to not less than the amount of such excess, be applied to the payment of such notes then outstanding. Section 7. Each bond anticipation note issued pursuant to this ordinance shall be dated on or about the date of its issuance and shall be payable not more than one year from its date, shall bear interest at a rate per annum as may be hereafter determined within the limitations prescribed by law and may be renewed from time to time pursuant to and within limitations prescribed by the Local Bond Law. Each of said bond anticipation notes shall be signed by the Mayor and by a financial officer and shall be under the seal of said City and attested by the City Clerk or Deputy City Clerk. Said officers are hereby authorized to execute said notes in such form as they may adopt in conformity with law. The power to determine any matters with respect to said notes not determined by this ordinance and also the power to sell said notes, is hereby delegated to the Chief Financial Officer who is hereby authorized to sell said notes either at one time or from time to time in the manner provided by law. Section 8. It is hereby determined and declared that the period of usefulness of said purpose, according to its reasonable life, is a period of ten years computed from the date of said bonds. Section 9. It is hereby determined and stated that the Supplemental Debt Statement required by the Local Bond Law has been duly made and filed in the office of the City Clerk of said City, and that such statement so filed shows that the gross debt of said City, as defined in Section 43 of the Local Bond Law, is increased by this ordinance by $2,425,000 and that the issuance of the bonds and notes authorized by this ordinance will be within all debt limitations prescribed by said Local Bond Law. Section 10. Any funds received from private parties, the County of Union, the State of New Jersey or any of their agencies or any funds received from the United States of America or any of its agencies in aid of such purpose, shall be applied to the payment of the cost of such purpose, or, if bond anticipation notes have been issued, to the payment of the bond anticipation notes, and the amount of bonds authorized for such purpose shall be reduced accordingly. The capital budget is hereby amended to conform with the provisions of this ordinance to the extent of any inconsistency therewith and the resolutions promulgated by the Local Finance Board showing full detail of the amended capital budget and capital program as approved by the Director, Division of Local Government Services, is on file with the City Clerk and is available for public inspection. Section 12. The City intends to issue the bonds or notes to finance the cost of the improvements described in Section 1 of this bond ordinance. If the City incurs such costs prior to the issuance of the bonds or notes, the City hereby states its reasonable expectation to reimburse itself for such expenditures with the proceeds of such bonds or notes in the maximum principal amount of bonds or notes authorized by this bond ordinance. Section 13. The full faith and credit of the City are hereby pledged to the punctual payment of the principal of and the interest on the obligations authorized by this ordinance. Said obligations shall be direct, unlimited and general obligations of the City, and the City shall levy ad valorem taxes upon all the taxable real property within the City for the payment of the principal of and interest on such bonds and notes, without limitation as to rate or amount. Section 14. This ordinance shall take effect twenty days after the first publication thereof after final passage. O-04-21 3 of 3 City of Rahway ORDINANCE CITY OF RAHWAY, NEW JERSEY No. O-06-21 AN ORDINANCE AMENDING CHAPTER 53: LAND USE PROCEDURES OF THE CODE OF THE CITY OF RAHWAY NOW, THEREFORE, be it ordained, by the City Council of the City of Rahway, County of Union, State of New Jersey, as follows: Section 1. § 53-33 – Applications: form; information required The following text shall replace § 53-33 in its entirety. Article V Application for Development Procedures § 53-33 Application Procedure. A. An application for development is required for all development as defined in this chapter, except that subdivision or individual lot applications for detached single-family and two- family dwelling units and their accessory buildings shall be exempt from site plan review and approval. No building permit shall be issued until approval has been given by the municipal agency for those applications requiring approval. B. A development application may take the form of a request for site plan approval, conditional use, subdivision, variance from the standards of Chapter 421, Zoning, or a combination of any of the above. C. All development applications as defined in this Chapter shall be submitted to the Administrative Officer for referral to the respective Technical Review Committee of each Board, with the exception of one-and-two-family dwellings. All applications shall conform to the requirements included in the respective Board application packets, and submission checklists in §53-34. Requests for waiver of any of the requirements of the submission checklists shall be submitted to the Administrative Officer as part of the application. D. Technical Review Committee (TRC). (1) Purpose. The Technical Review Committee is established to streamline and make the development process more cost efficient by providing assistance to applicants to address technical issues prior to applications reaching the respective Board. (2) The Technical Review Committee shall review all development applications to be presented to the Planning Board and Zoning Board of Adjustment, with the O-06-21 1 of 4 City of Rahway exception of one-and two-family dwellings. The Technical Review committee provides feedback pertaining to technical items. The Technical Review Committee’s recommendations are non-binding and do not guarantee Board Approval. The Board may request additional information or modifications to submitted applications. (3) Members. The Technical Review Committee shall be chaired by the Business Administrator or his or her designee, and consist of the Director of Community Development, the City Engineer, the City Planner, the Construction Official, the Planning or Zoning Board’s engineering and planning consultants, the Planning or Zoning Board’s attorney, and representatives from the City’s emergency services, as needed. Other officials or consultants may be required on a specific application based on their particular expertise. (4) Powers and duties. The Technical Review Committee shall: (a) Determine the completeness of all applications presented before it in accordance with the checklists and application requirements of the City. (b) Determine the adequacy of application materials provided to address technical standards set forth in the City Zoning Ordinance. (c) Determine compliance with technical standards set forth in the City Zoning Ordinance. (d) Consider and approve waivers of specific checklist requirements for completeness purposes. The Board may request additional information or modifications to submitted applications. (e) Recommend whether an environmental impact assessment, traffic impact assessment, or any other special studies should be provided. (f) Recommend whether other agency permits, or approvals should be provided. (5) Application submission and review procedure. (a) Submission. Applications shall be submitted to the City at least 15 days in advance of the scheduled Technical Review Committee meeting. (b) Reviews. The Technical Review Committee members will each issue, when appropriate, a preliminary review indicating the adequacy of the provided materials, and to provide recommended changes to the proposed project. Preliminary reviews shall be provided prior to the applicant’s scheduled meeting with the Technical Review Committee. Determinations for completeness shall be certified within 45 days of the date of submission, pursuant to the Municipal Land Use Law. O-06-21 2 of 4 City of Rahway (c) Meetings. The Technical Review Committee shall meet on the third Wednesday of the month. Minutes will be kept during TRC meetings and made available to the applicant and all TRC members. At the City’s discretion, additional or special meetings may be scheduled, based on need. (d) Applications for development shall not be scheduled for review by the Planning Board or Zoning Board of Adjustment until the Technical Review Committee has deemed the application complete in writing and indicated that all technical items have been addressed. If the TRC determines that the plans are incomplete or do not adequately address the technical standards set forth in the City Zoning Ordinance, additional meetings and the resubmission of revised plan sets may be required before the TRC can deem an application complete. Once the application has addressed all technical items and has been deemed complete, the application may proceed to the appropriate Board. At that time, the Board professionals will issue a review letter based on the Board submission. E. Applications in Redevelopment Areas. Prior to submission of formal development review by the Technical Review Committee and the Planning Board, each redeveloper shall submit detailed plans to the Rahway Redevelopment Agency (RRA) for its review. The RRA’s approval of such submission shall be based on whether the plans conform to the Redevelopment Plan and Redevelopment Agreement, if one exists at the time of conceptual review. If the RRA determines that the plans are non-conforming, RRA shall advise the Redeveloper of the issues that give rise to such non-conformance. The Redeveloper shall then revise and resubmit the plans as many times as necessary to receive approval from the RRA. If the RRA deems the submitted plans consistent with the Redevelopment Plan, a copy of that plan set shall be included in the Planning Board application, as well as any review letter or approving document created by the RRA or its professionals. Prior to review or submission in front of the Planning Board, any redevelopment application shall go through the TRC process as detailed in subsection D above. F. Review and approval of site plans and subdivisions for any property having frontage on a county road shall be required for commercial, industrial or multifamily structures containing four or more units or any land development for the above uses that require off- street parking or that produce surface runoff in excess of county standards. The municipal agency shall condition any approval that it grants upon timely receipt of a favorable report or approval by the County Planning Board's failure to report thereon within 30 days. G. At the request of the developer, the Planning Board shall grant an informal review of a concept plan for a development for which the developer intends to prepare and submit an application for development. The developer shall not be required to submit any fees for such an informal review. The developer shall not be bound by any concept plan for which review is requested, and the Planning Board shall not be bound by any such review. O-06-21 3 of 4 City of Rahway H. As a condition of approval, it shall be required that the applicant submit proof that no taxes or assessments for local improvements are due or delinquent on the property for which any subdivision, site plan or planned development application is made. Section 2. All Ordinances or parts of Ordinances inconsistent herewith are repealed. Section 3. If any section, subsection, sentence, clause, phrase, or a portion of this Ordinance is for any reason held to be invalid or unconstitutional by a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions hereof. Section 4. This Ordinance shall become effective after second reading and publication as required by law.
