REGULAR PLANNING COMMISSION MEETING MINUTES DECEMBER 10, 2015 THE REGULAR MEETING OF THE RICHMOND PLANNING COMMISSION WAS CALLED TO ORDER ON THURSDAY, DECEMBER 10, 2015, AT 7:00 P.M., BY CHAIRMAN McCLELLAN. CORRESPONDENCE - City Council Meeting Minutes of November 2, 2015 - City Council Meeting Minutes of November 9, 2015 Motion by Pentzien, seconded by Kaminski, to receive and file the correspondence as presented. SCU-01-2015/Request for a Special Condition Use/Home-Based Business/Edward Weber Sr. and Edward Weber Jr./35649 Orchard Lane Motion by Moore, seconded by Zink, to open the Public Hearing at 7:01 p.m. All yeas Motion passes City Planner Jeschke informed the Commission that the Applicant was requesting a Special Condition Use for a proposed home-based business specializing in firearm accessories. The applicant has indicated that their plan is to start the business in their home to build up clientele and funding to be able to afford a retail store in the future. Orville Schaudt, 35593 Quince – Was opposed to the Special Condition Use being granted. This was a residential street and he did not feel firearms sales should take place in the neighborhood. Diane Farnam, 36031 Madison – Supported her neighbor’s desire to start his own business, but was not in support of having firearms and accessories being sold in the neighborhood. Felt this type of business would be a target for break-ins. Concerned with property values dropping. Was not against firearms, but did not feel these types of sales should take place in a neighborhood. Edward Weber Sr, the applicant, indicated that most of the transactions would take place on-line or at gun shows. He was only requesting approval to have the home-based business long enough to raise the funds necessary to open a store front. He is a hunter – he currently owns several guns which are all kept in a fire-proof/locked safe. Edward Weber Sr. further indicated that on-line sales transactions would take place at the Richmond Police Department. A written letter was received from: David Gill, 35725 Quince, speaking against the applicant’s request. Motion by Moore, seconded by Kaminski, to close the public hearing at 7:10 p.m. All yeas Motion passes PCM: 12/10/2015 Page 2 of 6 ITEMS FOR CONSIDERATION B-1. SCU-01-2015/ Request for a Special Condition Use/Home-Based Business/Edward Weber Sr. and Edward Weber Jr./35649 Orchard Lane City Planner Jeschke informed the Commission that Home Based Businesses that are not specifically called out in Section 6.205 are subject to a Special Condition Use Permit within all residential zoning districts. The City Planner indicated that the proposed business is very close to a home office. Even though the applicant will be selling retail items, the majority of the sales will not be taking place at the residence. The majority of sales will be done at trade shows, shooting clubs and via internet sales. The City Planner has spoken with the Richmond Police Chief. Chief Teske did not feel there were any safety issues because this was a web-based business. The Planner felt that the proposed home bases business will be operated in such a way that it will minimize conflict with the surrounding area and was therefore recommending approval of the requested Special Condition Use. Moore – Agreed with the Planner – based on the zoning ordinance requirements. Rix – No problem with the proposal. Would like to establish a 1-year review of the special condition use. Hopes the applicant will be able to eventually move into a store- front. Pentzien – No problem with the requested Special Condition Use. Kaminski – No problem with the request. Did question if Mr. Weber would have a supply of guns at the house for sale. Ed Weber informed the Commission that he would not be keeping a supply of guns – he would arrange for the sale of a firearm and the actual transaction could take place at the Police Department. Weinert – Felt uncomfortable with the sale of firearms and accessories taking place in a residential neighborhood – have to consider the general safety of the neighborhood. Zink – Have reservations – increasing potential for something unfortunate happening – have to consider safety of neighborhood. McClellan – Questioned what would happen with deliveries if no one was home. Mr. Weber informed the Commission that Federal guidelines require that any package be signed for. Motion by Rix, seconded by Kaminski, to approve the requested Special Condition Use for a proposed home-based business specializing in firearm accessories (clips, holsters, gun cleaning kits, reloading supplies and some ammunition) as well as web PCM: 12/10/2015 Page 3 of 6 based firearm sale on 0.22 acres location at 35649 Orchard Lane (APN: 50-07-03-35- 284-015), subject to the following condition: 1. This approval shall be subject to a one (1) year review to evaluate the use and its compatibility with the surrounding neighborhood. Six yeas (Durkee, Kaminski, McClellan, Moore, Pentzien, Rix) Two nays (Weinert, Zink) Motion passes B-2. SPR-06-2015/Site Plan Review/Al and Theresa Maniaci/69001 and 69037 Main Street City Planner Jeschke informed the Commission that the applicant was proposing to move an existing business into an existing 1,881 square foot building located at 69001 Main Street. The applicant is also proposing a 544 square foot addition to the existing building. The existing building will also be renovating the interior and exterior of the building. The proposed site plan does not meet all the requirement of the Zoning Ordinance, but does significantly comply with the ordinance and the City Planner was recommending approval of the site plan. All Commissioners were in favor of the proposed site plan – felt it would be a major improvement to this corner. Motion by Moore, seconded by Rix, to approve the requested Site Plan Review for a proposed business (Richmond Flower Shop) in an existing 1,880 square foot building and a proposed 544 square foot building addition on 0.34 acres at 69001 and 69037 Main Street (APN’s: 50-07-03-35-485-011 and 50-07-03-35-485-010)., subject to the following condition(s): 1. Prior to the issuance of any occupancy permits, the parking lot shall be restriped to indicate the appropriate parking space locations and dimensions as well as all emblems and signage required for a van accessible barrier-free parking space. 2. Prior to the issuance of any occupancy permits, the applicant shall submit for all appropriate building and trades permits. 3. The applicant shall work with City Staff on landscaping along the Main Street frontage of the site that will complement the existing streetscape improvements as well as the adjacent trailhead park. PIR-01-2015/Public Improvement Review/City of Richmond/Water and Roadway improvements to Pound Road City Planner Jeschke informed the Commission that the City was proposing water and roadway improvements to Pound Road. DPS Director Goetzinger informed the Commission that the scope of work involves increasing the water main under Pound Road from 4-inch cast iron to 12-inch ductile iron. The proposed roadway will be widened from 22’ wide with no curb to 31’ wide with enclosed ditches, curb and gutter. Commissioners expressed concern with speeding that may occur once the improvements are made. The possibility of a stop sign at Karen/Pound was discussed. Zink – Questioned if now was the time to install sidewalk along Pound Road. City Manager Moore informed the Commission that there could be a SWIP program in the future, once the economy improves to a point where the City has funds to pay for ½ of sidewalk installation. Motion by Pentzien, seconded by Weinert, to approve the Public Improvement Review Request for a proposed water and road project on Pound Road. All yeas Motion passes B-4. Request to change April 2016 meeting date. City Planner Jeschke requested that the Commission change the April 2016 Planning Commission meeting date to April 21, 2016, to allow the City Planner to attend training in Lansing. Commissioners approved of this request. MISCELLANEOUS MATTERS FROM THE CITY STAFF City Manager Moore invited Commissions to the City’s Open House which will be held December 21st from 6-8 p.m. City Planner Jeschke informed the Commission that the last Lumberjack parcel has been bought – the site plan will be coming before the Commission in January – a 20,000 square foot medical facility is being proposed.
