REGULAR PLANNING COMMISSION MEETING MINUTES JULY 13, 2017 THE REGULAR MEETING OF THE RICHMOND PLANNING COMMISSION WAS CALLED TO ORDER ON THURSDAY, JULY 13, 2017, AT 7:00 P.M., BY CHAIRMAN McCLELLAN. ROLL CALL Present: Frank, Kaminski, Majchrzak, McClellan, Moore, Rix, Weinert, Zink Absent: Durkee Others: City Planner Jeschke, City Clerk Stagl Visitors: Mayor Pro-Tem Misteravich, Takeisha Zeigler, DeAngelo Zeigler, Jr. Motion by Moore, seconded by Rix, to excuse Commissioner Durkee from tonight’s meeting, due to being out of town. All yeas Motion passes APPROVAL OF MINUTES Motion by Rix, seconded by Kaminski, to approve the minutes of the June 8, 2017, regular meeting as presented. All yeas Motion passes AUDIENCE PARTICIPATION None. CORRESPONDENCE City Council Meeting Minutes of May 15, 2017 City Council Meeting Minutes of June 5, 2017 Motion by Kaminski, seconded by Zink, to receive and file the correspondence as presented. All yeas Motion passes PCM: 07/13/2017 Page 1 of 4 ADOPTION OF AGENDA Motion by Moore, seconded by Kaminski, to adopt the Agenda as presented. All yeas Motion passes PUBLIC HEARING A.-1. PCD-01-2017/Takeisha Ziegler/Request for a Preferred Class Designation/67926 Howard Street Motion by Moore, seconded by Frank, to open the Public Hearing at 7:01 p.m. All yeas Motion passes City Planner Jeschke informed the Commission that a preferred class designation allows the City to approve nonconforming uses in locations where they otherwise would not be allowed, provided the use does not adversely impact the surrounding area. This property is currently zoned R-3. Under that designation the only uses allowed on the property are detached single family residential uses and a few other uses such as child care and foster group homes for less than six. The Preferred Class Designation allows the City to “bend the rules” for this particular use. Historically this property has been used as a Dependent Elderly Housing Congregate Care Facility. The facility has been closed for a number of years. The applicant is proposing to reopen the facility as a dependent elderly care facility. No written or verbal comments were received. Motion by Rix, seconded by Moore, to close the public hearing at 7:04 p.m. All yeas Motion passes ITEMS FOR CONSIDERATION B-1. PCD-01-2017/Takeisha Ziegler/Preferred Class Designation/67926 Howard Street City Planner Jeschke informed the Commission that the applicant was requesting a Preferred Class Designation. The property is currently zoned R-3. Under that designation, the only uses allowed on the property are detached single family residential uses and a few other uses such as child care and foster group homes for less than six. The options for this property are very limited. In lieu of rezoning the property which could result in undesirable uses being allowed on the property in the future; the Preferred Class Designation allows the City to “bend the rules” for only this particular use. PCM: 07/13/2017 Page 2 of 4 The applicant is proposing to reopen the facility as a dependent elderly care facility. The applicant would like to be allowed to have up to 20 residents. However, the applicant expects with the state licensing requirements as well as their proposed renovations to the entire building, the true number of residents would probably be less than 20. The applicant is proposing to construct a driveway adjacent to the south of the entrance which will be able to accommodate three vehicles parked in a single file. Takeisha Ziegler informed the Commission that her business plan is for 12 occupants. She is reworking the sizes of the rooms and hallways. The City Planner was recommending approval with four conditions. Motion by Zink, seconded by Frank, to approve the Preferred Class Designation for a nonconforming use and a Site Plan Review from Takeisha Ziegler for a proposal to allow a Dependent Elderly Housing Congregate Care Facility on property located at 67926 Howard Street (APN: 50-07-06-01-308-016), subject to the following conditions: 1. If the building is vacant for more than one (1) year after this approval the preferred class designation of this property shall be null and void. 2. The only use of this property shall be as a Dependent Elderly Housing Congregate Care Facility. Any change in the proposed use of the property will necessitate a reconsideration of this Preferred Class Designation and require a new public hearing. 3. Per Article 25 (Definitions) of the Zoning Ordinance, the proposed Dependent Elderly Housing Congregate Care Facility shall be allowed to house male and female resident age 60 or older. Additionally, the applicant may house up to twenty (20) residents; provided they are in compliance with all state licensing and building/zoning requirements. 4. The applicant shall work with the planning and building department regarding the layout of the driveway as well as submit for all required building and related building/trade permits, sign permits, and occupancy permits through the City of Richmond Building Department. All yeas Motion passes B-2. Election of Officers Motion by Kaminski, seconded by Frank, to nominate Dr. McClellan as chairperson of the Planning Commission for Fiscal Year 2017-2018. All yeas Motion passes Motion by Rix, seconded by Frank, to close the nominations. All yeas Motion passes PCM: 07/13/2017 Page 3 of 4 Dr. McClellan is the Chairperson for FY2017-2018. Motion by Kaminski, seconded by Frank, to nominate Mark Zink as vice chairperson of the Planning Commission for Fiscal Year 2017-2018. All yeas Motion passes Motion by Moore, seconded by Frank, to close the nominations. All yeas Motion passes Mark Zink is the Vice Chairperson for FY2017-2018. MISCELLANEOUS MATTERS FROM THE CITY STAFF Moore – The City Manager and City Planner met with the new owners of the Kmart Plaza. They are working towards getting the property occupied. - The City Planner and Public Works director met with the potential applicant for a new Burger King restaurant, at the former Brengman’s site. Discussion on what other types of potential businesses could be developed on this site. City Planner Jeschke informed the Commission that a sit-down restaurant would require a larger parking area and any new building will have to comply with the zoning ordinances set-back requirements. Discussion on requiring a developer to provide coordinated parking. City Manager Moore informed the Commission that Administration was considering making coordinated parking a requirement in the zoning ordinance. COMMENTS FROM CHAIRMAN AND COMMISSION MEMBERS Majchrzak – Commented on how dark the parking lot it where the new micro-brewery is proposed. He asked what could be done regarding lighting.
