REGULAR PLANNING COMMISSION MEETING MINUTES AUGUST 10, 2017 THE REGULAR MEETING OF THE RICHMOND PLANNING COMMISSION WAS CALLED TO ORDER ON THURSDAY, AUGUST, 2017, AT 7:00 P.M., BY VICE-CHAIRMAN ZINK ROLL CALL Present: Durkee, Frank, Majchrzak, Moore, Rix, Weinert, Zink Absent: Kaminski, McClellan Others: City Planner Jeschke, City Clerk Stagl Visitors: Ken Simmons, Jeff Schroeder, Britney Shea, Allan Press, Wayne Baumgarten, Alison Koch APPROVAL OF MINUTES Motion by Rix, seconded by Weinert, to approve the minutes of the July 13, 2017, regular meeting as presented. All yeas Motion passes AUDIENCE PARTICIPATION None. CORRESPONDENCE City Council Meeting Minutes of June 19, 2017 City Council Meeting Minutes of July 5, 2017 Motion by Moore, seconded by Frank, to receive and file the correspondence as presented. All yeas Motion passes ADOPTION OF AGENDA Motion by Rix, seconded by Frank, to adopt the Agenda as presented. All yeas Motion passes PCM: 08/10/2017 Page 1 of 6 PUBLIC HEARING A-1. SCU-02-2017/Carrols Corporation/Special Use Request/67020 Gratiot Avenue Motion by Moore, seconded by Rix, to open the Public Hearing at 7:03 p.m. All yeas Motion passes City Planner Jeschke informed the Commission that the applicant was requesting a special condition use permit to allow a drive-through facility in conjunction with the proposed Burger King Restaurant. In accordance with the City’s zoning ordinance, all drive-through’s require a special condition use permit. Ken Simmons, spoke on behalf of St. Peter’s Schools – expressed his concerns with the increased amount of traffic on Gratiot that will be created by the proposed business, especially in the mornings when school began and in the evenings when school ended. He questioned this location was the right location for this type of a business. Motion by Moore, seconded by Frank, to close the Public Hearing at 7:09 p.m. All yeas Motion passes ITEMS FOR CONSIDERATION B-1. SCU-02-2017/Carrols Corporation/Special Condition Use Permit/Drive-through Facility in conjunction with the proposed Burger King/67020 Gratiot Avenue City Planner Jeschke informed the Commission that the application was requesting permission to install a drive-through lane for a proposed Burger King restaurant. The proposed 3,020 square foot restaurant is situated toward the northwestern area of the site. The proposed drive-through is situated on the north side of the proposed restaurant. City Planner Jeschke informed the Commission that a sit-down restaurant could not exist on this site under the City’s current set-back requirements. The proposed drive- through and Burger King restaurant meets all City ordinance requirements and MDOT requirements. In his opinion, the drive-through may affect St. Peter’s in the mornings and only on 31 Mile Road. Based on the facts that the proposed restaurant and drive-through meets all setbacks, and ordinance requirements, the City Planner was recommending approval of the Special Condition Use Permit. PCM: 08/10/2017 Page 2 of 6 Majchrzak expressed some concerns with the timing of the light at 31 Mile Road for left turns from Gratiot onto 31 Mile Road. Other Commissioners expressed concerns with the increased traffic congestion. The Engineer, Allan Pruss, informed the Commission that they would explore with MDOT the possibility of a deceleration lane. The possibility of having the speed limit on Gratiot reduced was discussed, also prohibiting left turns from Gratiot into the proposed restaurant. Motion by Moore, seconded by Frank, to approve the requested Special Condition Use Permit to allow a drive-through facility in conjunction with a proposed fast food restaurant (Burger King) on 1.02 acres of property located at 67020 Gratiot Avenue (APN: 50-07-06-02-477-015), subject to the following condition: 1. The applicant or designee of the applicant shall seek approval for a deceleration lane for Northbound M-19 (Gratiot Avenue) traffic while going through the driveway permitting process with the Michigan Department of Transportation. All yeas Motion passes B-2. SPR-02-2017/Carrol Corporation/Site Plan Review/Burger King Restaurant/67020 Gratiot Avenue City Planner Jeschke informed the Commission that the applicant was proposing a 3,020 square foot Burger King Fast food restaurant. The building is rectangular in shape with the long side parallel to 31 Mile Road. The restaurant will feature a drive- through situated on the north side of the proposed building and parking situated primarily to the south of the building. Motion by Rix, seconded by Frank, to approve the requested Site Plan Review (plans dated July 19, 2017 and August 8, 2017) for a proposed fast food restaurant (Burger King) on 1.02 acres of property located at 67020 Gratiot Avenue (APN: 50-07-06-01- 477-015), subject to the following conditions: 1. Prior to the issuance of any building permits, the site plan shall be amended to restrict egress movement onto Gratiot Avenue (M019) as a right-turn only movement by adding an island within the driveway. All appropriate marking and signage shall be required. 2. The applicant shall submit for sign permits for all proposed wall and freestanding signage that meets or exceeds the Zoning Ordinance requirements. 3. Prior to the issuance of any building permits, the applicant shall comply with the all conditions as required by the city engineering consultant, Tetra Tech. PCM: 08/10/2017 Page 3 of 6 Discussion on Motion: Rix – Expressed his concerns with the traffic and safety issues. Questioned if we could prohibit left turn traffic into the business from Main Street. City Planner Jeschke indicated that the City could prohibit left turns from Gratiot into the business. Vote on Motion: All yeas Motion passes Ken Simmons stated that he felt the deceleration lane and prohibiting left turn into the business from Gratiot would help to improve the traffic safety issues in this area. B-3. Macomb County Planning & Economic Development Department/Discussion on Future Land Use Section of the Master Plan City Planner Jeschke informed the Commission that the proposed Future Land Use Map had been discussed by the Commission at the May meeting. The proposed land use map has been amended to show the designation for churches changed to match the surrounding neighborhood characteristics. Another proposed changed to the future land use map is the removal of the mobile home park designation. City Planner Jeschke informed the Commission that the City does have mobile home zoning. Mobile home are a possible use in the multiple family residential districts – the applicant would have to petition for a rezoning. Commissioners felt they had more control if the mobile home designation remained in the future land use map. City Planner Jeschke would make the change. Discussion on church designations in future land use map. City Planner Jeschke informed the Commission that the change was made so that in the event a church ceased to operate as a church a potential applicant had an idea of what could go into the site. City Manager Moore further explained that in some areas the neighborhood church would be designated as residential – if the church ceased to exist that property would be able to be redeveloped as residential. Jeff Schroeder stated that for future land use designation we should try to have them match the zonings. Some Commissioners were not comfortable with changing the designations for all churches. City Planner Jeschke informed the Commission that the future land use designation does not affect the current zoning of the church. PCM: 08/10/2017 Page 4 of 6 Jeff Schroeder recommended that we designate the future land use as what we would want to see the land developed as if the churches ceased to exist. Discussion on the properties on 31 Mile Road – we are proposing that the properties remain as how they are currently designated – Highway Commercial. Discussion on changing an additional two (2) properties from multiple family to highway commercial. Discussed the 10 acre parcel on Gratiot that is in Richmond and Casco Township – it is proposed that this will change from multiple family to highway commercial. Commissioner Rix at 9:00 p.m. to attend another meeting. City Planner Jeschke informed the Commission that next month the goals and objectives would be presented to the Commission. Once all the changes are made the Commission will get a full copy of the proposed master plan. B-4. TXT-01-2017/City of Richmond/Review of proposed Text Amendment to Article 13 and Article 25 of the City of Richmond Zoning Ordinance City Planner Jeschke presented the Commission with a proposed Text Amendment to Article 13 and Article 25 of the Zoning Ordinance to amend the definition of animated copy on signs. The proposed Text Amendment would come before the Commission at the September meeting for a public hearing. The consensus of the Commission was to move forward with the ordinance amendment as presented. MISCELLANEOUS MATTERS FROM THE CITY STAFF City Manager Moore informed the Commission that Main Street would be shutdown beginning on Monday August 14th for reconstruction of the railroad tracks. City Planner Jeschke informed the Commission that the new owners of Kmart Plaza were working on improvements to the Plaza. COMMENTS FROM CHAIRMAN AND COMMISSION MEMBERS Weinert – The Historical barn will be reconstructed next week. - Commented on the blight condition of the old Sunoco Station on Gratiot.
