All yeas Motion passes ADOPTION OF AGENDA Motion by Moore, seconded by Kaminski, to adopt the Agenda as presented. All yeas Motion passes PUBLIC HEARING A-1. REZ-05-2017/M19 Development, LLC/Request for Rezoning of 37305 31 Mile from RM-1 to B-3 Motion by Moore, seconded by Kaminski, to open the Public Hearing at 7:02 p.m. All yeas Motion passes City Planner Jeschke informed the Commission that this item has been before the Commission in January 2017. The Commission at that time denied the rezoning request, but requested that the petitioner present a conceptual plan that indicated the potential future use. The applicant is now resubmitting a “conceptual” site plan and information of who the tenant is proposed to be at this time. The proposed use being planned is for the expansion of an auto storage area of Huvaere Chrysler, Dodge, and Jeep. Joe Brickel, 37275 31 Mile Road, informed the Commission that he lived right next door to this proposed site. He requested that a privacy fence be installed along the property line to shield the commercial business from his residence. In addition to the privacy fence, he would like to request that trees also be planted. Vern Houston, speaking on behalf of St. Peter’s Church/School – they were not opposed to the potential use, but requested that the Commission take into consideration that this site was adjacent to the school’s playground. Requested that this property be fenced in. Alison Koch, 37201 31 Mile Road, expressed her concern with potential LED lighting. PCM: 09/14/2017 Page 2 of 9 Motion by Moore, seconded by Kaminski, to close the Public Hearing at 7:14 p.m. All yeas Motion passes A-2. PCD-01-2017/John Pellegrino/Request for Preferred Class Designation/67926 Howard Street Motion by Moore, seconded by Kaminski, to open the Public Hearing at 7:15 p.m. All yeas Motion passes The applicant, John Pellegrino informed the Commission that he was proposing to re- open this facility, but the State requirements will take two years to accomplish. At this time he was proposing to open the facility as an Adult Foster Care Facility and transition to a state-licensed Assisted Living Facility over the two-year time period. The building was in need of several updates. Motion by Kaminski, seconded by Moore, to close the Public Hearing at 7:23 p.m. All yeas Motion passes A-3. SCUI-03-2017/Statewide Richmond, LLC/Request for a Special Condition Use Permit/67500 Main Street Motion by Moore, seconded by Kaminski, to open the Public Hearing at 7:23 p.m. All yeas Motion passes City Planner Jeschke informed the Commission that a public hearing was required to allow for outdoor display in conjunction with a business. The ordinance did allow for public displays with a public hearing. John Endee, the attorney representing the applicant, informed the Commission that the new property owner has already made structural and cosmetic improvements. The recommendations being proposed by the City Planner will be taken into consideration. Kaminski commented on the poor condition of the shrubbery along the lot line adjacent to the Lake Angela entrance. Mr. Endee indicated that the applicant is willing to discuss this issue with the City. Motion by Kaminski, seconded by Moore, to close the Public Hearing at 7:31 p.m. All yeas Motion passes PCM: 09/14/2017 Page 3 of 9 ITEMS FOR CONSIDERATION B-1. REZ-05-2017/M-19 Development, LLC/ Request for Rezoning of 37305 31 Mile from RM-1 to B-3 City Planner Jeschke informed the Commission that the applicant, Roy Rose, was resubmitting the rezoning request with additional information that indicates who the proposed tenant will be and a conceptual site plan. The rezoning request is before the Commission to determine if a commercial zoning fits the City’s vision for this area and is consistent with the Master Plan. If the rezoning request is approved by the Commission, the applicant will still be required to submit a formal site plan for review by the Commission at a future date. City Planner Jeschke stated that the requested use is within the guidelines of what can be developed in the Highway Commercial (B-3) zoning. Roy Rose informed the Commission that he has been working with the proposed tenant to develop the conceptual site plan for the Commission. The privacy fencing, requested by a resident, will be incorporated in to the final site plan and presented to the Commission. It was noted by Roy Rose that he will be selling the property to the proposed tenant. McClellan – Assuming that the new owner will be using the property for the storage of vehicles, request that the City Planner keep track of any objectionable lighting. Also expressed his concerns will the traffic that will be created – this property is next to St. Peter’s school playground. McClellan questioned if a car hauler would be able to get onto this property. Motion by Zink, seconded by Kaminski, to approve the requested rezoning from RM-1 (Multiple Family Residential) to B-3 (General Business) of 6.75 acres of property located at 36305 31 Mile Road (APN: 50-07-06-01-51-056), for the following reason. 1. Consistency with Zoning Ordinance Compliance Standards as listed: - Consistency with adopted Land User Plan. The proposed rezoning to B- 3 (General Business) is consistent with the future land use designation of Highway Commercial that currently exists over this property. - Current Zoning Compatibility with the Site’s Natural Features. A review of the property reveals that there are no woodlands or wetlands within the property. - Reasonable return on investment with the current classification. No information has been provided relative to the current return on investment under the existing zoning classification or the proposed zoning classification. - Capacity of infrastructure and other public series adequate to accommodate the uses permitted in the B-3 District without compromising the health, safety and public welfare. The proposed PCM: 09/14/2017 Page 4 of 9 rezoning should not compromise the health, safety, and public welfare by rezoning the property B-3 (General Business). - Apparent Demand for Uses in the B-3 District. The property owner feels that there is more demand for commercial property than multiple-family residential. - Ability to comply with the proposed classification standards and requirements. The applicant has provided a conceptual plan and the plan appears to be in compliance with the proposed zoning classification standards and requirements. - Appropriateness of Requested Rezoning. The request to rezone the parcel from RM-1 to B-3 is consistent with the Master Plan Designation of Highway Commercial. - Exclusionary and Spot Zoning Issues. The proposed rezoning does not constitute exclusionary zoning. - Establishment of a desirable zoning trend policy for similar or identical lands. It is not immediately known if this rezoning will set a trend. All yeas Motion passes B-2. PCD-01-2017/John Pellegrino/Request for Preferred Class Designation/67926 Howard Street City Planner Jeschke informed the Commission that the applicant was proposing to reopen the facility as a dependent elderly care facility. The applicant stated he would oversee the project management along with staffing of employees and everyday logistics and would like to be allowed to have up to 20 residents, aged 60 years or older. The applicant was proposing to do the following upgrades: - Paving a driveway on the west side of the property for overnight parking of up to three (3) cars. - Installation of an upgraded fire monitoring system including residential fire suppression system. - New roof - Reconstruct the front porch. - Remodel the bathrooms. City Manager Moore stated that the applicant has indicated that this would be an unlicensed facility with up to 20 senior resident. The applicant has stated he would work toward becoming a licensed Adult Foster Care Facility which he stated is a two (2) year process. John Pellegrino stated that his proposal cannot be presented as an Adult Foster Care Facility at this time. Initially, it would be room and board for court-appointed individuals. There would be a common kitchen, but meals would not be provided. Each resident would be responsible for making their own meals. PCM: 09/14/2017 Page 5 of 9 The Commission discussed if residents would have vehicles, and if so, where would they park, since the facility does not provide any parking. Zink stated that this use is different from the use proposed by a previous applicant. This proposal appears to be a studio apartment with a common kitchen. John Pellegrino indicated that he would not allow the residents to have vehicles. The Commission had several questions and the information provided by the applicant was not sufficient. Questioned if the item could be tabled until a future meeting after the applicant can provide additional information. Motion by Moore, seconded by Zink, to table action on this item until the October Meeting, pending additional information to be provided by the applicant. All yeas Motion passes B-3. SCU-03-2017/Statewide Richmond, LLC/Request for a Special Condition Use Permit/67500 Main Street City Planner Jeschke informed the Commission that the applicant was requesting a Special Condition Use Permit to allow the outdoor display of goods in conjunction with a proposed retail business on 8.03 acres of property located at 67500 Main Street. The City Planner was recommending approval of the special condition use permit. The Commission was in consensus with the recommendations from the Planner. McClellan did request that the applicant keep the outdoor display area maintained. Jon Endee, the attorney for the applicant, informed the Commission that a clean, neat presentation was important to the applicant. Motion by Zink, seconded by Kaminski, to approve the requested Special Condition Use Permit to allow outdoor display of goods in conjunction with a proposed retail business (Tractor Supply Company) on 8.3 acres of property located at 67500 Main Street (APN: 50-07-06-01-426-026), subject to the following conditions: 1. The fencing around the outdoor display area shall be of a decorative variety that complements the established streetscape design in Richmond. 2. The fenced in display area shall be moved back (Approx. 15 feet) so that the enclosure is not extending beyond the front edge of the building. The fencing shall be decorative, black, 8 feet tall fencing. PCM: 09/14/2017 Page 6 of 9 3. The trailer display area shall consist of a single row of parking with a decorative fence around three sides of the area to clearly define and buffer from the rest of the customer parking area. The fencing shall be black and a minimum of 4 feet tall. All yeas Motion passes B-4. SPR-03-2017/Statewide Richmond, LLC/Site Plan Review/67500 Main Street City Planner Jeschke informed the Commission that the applicant was proposing a 32,614 square foot Tractor Supply company store located at 67500 Main Street. Prior to this item, the Commission approved a Special Condition Use request to allow the outdoor display of good in conjunction with the business. The property is located adjacent to the northeast side of Main Street between Muttonville Lane and Lake Angela Drive. The site is within the K-Mart plaza and is commonly referred to as the “old Kroger” space within the center. The 32,614 square foot space is toward the far western end of the site nearest to Lake Angela Drive. The applicant is also proposing three distinct outdoor display areas for goods that are being sold within the building. City Planner Jeschke was recommending “Ingress Only” at the northwestern most driveway. The applicant will need to apply for any sign permit requests. Extensive discussion on the traffic in the area. Kaminski, who lived in Lake Angela, expressed his concerns with the added potential traffic. If was very difficult trying to make a left turn on Main Street from Lake Angela Estates. He was adamant that we needed to restrict the use of the northwestern most driveway to “Ingress Only”. Jon Endee, the attorney representing Statewide Richmond, suggested that the Commission approve the site plan, but defer just the issue of the ingress/egress. The applicant can work with the City Planner and research viable options for the northwestern-most driveway on Main Street. Motion by Weinert, seconded by Zink, to approve the requested Site Plan Review for a proposed retail business (Tractor Supply Company) on 8.03 acres of property located at 67500 Main Street ( APN: 50-07-06-01-426-026), subject to the following conditions(s) 1. The Applicant and City Administration will research viable options for the northwestern-most driveway on Main Street and come back before the Planning Commission in 90 days. Prior to the issuance of any occupancy permits, the applicant shall provide the Planning and Economic Development Director with rendering of the front façade of the building. 3. The Applicant shall submit for sign permits for all proposed wall signage that meets or exceed the Zoning Ordinance requirements. PIR-03-2017/City of Richmond/Public Improvement Review/Public Works Facility at Beebe and Water Streets City Planner Jeschke informed the Commission that the City of Richmond Department of Public Works was requesting approval to install a masonry screening wall to enclose the rear of the DPW yard. The wall is proposed along the south, west and a portion of the northern property boundaries. The Public Works facility is surrounded by single family residential uses to the north, south and west and multiple family residential to the east. The proposed wall is intended to provide some screening between these uses. Some discussion on whether there would be a shrubbery in front of the wall. DPS Director Goetzinger will consider this. Motion by Zink, seconded by Kaminski, to approve the Public Improvement Review of a Site Plan Review for a proposed masonry screening wall enclosing the Public Works facility at Beebe and Water Streets, subject to the following conditions: 1. The masonry wall shall be required to obtain building permits. Discussion on motion: Tom Hebel, City resident, expressed his opposition to the wall being built. He felt there were other more important items that the City should spend money on. Vote on motion: All yeas Motion passes B-6. Discussion on the Master Plan Goals and Objectives/Macomb County Planning and Economic Development Department The Planning Commission was in consensus of the Goals and Objectives Section of the Master Plan as presented by the Macomb County Planning and Economic Development Department. Jeff Schroeder from Macomb County Planning, informed the Commission that the action plan will be presented in October. PCM: 09/14/2017 Page 8 of 9 MISCELLANEOUS MATTERS FROM THE CITY STAFF City Manager Moore – Romeo2Richmond Half Marathon this weekend. COMMENTS FROM CHAIRMAN AND COMMISSION MEMBERS Zink – Commented that he felt Commissioners should go through the Chair when they wanted to comment on an item. Weinert – The barn is going up in the Historical Village. Kaminski – Commented that Bob Eisenhardt will be opening up additional building site and making one lake larger – questioned if this needed to come before the Commission. City Manager Moore informed the Commission that the additional building sites were included with the site plan previously received and approved by the Planning Commission. McClellan – Commented on no roadside litter in Nova Scotia - Stated that Canadians are happy with their health care system. - Expressed his displeasure – he felt City Administration was aware of who the tenant was for the property on 31 Mile Road and withheld the information from the Planning Commission.
