PCD-02-2019/Request for a Preferred Class Designation/Ali Hakim/67926 Howard Street Motion by Rix, seconded by Frank, to open the Public Hearing at 7:01 p.m. All yeas Motion passes City Planner Jeschke informed the Commission that the applicant was requesting a Preferred Class Designation for a nonconforming for a proposal to allow an Elderly Housing Congregate Care Facility on property that was currently zoned single family residential. Mick Sullivan questioned what was being proposed. The City Planner explained that because the property was currently zoning single family residential, the proposal for an Elderly Housing Congregate Facility required a Preferred Class Designation. No further written or verbal comments were received. Motion by Moore, seconded by Kaminski, to close the public hearing at 7:04 p.m. All yeas Motion passes ITEMS FOR CONSIDERATION B-1. PCD-02-2019/Request for Preferred Class Designation/Ali Hakim/67926 Howard Street City Planner Jeschke informed the Commission that the applicant was requesting a Preferred Class Designation for a nonconforming use and a site plan review for a proposal to allow an Elderly Housing Congregate Care Facility on property location at 6796 Howard Street. This property is zoned for single-family residential, therefore, this proposal requires a Preferred Class Designation. PCM: 09/12/2019 Page 2 of 5  APPROVED 11/11/2019 The applicant is proposing to renovate the building including the 18 bedrooms within the building. In addition, the applicant is proposing to have 18 residential and will have residents that have minor physical disabilities. The staff will consist of a cook, manager of the facility, who is a registered nurse, and 3-5 certified health aids. They are proposing 24 hour staffing and will be cooking meals for residents. The Dependent Elderly Housing Congregate Care Facility is a good fit for the property. The property was previously used in the same manner as what is being proposed. The city Planner is recommending approval of the preferred class designation of this property. The Commission was reminded that a Preferred Class Use runs with the applicant, use, and property together. If another person wanted to purchase the property but still operate in the same manner; the new owner would need to reapply to the Planning Commission for a Preferred Class Use Permit. Ali Hakim informed the Commission that he and his business partner were trying to open a group home – they were both nurses. They would be providing minimal assistance to residents. He felt it would be more of an assisted living facility. The residents on the second floor would be independent residents while the residents on the main floor would require some care. None of the residents would have cars. They would be dependent on the staff to get them to/from doctor visits. They planned on being licensed through the State. Some discussion on the alarm system that sounded every time someone when in/out of the building. Mr. Hakim informed the Commission that a new alarm system had been installed and it should not disturb the neighboring properties. Rix questioned if any of the residents would have mental disabilities. Mr. Hakim stated no – they would not have the certification for handling residents with mental disabilities. Majchrzak – questioned the fire suppression system. Mr. Hakim explained that a new system had been installed. Moore indicated that he was in favor of the proposal – the City was in need of a senior care facility. Zink – questioned the age of the residents. Mr. Hakim stated that the licensed allowed them to have residents from ages 18-99, but they would preferr to have residents 60 years old and older. Mr. Hakim’s business partner explained that they would have residents 55 years of age and older – they would all be homebound. They would only be working with Medicaid or Medicare eligible patients – they would have no out-of-pocket residents. Motion by Moore, seconded by Frank, to approve the Preferred Class Designation for a nonconforming use and Site Plan Review from Ali Hakim for a proposal to allow A Dependent Elderly Housing Congregate Care Facility on property located at 67926 PCM: 09/12/2019 Page 3 of 5  APPROVED 11/11/2019 Howard Street (APN: 50-07-06-01-308-016), subject to the following conditions. 1. If the building is vacant for more than one (1) year after this approval, the preferred class designation of this property shall be null and void. 2. The only use of this property shall be as a Dependent Elderly Housing Congregate Care Facility. Any change in the proposed use of the property will necessitate a reconsideration of this Preferred Class Designation and require a new public hearing. 3. Per Article 25 (Definitions) of the Zoning Ordinance, the proposed Dependent Elderly Housing Congregate Care Facility shall be allowed to house male and female residents age 60 or older. Additionally, the applicant may house up to eighteen (18) residents; provided they are in compliance with all state licensing and building zoning requirements. All proposed residents under the age of 60 shall provide documentation to the City of Richmond proving that the patient is Medicare/Medicaid eligible. 4. The applicant shall work with the planning and building department regarding all required building and related building/trade permits, sign permits, and occupancy permits through the City of Richmond Building Department. 5. The applicant shall repair the sewer cleanout in the driveway to ensure the cleanout is property accessible and protected from damage and infiltration. The repair work shall be coordinated with the Department of Public Works for direction and final approval. All yeas Motion passes B-2. Review and comments on the Public Participation Plan and Development Guidebook City Planner Jeschke informed the Commission that the Public Participation Plan and the Development plan are required as a participant in the Redevelopment Ready Communities Program. The RRC program is a voluntary, no cost certification program designed to promote effective redevelopment strategies through a set of best practices. The Public Participation Plan is a document that looks at how we try to engage the public when we have certain review that require public engagements. The Development Guidebook is a documents that lists the procedures for any type of development that may occur within the City. All yeas Motion passes B-3. Adoption of 2020 Planning Commission Meeting Dates Motion by Kaminski, seconded by Majchrzak, to adopt the 2020 Planning Commission Regular meeting schedule. All yeas Motion passes MISCELLANEOUS MATTERS FROM THE CITY STAFF City Manager Moore – Will not be at the October meeting City Planner Jeschke – May be cancelling the October meeting. CHAIRMAN AND COMMISSION MEMBERS Commissioners congratulated the Good Old Days for a successful and fun Festival. Weinert – West Richmond subdivision looks very nice. Prior – Her out of town guests commented on how clean the City was the day following the festival. Rix – Informed Commissioners that on Sunday at Noon there would be a bond millage meeting at the Richmond High School auditorium.
