TXT-01-2023 /City of Richmond/Request for a Text Amendment to amend Sections 4.02 (Table of Permitted Uses by District) and 25.02 (Definitions) and to remove Section 6.510 (Package Liquor Store) of the Richmond Zoning Ordinance to make the ordinance consistent with State of Michigan Law. Motion by Rix, seconded by Kaminski to open the public hearing at 7:02 p.m. All yeas Motion passes The public hearing was held to receive comments on the Text Amendment to Sections 4.02 (Table of Permitted Uses by District) and 25.02 (Definitions) and to remove Section 6.510 (Package Liquor Store). This item was previously discussed with commissioners at the last planning commission meeting. Comments were received from members and the recommendation for the text amendment as well as the removal of the package liquor supplement standard was recommended. No further written or verbal comments were received. TXT-01-2023 /City of Richmond/Request for a Text Amendment to amend Sections 4.02 (Table of Permitted Uses by District) and 25.02 (Definitions) and to remove Section 6.510 (Package Liquor Store) of the Richmond Zoning Ordinance to make the ordinance consistent with State of Michigan Law. City Planner Jeschke discussed the proposed text amendment to Section 6.510 (Package Liquor Stores) and Section 25.02 (Definitions). Due to the recent changes in the way the State of Michigan permits package beer, wine, and liquor stores, it is nearly impossible to enforce the distance separation requirements in our ordinance. Administration recommends the revision to both the Table of Permitted Uses and definition in the distance separation requirement for Package liquor stores as well as the omission of a Package Liquor Store Zoning Ordinance. Motion by Weinert, seconded by Kaminski to approve Text Amendment (TXT-01-2023) and recommend the City Council approval of Ordinance 156-32; which amends Sections 4.02 (Table of Permitted Uses by District) and 25.02 (Definitions) and removes Section 6.510 (Package Liquor Store) of the Richmond Zoning Ordinance to make the ordinance consistent with the State of Michigan Law. PIR-0102023 /City of Richmond/Request for a Public Improvement Review of the Richmond Municipal Parking Lots Project on the east side of Main Street between Water and Monroe Streets. City Planner touched briefly on the Public Improvement Project but deferred the discussion to City Manager Moore to provide more detailed plans involved in this project. Moore provided the commissioners with a schematic which outlined the current property lines for each business impacted and presented the following information: The private portion of the parking lot on the east side of Main Street between Water and Monroe Street is scheduled to be reconstructed this summer. In addition, the pavement is in very poor condition and the parking has never had clearly defined spaces. The upgrades to this project have been on the TIFA priority list, and will utilize TIFA money, which allows improvements to private property using this funding. The sewer main in this same area, which was constructed in 1892, is over-sized and in very poor condition. The Sanitary Sewer Fund will pay for the sewer main, sewer leads up to the building and the two grease traps. Kaminski asked for further detailed information on the property lines and questioned if PCM: 03/09/2023 Page 3 of 5  APPROVED 06/08/2023 there have been any disputes between business owners regarding the parking. There was also an inquiry about the placement for handicapped spaces. Commissioner Kaminski feels it is a wonderful project. Moore has spoken to most business owners and all are in support of the improvement. Weinert questioned the ease of snow removal with the anticipated changes to the parking lot. Moore’s response indicated that there will be seasonal golf cart parking spots that will be utilized as the snow relief area during the winter months. Misch inquired about the lighting that will be installed. Motion by Kaminski, seconded by Zink to approve the Public Improvement Review of the Richmond Municipal Parking Lots Project on the east side of Main Street between Water and Monroe Streets. All yeas Motion passes MISCELLANEOUS MATTERS FROM THE CITY STAFF Jeschke informed the Commissioners that the EDC is currently working on proposals for the future of the Richmond Chamber of Commerce as it has been dissolved. He is also looking at options for integrating a Social District within the City. Moore indicated bid awards have been approved for the Diane Lane, Stone Street and the DPW Barn extension project. Work at the Roosevelt Auditorium is in its final stages. Invitations have been sent out for the ribbon cutting event. CHAIRMAN AND COMMISSION MEMBERS Maniaci – Glad to be a new member of the Planning Commission Kaminski asked for clarification of the no parking on the streets during the winter month, inquired on the legality of golf carts and let commissioners know of the bridge closure on County Line Road. Rix announced the donation of the property at 69089 Main Street to the City. Once a walk thru of the property is complete the City will decide on its future usage.
