Review of the Bylaws and Rules of Procedure for the Planning Commission and the Board of Zoning Appeals. Both the Planning Commission and Board of Zoning bylaws need to be updated due to State Enabling Act which has changed the board composition. These changes will ensure the proper language is incorporated into both sets of bylaws. It was noted that the Planning Commission made revisions to the bylaws, however, they were never brought to City Council for formal adoption. The request was made to commissioners to review the changes to make sure they are still relevant before they are brought forward for consideration by Council. No further changes were suggested. The Board of Zoning Appeals bylaws have not been updated since the City decided to go from a seven member board down to a five member board. The Zoning Ordinance was updated but the bylaws were not adopted. Furthermore, the Order of Business section and the Hearing Section were amended to reflect consistency between the Planning Commission and the Board of Zoning Appeals bylaws and rules of procedure. City Manager, Moore, reviewed the Rules of Procedure with members and best practice when conducting a Public Hearing. There was a discussion among commissioners clarifying the process and provided some guidelines when a Public Hearing is held. There was a discussion that touched on when a super majority is needed versus a regular majority of quorum to approve any requested action or motion placed before the Commission. Article V, Section 10, VOTING, needs to be updated to reflect the correct voting majority. All other sections will be carefully reviewed to ensure accurate numbers are noted. Planning Commission Motion: Motion by Misko, seconded by Kaminski, to recommend to City Council approval of the City of Richmond Planning Commission Bylaws and Rules of Procedure dated May, 2023. All yeas Motion passes Board of Zoning Appeal Motion: Motion by Schade, seconded by Kaminski, to recommend to City Council approval of the City of Richmond Board of Zoning Appeals Bylaws and Rules of Procedure dated May, 2023. PCM/BZA Joint Meeting: 05/11/2023 Page 3 of 4 APPROVED 10/12/2023 All yeas Motion passes B-2. Discussion on upcoming Master Plan Revision. Every five (5) years the community master plan should be updated by the Planning Commission to make sure the items noted are still relevant or if revisions are necessary. The sections that will be reviewed are the Goals and Objectives, the Future Land Use Plan and the Implementation section of the plan with this year’s update. There was a discussion on Boundary Annexation and how the process works. Administration will begin providing articles and chapters of the Master Plan this summer. MISCELLANEOUS MATTERS FROM THE CITY STAFF An update on the two (2) major projects currently taking place was provided. The last phase of the Swan Creek Subdivision will be coming back to the Planning Commission. The next set of approvals will be forthcoming. CHAIRMAN AND COMMISSION MEMBERS Misko noted his Richmond residency will expire at the end of the month. He has enjoyed being a part of the Planning Commission. MISCELLANEOUS MATTERS FROM THE CITY STAFF COMMENTS FROM CHAIRMAN AND COMMISSION MEMBERS ADJOURNMENT Those members of the Planning Commission wishing to speak shall first be recognized by the Chair to speak, and each person who speaks shall address the chair. Other persons in attendance at the meeting shall not speak unless recognized by the Chair (Roberts’ Rules). Prior to the discussion by the Planning Commission each item to be considered, the Chair shall first ask for a motion from the Planning Commission on the item to be discussed. Once a motion is made and seconded, the Planning Commission may discuss the matter at hand. Once the Planning Commission has finished its discussion on the matter, the Chair shall open discussion on the matter to the public. The Chair, at their sole discretion may establish a time limit for individual public comments on any business item if the Chair determines that time limits are necessary to provide for the orderly conduct of the meeting (PA267 of 1976, as amended). When the Chair determines that there are no other public comments on the business item, discussion on the item will be closed to the public and only the Planning Commission shall then engage in any final discussion on the matter and act on the business item without interruption from the public. - 1 -
