MINUTES Mayor and Council Regular Meeting September 29, 2022 6:30 P.M. CALL TO ORDER – A Regular Meeting of the Mayor and Council of the Borough of River Edge was held in the Council Chambers of the River Edge Borough Hall at 705 Kinderkamack Road, River Edge, NJ 07661. The meeting was called to order at 6:30 p.m. by Council President Kaufman. SILENT PRAYER – FLAG SALUTE Council President Kaufman asked for a moment of silence for Jim Bounds, longtime Crossing Guard, whose daughter recently passed away. Councilwoman Busteed led those present in a salute to the flag. STATEMENT OF COMPLIANCE - Council President Kaufman read the Statement of Compliance into the record as follows: Statement of Compliance with Open Public Meeting Act: This meeting complies with the Open Public Meeting Act by notification on January 7th this location, date and time to the Town News and the Record and by posting of same on the municipal bulletin board and Borough website and filing a notice of the same with the Municipal Clerk. Notice of this meeting by the September 7, 2022 Sunshine Notice was sent to the Record and Town News and posted on the municipal bulletin board and Borough website. Chief Financial Officer Chris Battaglia APPROVAL OF MINUTES – Council President Kaufman announced that the Minutes of the Mayor and Council Regular and Closed Session Meetings of September 12, 2022 are being carried to the next meeting as there are not enough members present this evening to vote. FOR DISCUSSION – Meeting Time for Mayor and Council Meetings via Zoom Borough Administrator Aportela noted that a Sunshine Notice needs to be prepared for the change of venue from in-person to virtual Mayor and Council meetings and inquired whether the virtual meetings will commence at 6:30 pm or 7 pm. It was confirmed that the meetings will continue to commence at 7 p.m. Block Party Permits Borough Administrator Aportela explained that a resident expressed concern that a block party was recently approved on the same weekend and in the same area as several large events, causing traffic and parking issues in her neighborhood. Borough Administrator Aportela advised that Chief Walker provided feedback on this matter which was included in the agenda packet. She inquired whether the Codification Committee should be tasked with looking at the portion of the Borough Code pertaining to block parties for possible amendments. There was discussion regarding the need for coordination if there is another large event taking place in town. It was agreed that those holding a block party should be made aware of the need to end by 10 pm to be in compliance with the Noise Ordinance. It was further agreed that this matter will be referred to the Police Department for further review and recommendation on possible amendments. APPOINTMENTS & PERSONNEL CHANGES – On motion by Councilwoman Busteed, seconded by Councilwoman Kinsella, and all members present voting in favor, to approve the following appointments and personnel changes: Approve the extension of Olivia Shnaper as a temporary Intern to provide assistance to the Building Department by sorting files that will be scanned, through October 31, 2022, at an hourly rate of $15.00, up to 20 hours per week, effective September 29, 2022. Approve the salary increase of Ryan Reilly, Police Officer from an annual salary of $44,146.00 to Patrolman 18th grade - $53,609.00 effective October 25, 2022. Approve the salary increase of Jason Hall, Police Officer from an annual salary of $44,146.00 to Patrolman 18th grade - $53,509.00 effective October 25, 2022. Approve the salary increase of Diane Johnson, Crossing Guard from an hourly Step 2 rate of $22.05 to Step 3 - $23.21 effective November 9, 2022. Approve the salary increase of Muriel Jones, Crossing Guard from an hourly Step 2 rate of $22.05 to Step 3 - $23.21 effective November 9, 2022. Approve the salary increase of Tom Callari, Crossing Guard from an hourly Step 2 rate of $22.05 to Step 3 - $23.21 effective September 19, 2022. Approve the salary increase of John Goble, Crossing Guard from an hourly probationary  rate of $18.00 to Step 1 - $20.89 effective September 1, 2022. Approve the salary increase of Peter Van Gunst, Crossing Guard from an hourly Step 2 rate of $22.05 to Step 3 - $23.21 effective October 16, 2022. Approve the salary increase of Sean McLoughlin, Crossing Guard from an hourly Step 2 rate of $22.05 to Step 3 - $23.21 effective September 19, 2022. MONTHLY REPORTS – Council President Kaufman advised that the following reports are on file in the Office of the Borough Clerk and available for review: Shade Tree Commission - May 2022 PROCLAMATIONS & AWARDS Certificates of Award - Storm Drain Art Contest Award Winners Laura Hoogstrate, Chair of the Environmental Protection Commission, provided background on the Storm Drain Art Contest and advised that each winner’s art will be painted onto a storm drain. She thanked the governing body and acknowledged the efforts of everyone who was involved. Presentation of Award Certificates to the Little League 9U District Champions The following coaches and players of the Little League 9U team were honored for winning the New Jersey Little League District 4 Tournament: Team Members: Dominick Woods Michael Zebroski Jacob Guzman Caden Ludlum Like Formoso Troy Kim Jack Campanelli Colin McGrory Joseph Giampietro Hudson Marley Coaches: Justin Woods Keith Zebroski Michael Giampietro PJ McGrory Bob Ludlum Jay Kim Coach Justin Woods commented that, although the team lost the first game of the tournament in extra innings, they won the next consecutive 7 games. He noted that the players didn’t give up on each other and that both he and Coach Keith are very proud of this team. Presentation of Award Certificates to REGAL 12U and 2/3 Travel Softball Team REGAL 2/3 Kinderkamack Softball League Travel Division Team Coach Daniel Sansevere explained that the 2/3 Travel Softball Team entered the Kinderkamack League as a group of all 2nd graders in a 2nd and 3rd grade division. He advised that the team went 9 and 1 and won their league championship. He noted that they beat the undefeated Emerson team to win the league championship. He commented on how proud he is of the players and thanked the other coaches as well as the parents. Council President Kaufman presented certificates to the following players: Alyssa Andriano Anna Pascale Caitlyn Theodorakos Emma Arabia Julia Marcus Kaitlyn Villalba Keagan Fogarty Molly Furrer Olivia Bertuzzi Resse Hornidge Taylor Strasser PUBLIC COMMENTS ON ANY ITEM – As there was a member of the public who wished to speak on a non-agenda item, it was decided to open the floor for comments on any item. On motion by Councilwoman Busteed, seconded by Councilman Chinigo, and all present voting in favor, to open for public comments. Sean Lang, Elm Ave, explained that two ash trees were planted on his property and have caused destruction. He noted that the Shade Tree Commission only makes a determination as to whether the tree is healthy and does not take into account the damage that it may cause. Borough Attorney Sarlo explained that the Shade Tree Commission is an autonomous commission, and as such, the Mayor and Council does not have jurisdiction. He noted that issues such as his are handled on a case-by-case basis and explained that Mr. Lang would first need to go before the commission, and if he is not satisfied with the outcome, he could then to appeal to the Mayor and Council. Mr. Lang questioned why he is responsible to make repairs when a Borough tree is causing the damage. He advised that he does not want to have liability for any future issues. Borough Attorney Sarlo stated that he is unable to give indemnification to Mr. Lang. Mr. Lang was, again, advised that he first needs to go before the Shade Tree Commission to discuss this issue. FOR DISCUSSION – (continued) Voorhis Avenue Project Jeyson Flores, Engineer, Costa Engineering, provided background on this project and explained how drainage issues in this area will be addressed. He further explained that the project went out to bid with a base bid and two alternates. He reviewed the bid results and expressed surprise that the 60-inch pipe came in higher than the storm capture. Borough Administrator Aportela explained that the project estimates were prepared prior to the inflation explosion which is the reason that the budgeted amount was only $1,083,000. She explained the different options that the governing body has with respect to the bids which included funding the base bid and alternate b now or rejecting the bids which would allow the Borough to go out to bid again. Should this project be rebid, she advised that it needs to be decided whether the additional inlets and paving should be incorporated or kept as an alternate. She noted that, should the bids come in high again, it would allow a price to be negotiated. Mr. Flores advised that, as this project was bid at the height of inflation, it is his recommendation that the bids be rejected and the project be rebid to see if better prices come in, noting that it would give the opportunity to negotiate if the bids come in high again. He further advised that it would also be his recommendation to choose storm captures and explained that there is not a need to pave the road as PSE&G will be doing upgrades which will require them to pave the road. As such, his recommendation would be to move forward with the base bid and alternate b without milling and paving. Borough Administrator Aportela explained that if the decision is to reject, there would be a resolution listed on the next agenda to formally reject the bids and select a new bid opening date. Although the new date would depend on the extent of the revisions to the bid specifications, she expressed her belief that the bid opening can be held by the first week of November. She explained that, as utilities need to perform their work first, the soonest that the project can move forward is April. As such, she noted that rejecting and going back out to bid would not have any impact on the timing for this project. She further noted that the CFO needs direction on the amount to put into the supplemental bond ordinance for this project. Motion by Councilman Chinigo, second by Councilwoman Kinsella, to open the floor to the public. Tim O’Donnell, Voorhis Avenue, implored the governing body to move forward as he believes that prices will only increase. Briana Bayersdorfer, Voorhis Avenue, advised that she does not feel safe in her home any longer and commented that she will need to move if this project is not completed. She urged the governing body to move forward. Motion by Councilwoman Kinsella, second by Councilwoman Malellari, to close the floor to the public. CFO Battaglia explained that, procedurally, the Borough is ready to move forward as a result of the resolution that was adopted to authorize an increase in the debt policy to 1.5%. He further explained that, by doing so, it allows the Borough to move forward with the bond ordinance that will ultimately fund this project. He explained the steps that would be required should the decision be to award the contract to the lowest bidder and noted that a bond ordinance would need to be adopted prior to the end of the year. He advised that the amount that he would look to include in the supplemental bond ordinance would be $800,000 to $900,000 to allow for potential change orders. He explained that, should the amount come in less, the difference can be cancelled before debt is incurred on it. There was discussion regarding the large expenses that the Borough is currently facing and the benefit of going out to bid again to see if a lower price comes in. Concerns were raised whether the proposed timeline is realistic. It was noted that the only item that is outside the Borough’s control are the utilities and Mr. Flores confirmed that he is currently working with the utilities to have them complete their work now. He advised that he will have more information next week on the time that it will take for the utility work to be completed. Mr. Flores advised that language can be included in the specifications that the project needs to commence in the first week of April and be completed within three months. It was the consensus of the governing body to reject the bids. Borough Administrator Aportela will work with Mr. Flores to determine the new bid opening date. It was also the consensus of the governing body to authorize CFO Battaglia to place additional funding into the supplemental bond ordinance for this project. CFO Battaglia will work with Mr. Flores to finalize the amount to place into the bond ordinance to ensure that there will be proper funding. The supplemental bond ordinance will be introduced no later than the second meeting in November. SECOND READING & HEARING ON ORDINANCES Ordinance #22-14 Council President Kaufman read into the record: The following ordinance published herewith was first read by title only on September 12, 2022 and posted on the bulletin board of the municipal building. Ordinance #22-14 An Ordinance to Fix the Salary, Wage and Compensation of the Employees of the Department of Public Works Represented by Local 125, International Brotherhood of Teamsters, Blue Collar Unit, for the Years 2022 through 2027 Borough Administrator Aportela explained that a Collective Bargaining Agreement was authorized with the DPW employees who fall under Local 125. She further explained that this ordinance establishes the salaries of each position for each year of the contract term. On a roll call, the vote was recorded as follows: Councilwoman Busteed: aye Councilwoman Kinsella: aye Councilman Chinigo: aye Councilwoman Malellari aye Council President Kaufman: aye Councilwoman Montisano-Koen: absent ******** #22-274 Amend Debt Policy WHEREAS, the Mayor and Council adopted a debt policy on January 1, 2013, via Resolution #12-444, which included a provision that the total indebtedness is restricted to an amount at any one time not to exceed 1% of the last locally assessed valuation of the municipality as last equalized by the Division of Taxation; and WHEREAS, due to the infrastructure needs of the Borough, in conjunction with the current economic climate of supply chain issues and inflation that is impacting the cost of goods and services, there is a need to amend the debt policy; and WHEREAS, the Finance Committee reviewed a debt analysis performed by the Chief Financial Officer and confirmed by the Financial Advisor; and WHEREAS, the Finance Committee has recommended to amend the policy to reflect that total indebtedness provision be increased from 1% to 1.5%; and WHEREAS, as per NJSA 40A:2-6, the debt limitation for a municipality is 3.5% NOW, THEREFORE BE IT RESOLVED, by the Mayor and Council of the Borough of River Edge, that the Borough’s debt policy is hereby amended to reflect a debt limitation of 1.5%. ******** #22-275 Refund of Performance Escrow for the Property Located at 916 Poplar Avenue, Block 108, Lot 11 WHEREAS, Susan Ng deposited $5,000.00 in escrow to replace the sidewalk within 90 days of the project completion at the property located at 916 Poplar Avenue, Block 108, Lot 11; and WHEREAS, the Construction Official and Zoning Officer have performed all final inspections. WHEREAS, the foregoing appropriation together with prior appropriations exceeds three (3) percent of the total operating appropriations (including utility operation appropriations) in the budget for 2022, NOW, THEREFORE, BE IT RESOLVED, (by not less than 2/3 of all governing body members affirmatively concurring) that in accordance with NJS 40A:4-49, petition be made to the Director of the Division of Local Government Services for permission to exceed the statutory limitation of 3 percent for the creation of an appropriation for the purpose set forth in the preamble in accordance with the following: 1. That two (2) certified copies of this resolution be filed with the Director of the Division of Local Government Services ******** #22-280 Confirm Amendment of Emergency Purchase – Oak Ditch Wall Reconstruction at Valley Road WHEREAS, an emergency repair to a partially collapsed retaining wall in the Oak Ditch at Valley Road in the amount of $471,099.40 was authorized on September 12, 2022, via Resolution #22-268; and WHEREAS, the retaining wall on the opposite side of the ditch started to fail, which also posed a threat of blocking the existing culvert headwall at Valley Road and damaging Borough infrastructure by blocking the only waterway passage for the ditch; and WHEREAS, the Borough Engineer has determined that this situation was an emergency affecting the health, safety and welfare of the public; and WHEREAS, Matina & Son, Inc. has responded to the subsequent emergency for an additional price of $353,898.80. OLD BUSINESS – Girls’ Softball Field Councilwoman Kinsella reported that the Recreation Commission met this week. She advised that REGAL and Little League presented to the subcommittee and everyone is in agreement on how to proceed. She further advised that a meeting with all the stakeholders is tentatively scheduled on October 13th. As more concrete numbers for the work at Roosevelt are needed, the Recreation Commission is requesting that the Borough Engineer and DPW Superintendent assist in providing an updated cost estimate. Once more accurate numbers have been obtained and presented to the stakeholders, the Recreation Commission will then come before the Mayor and Council. Borough Administrator Aportela advised that the governing body would need to give consensus to authorize the Borough Engineer to prepare the updated cost estimate and noted that it would fall under the Special Projects Engineering line. Councilman Chinigo raised concerns over investing in non-Borough owned property and commented that the term of the contract would need to be at least 10 years for him to consider this option. He inquired why the Recreation Commission is not present to request the services of the Borough Engineer. He also asked for confirmation that REGAL would be funding part of this project. Councilwoman Kinsella is to confirm with REGAL that they will still be providing funding towards this project. It was decided to invite the Recreation Commission to discuss this request at the next Mayor and Council meeting. It was agreed that Borough Engineer Costa will meet with Councilwoman Kinsella and a few Recreation Commission members to get an idea of the cost associated with providing updated cost estimates for the work at Roosevelt School. It was also requested that, going forward, minutes from the Recreation Commission be forwarded to the Borough Clerk for distribution to the governing body. Update on Construction Projects Please see attached status update on construction projects. PUBLIC COMMENTS – Motion by Councilwoman Busteed, second by Councilwoman Kinsella, and all members present voting in favor, to open public comments. Mel Solomon, Eastbrook Drive, expressed concerns regarding the construction on Valley Road between Mohawk and Oak, noting that the traffic signs are inaccurate, and due to their placement, pose a hazardous condition. Borough Administrator Aportela advised that this project is anticipated to be completed in four to five days and advised that traffic concerns should be directed to Chief Walker and Sgt. Diamond of the Police Department. Motion by Councilman Chinigo, second by Councilwoman Kinsella, and all members present voting in favor, to close public comment. COUNCIL COMMENTS – Councilwoman Kinsella reminded everyone that River Edge Day is this Sunday. As rain is predicted, she announced that the rain date is Sunday, October 9th. Borough Administrator Aportela advised that the Interim Recreation Director will poll the Recreation Commission to determine whether this event should be postponed. Should the decision be to postpone, notification will be provided via Nixle and Constant Contact. Council President Kaufman congratulated the contest winners and REGAL and Little League championship teams who were honored earlier this evening. Results are expected next week. In addition, Rob will be meeting with the contractor to look for solutions because based on the survey of the Beech Drive area, the topography is very flat with no drainage and no pitch to divert the water. • ADA Ramps 2021 (Vektor) – The restoration is complete – waiting for final invoice and maintenance bond. 2022 (AA Berms) – Ramps are complete – currently coordinating parking lot portion of the project. • Train Station Parking Lot – RE21 – 0462 Asphalt testing was performed this past Monday. Results are expected next week. • Bogert Road Section 5 & Bogert Road Section 6 – RE20-0408 & RE21-0458 Going out to bid 10/4, with the flashers. • 2021 CDBG Reservoir Sidewalk and Ada Ramps – RE21-0437 Held preconstruction meeting today, the area is from KK to Bogert; anticipated time period of the project is 3 weeks – anticipated start date is mid-October, weather permitting. Also coordinating the application for the next round to continue sidewalk replacement – phase 2 of the oxford & Rutgers area – waiting for an update on the HUD funding approval – county recommended $158,300 to be awarded from the Boro’s original application of $179,086.60. • Oak Ditch @ Valley Road Emergency Repair Installation of walls on the east and west sides has been completed. The contractor is at the restoration stage, which is expected to take about 4 days or so. Library – carpeting was installed this week; ACs are installed, but not operational yet since the existing wiring is not compatible with the new units.
