MINUTES Mayor and Council Regular Meeting November 14, 2022 7:00 P.M. CALL TO ORDER – A Regular Meeting of the Mayor and Council of the Borough of River Edge was held virtually via Zoom. The meeting was called to order at 7:01 p.m. by Mayor Thomas Papaleo. SILENT PRAYER – FLAG SALUTE Mayor Papaleo asked for a moment of silence for all troubled spots in world, especially inner cities, as well as for all places that have experienced gun violence including the University of Virginia. He commented that elected officials, emergency responders, and hospital workers are in everyone’s thoughts and prayers. Mayor Papaleo led those present in a salute to the flag. STATEMENT OF COMPLIANCE - Mayor Papaleo read the Statement of Compliance into the record as follows: Statement of Compliance with Open Public Meeting Act: This meeting complies with the Open Public Meeting Act by notification on January 7th this location, date and time to the Town News and the Record and by posting of same on the municipal bulletin board and Borough website and filing a notice of the same with the Municipal Clerk. Notice of this meeting via the October 7, 2022 Sunshine Notice containing the date, time, and access information was sent to the Record and Town News and has been posted on the bulletin board and Borough website. The regular meeting resumed at 7:46 p.m. ROLL CALL PRESENT: Councilwoman Busteed, Councilman Chinigo, Council President Kaufman, Councilwoman Kinsella, Councilwoman Malellari, Councilwoman Montisano-Koen and Mayor Papaleo. ABSENT: None ALSO PRESENT: Borough Administrator Lissette Aportela Borough Attorney Thomas Sarlo, Esq. FOR DISCUSSION – Girls Softball Field Michelle Ryan, Interim Recreation Director, reviewed the proposal for recommended improvements to the softball fields located at Roosevelt School which was presented on October 24th. The proposed improvements include sprinklers, drainage, and regrading of the field, dugouts, solar- powered scoreboards, and batting cages. It was also requested that synthetic turf installation for the entire field, the infield only and the outfield only also be explored. Mayor Papaleo advised that he, together with Councilwoman Kinsella and Borough Administrator Aportela, had a preliminary meeting with the Board of Education (BOE) to see whether they are open to the elements that REGAL put forth as well as whether they are open to negotiating other matters relating to this project. He noted that both a verbal and written response were received from the BOE indicating that they are receptive to moving this project forward. As members of the public who live within 200 feet of Roosevelt School were invited to attend this evening, Mayor Papaleo suggested that the meeting be opened to the public at this time. Motion Councilwoman Kinsella, second by Councilwoman Busteed, and all members present voting in favor, to open the floor for public comment. No one came forward. Motion by Council President Kaufman, second by Councilwoman Kinsella, and all members present voting in favor, to close the floor for public comment. Motion by Council President Kaufman, second by Councilwoman Busteed, and all members present voting in favor, to have the Borough Administrator and Interim Recreation Director task the professionals to provide preliminary cost estimates as well as a timeframe for the proposed improvements. Borough Administrator Aportela is also to confirm with the Board of Commissioners whether funding is available. Mayor Papaleo noted that, once updated cost estimates are obtained, Borough Attorney Sarlo would be tasked with negotiating the language of an interlocal agreement with the BOE. He thanked the BOE for a good conversation and expressed hope that a plan to negotiate can proceed at the next meeting. APPROVAL OF MINUTES – On a motion by Councilman Chinigo, seconded by Councilwoman Kinsella, with Councilwoman Busteed abstaining from the November 2, 2022 Special Meeting and all other members present voting in favor, that the Minutes of the Mayor and Council Regular and Closed Session Meetings of October 24, 2022 and the Mayor and Council Special Meeting of November 2, 2022 are hereby approved. 2023 Mayor and Council Meeting Schedule Borough Clerk Dodd reviewed the proposed 2023 Mayor and Council meeting schedule, noting that meetings which fall on a holiday will be scheduled for Thursday of that week. She advised that Councilwoman Montisano-Koen has indicated that the proposed date for the 2022 Sine Die/2023 Reorganization Meeting needs to be rescheduled due to a conflict. It was the consensus of the governing body to proceed with the dates and times included in the proposed 2023 meeting schedule. Borough Clerk Dodd is to work with Councilwoman Montisano- Koen and Council-Elect Benson to schedule the Sine Die/Reorganization Meeting. Ordinance #22-15 An Ordinance to Fix the Salary, Wage and Compensation of the Officers and Employees of the Borough of River Edge, in the County of Bergen, and State of New Jersey for the Year 2022. Borough Administrator Aportela advised that this ordinance updates the salary ranges for the position of Administrative Assistant within both Borough Hall and the Department of Public Works. Public Comments on Ordinances 22-15 Motion by Council President Kaufman, second by Councilwoman Kinsella, and all members voting in favor, to open the floor to the public on Ordinance #22-15. Borough Clerk Dodd confirmed that, as per the sample resolution that was received from the County, 2024 is the correct year. Councilwoman Montisano-Koen questioned whether the installation of the cameras being authorized via Resolution #22-230 includes the Library. Borough Administrator Aportela advised that a resolution to authorize the installation of cameras at both Memorial Park and the Library was authorized a few months ago. She explained that, due to the age of the camera system at the Police Department, it needs to be replaced to allow interface with the new cameras that were installed in the park and at the Library. BE IT FURTHER RESOLVED, that the appointment date is predicated on passing a physical examination. #22-320 Authorize Issuance of Purchase Order – Internal Security Cameras WHEREAS, Resolution #22-262 adopted on September 12, 2022, authorized the Borough Information Technology Consultant, Quikteks for additional information technology services associated with the purchase and installation of a new security camera system for the various borough facilities for a cost not to exceed $43,958; and WHEREAS, Chief Michael Walker has identified internal cameras in the Police Department that require replacement to integrate with the new security system; and WHEREAS, Quikteks has submitted a proposal for the purchase and installation of a new cameras throughout the Police Department, including the licensing of the software for a cost not to exceed $25,475; and WHEREAS, Chief Financial Officer Chris Battaglia has advised that funding is available. NOW, THEREFORE, BE IT RESOLVED that the Mayor and Borough Council of the Borough of River Edge hereby confirms that Police Chief, Michael Walker is authorized to issue a purchase order purchase and installation of a new cameras throughout the Police Department, including the licensing of the software for a cost not to exceed $25,475 to Borough Information Technology Consultant, Quikteks. #22-321 Authorize Purchase of 2022 Chevrolet Equinox for the River Edge Police Department WHEREAS, the purchase of new vehicles for the River Edge Police Department was authorized in the 2022 capital budget; and WHEREAS, the Police Captain, Craig Casey has solicited quotes for this purchase from three vendors and has recommended that a purchase order be issued to Paramus Chevrolet, Inc. based on the quote received for a total cost of $29,830.00, product availability and completion of mandatory pay-to-play documentation; and WHEREAS, Ronald Barna, President of Paramus Chevrolet, Inc. has completed and submitted a Business Entity Disclosure Certification which certifies that he and his company have not made any contributions to any political or candidate committee in the Borough of River Edge in the previous one year that would render him ineligible to be awarded this contract, and that the proposed contract prohibits him and his company from making any such reportable contributions through the term of the contract; and WHEREAS, Chief Financial Officer Chris Battaglia has advised that funding is available for this purchase. NOW THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of River Edge that Police Captain Casey is authorized to issue a purchase order for a 2022 Chevrolet Equinox to Paramus Chevrolet, Inc., having its principal office at 194 Route 17 North in Paramus, NJ 07652 based on the quote submitted in the amount of $29,830.00. #22-322 Authorize Membership to National Purchasing Partners WHEREAS, P.L. 2011, c.139, and N.J.S.A. 52:34-6.2 authorize contracting units to make purchases through the use of national cooperative purchasing agreements; and WHEREAS, National Purchasing Partners (NPP), offers free voluntary membership for interested local government entities; and WHEREAS, National Purchasing Partners offers a variety of goods and services through cooperative purchasing agreements available to its members; and WHEREAS, the Borough of River Edge is desirous of entering into an agreement with the National Purchasing Partners that will permit the Borough to purchase certain goods and/or services, as may be set forth in subsequent resolutions. NOW, THEREFORE BE IT RESOLVED that the Borough Administrator/Qualified Purchasing Agent is hereby authorized and empowered to execute an appropriate agreement with the National Purchasing Partners (NPP) and to take all other steps necessary and appropriate to effectuate the purposes of this resolution. #22-323 Authorize Accounts Supervisor to Issue a Refund Check to Marti Realty LLC, for the Property Located in Front of 1091 Main Street (New Bridge Landing Plaza) WHEREAS, the Borough of River Edge received a street opening permit from Marti Realty, LLC who surrendered the performance escrow bond in the amount of $500.00 for the installation of 2 permanent monitoring wells at the property located in front of 1091 Main Street; and WHEREAS, Jason Milito, Superintendent of Public Works has inspected the sidewalk where the opening was made and has declared it satisfactory; and WHEREAS, the Chief Financial Officer has certified that funds are available from Trust Other Account in the amount not to exceed $500.00. WHEREAS, The Borough Council of the Borough of River Edge, County of Bergen, State of New Jersey recognizes that the abuse of alcohol and drugs is a serious problem in our society amongst persons of all ages; and therefore has an established Municipal Alliance Committee; and, WHEREAS, the Borough Council further recognizes that it is incumbent upon not only public officials but upon the entire community to take action to prevent such abuses in our community; and, WHEREAS, the Borough Council has applied for funding to the Governor’s Council on Alcoholism and Drug Abuse through the County of Bergen; NOW, THEREFORE, BE IT RESOLVED by the Borough of River Edge, County of Bergen, State of New Jersey hereby recognizes the following: 1. The vote was recorded as follows: Councilwoman Busteed: aye Councilwoman Kinsella: aye Councilman Chinigo: aye Councilwoman Malellari aye Council President Kaufman: aye Councilwoman Montisano-Koen: aye NEW BUSINESS – Opioid Settlement Councilwoman Busteed inquired whether funds were received in connection with the opioid settlement and whether the Municipal Alliance will play a role in how these funds are utilized. Borough Administrator Aportela confirmed that approximately $2,000 was received and expressed her belief that Chief Walker plans to utilize these funds for the LEAD program. Should the Chairperson of Municipal Alliance have questions regarding these funds, Borough Administrator Aportela confirmed that questions should be directed to her and she would consult Chief Walker and the CFO to see whether these funds have been encumbered. OLD BUSINESS – Update on Construction Projects Borough Administrator Aportela reported on the following projects: Lead Removal from Water Service Lines – Veolia has contracted with Brut Contracting to inspect approximately 1,100 service lines that are either lead or unknown in Veolia’s records. This lead will be removed at no cost to the homeowner. Representatives will be carrying ID as an in-home inspection is required. Information on these inspections will be posted to the Borough website and will include an interactive map. Mayor Papaleo requested that Borough Administrator Aportela ask Chief Walker to provide tips on what a resident should do if they are unsure about opening the door. This information is to be posted to the website and Mayor’s page. Voorhis Avenue Drainage Improvements – the bids came in within the new budget. Borough Administrator Aportela is coordinating with the CFO to determine when the contract can be awarded. The lowest bidder also performed the Valley Road emergency repair and the Manchester sewer repair last year. Mayor Papaleo requested that Borough Administrator Aportela prepare a memorandum with details regarding this project. He, together with Councilwoman Kinsella and Council President Kaufman, will visit the impacted residents on Voorhis Avenue to provide an update. Paving Projects – the Borough Hall parking lot was paved last week and striped this past weekend. This lot was required to be milled and paved to comply with JIF safety requirements. There are remaining punch list items for this lot and the 2022 ADA ramp project. The Center Avenue parking lot is unable to be paved as the first frost has taken place. Borough Hall Repair – a preconstruction meeting was held last week. Due to live electrical in the basement which feeds the Public Safety Building, a variance is required from the DCA and should be issued in approximately 20 days. There will be a resolution pertaining to abatement oversight listed on the next meeting agenda. Work is expected to start either the last week of November or first week of December. The Building and Health Departments have been relocated to 10 River Edge Road; all other offices are working in a hybrid format. Borough Hall will be closed on November 21st and November 22nd for the moving of office equipment. Fire Company No. 2 Renovation – a preconstruction meeting was held and a walkthrough with the contractor will be scheduled within the next few weeks. Fire Company No. 1 HVAC Replacement – this project is near completion. New windows will be installed in December. Beech Drive – Although the intent was to authorize a change order to address ponding that is taking place on Beech Drive, Borough Administrator Aportela explained that this work is unable to be completed as the paving will not adhere due to frost. There will be coordination with the DPW Superintendent to ensure that additional salt is placed at this location when there is icing/snow. This issue will be addressed in the spring once temperatures regulate. Tabled Resolution #22-281 - Authorizing the Assignment of a Developer’s Agreement with ILBJ, LLC to Dark Sky Development, LLC for the Development of 335 Johnson Avenue (Block 1405, Lot 3) Borough Administrator Aportela reported that the Land Use Attorney confirmed that this resolution may be adopted prior to the replacement of the performance bond. She noted that it is at the discretion of the governing body as to whether they would like to proceed or wait to take action until the performance bond has been replaced. There was no motion to remove Resolution #22-281 from the table. Motion by Councilwoman Malellari, second by Councilman Chinigo, and all members present voting in favor, to close public comment. COUNCIL COMMENTS – Councilwoman Kinsella announced that the Christmas Tree Lighting will take place on December 4th in front of Borough Hall and Santa will be visiting the Firehouse on this date. It was confirmed that the menorah can be placed in front of Borough Hall as this area will not be in the construction zone. Members of the governing body congratulated Councilwoman Montisano- Koen and Council-Elect Benson on winning the election. The meeting was adjourned at 8:28 p.m. Respectfully submitted, Anne Dodd, RMC Borough Clerk  BOROUGH OF RIVER EDGE ORDINANCE #22-15 AN ORDINANCE TO FIX THE SALARY, WAGE AND COMPENSATION OF THE OFFICERS AND EMPLOYEES OF THE BOROUGH OF RIVER EDGE, IN THE COUNTY OF BERGEN, AND STATE OF NEW JERSEY FOR THE YEAR 2022 BE IT ORDAINED by the Mayor and Council of the Borough of River Edge, County of Bergen, State of New Jersey, as follows: Section 1: The title and compensation for the full-time positions of the Borough of River Edge for the year 2022 shall be amended as follows: 2022 BOROUGH HALL Administrative Assistant $40,000 – $55,000 DEPARTMENT OF PUBLIC WORKS Administrative Assistant $40,000 – $55,000 Section 2. Any and all other ordinances or parts thereof in conflict or inconsistent with any of the terms hereof are hereby repealed to such extent as they are so in conflict or inconsistent. Section 3. In case any article, section or provision of this ordinance shall be held invalid in any court of competent jurisdiction, the same shall not affect any other article, section or provision of this ordinance except insofar as the article, section or provision so declared invalid shall be inseparable from the remainder or any portion thereof. Section 4. This Ordinance shall take effect as of October 1, 2022 upon final passage and publication as required by law.
