Counciimember Clausen seconded the motion, which carried with 51 Clausen, Gallup, Huntly, Milbank and Wright in favor. No one opposed. 52 53 Motion #4 54 Councilmember Wright moved to "adopt the General Plan Land Use Map, General Plan Land Use 55 and Sensitive Area Map, with the removal of the commercial designation on the property located at the 56 intersection of 100 E 700 S, and the Annexation Declaration Map, all dated December 2021." 57 Councilmember Clausen seconded the motion, which carried with Clausen, Gallup, Huntly, Milbank and 58 Wright in favor. No one opposed. 64 65 66 Minutes of the Meeting: 67 68 The River Heights City Council met at 6:00 p.m. in the Ervin R. Crosbie Council Chambers in the 69 River Heights City Building on Tuesday, December 7, 2021,for their regular council meeting. 70 Budget Workshop: Mayor Rasmussen gave some training on running a meeting. Then he turned 71 the time over to FD Grover for general budget training. Mr. Grover suggested budget adjustments in 72 January. 73 Ambassador Recognition: Councilmember Gallup showed a short video of the activities the 74 ambassadors planned and participated in during the past year. Mayor Rasmussen handed out Mayor's 75 Coins and Councilmember Gallup presented certificates to each of the ambassadors. 76 Councilmember Clausen led in the Pledge of Allegiance. 77 Adoption of Previous Minutes and Agenda: Minutes for the November 30, 2021, meeting were 78 reviewed. Mayor Rasmussen explained that the city attorney had a few changes to the Rocky Mountain 79 Power ordinance. RMP would like their attorney to review the changes before adoption. After this 80 happens, the ordinance will be back on the agenda. 81 Councilmember Clausen moved to "adopt the minutes of the council meeting of November 30, 82 2021,and the evening's agenda, with the removal of the RMP agenda item." Councilmember Wright 83 seconded the motion, which passed with Clausen,Gallup, Huntly, Milbank, and Wright in favor. No one 84 opposed. 85 Reports and Approval of Pavments(Mavor. Council. Staff): 86 Public Works Director Nelson didn't have anything to report. 87 Treasurer Wiiker 88 • She presented and answered questions regarding the list of bills to be paid. 89 Councilmember Clausen moved to "pay the bills as listed." Councilmember Milbank 90 seconded the motion, which passed with Clausen, Gallup, Huntly, Milbank,and Wright in favor. 91 No one opposed. River Heights City Council Meeting, 12/7/21 2  Councilmember Huntly didn't have anything. 'Vj Councilmember Milbank 94 • He brought attention to the drawings of the city square in the Drive, done by Design West. He 95 planned to have further discussion on it at a later date. Mayor Rasmussen would like to see more 96 people involved. 97 • BioWest is waiting for Forsgren Engineering to finish up some work before they can move forward 98 on the Stewart Hill Park Plan. 99 Councilmember Clausen didn't have a report. 100 Councilmember Gallup 101 • She spent some time watching the crossing guards and gave them some pointers. She'd like them 102 to do some more training. 103 • She has called the sheriff to see if they could come patrol during school hours. 104 Recorder Lind 105 • Reminded that newsletter items are due by December 15. 106 Public Comment: Mike Jablonski thanked those on the council for their service, as well as the 107 mayor. He explained that he and his wife spent a lot of their time this year drafting written comments. 108 He noted that the recent General Plan maps drafts show a trail on their property. They wished someone 109 had approached them to discuss this. He reiterated their strong desire to not have their property be 110 considered for PUD. It was VERY important to them. He felt it was unreasonable for the council to 111 consult an attorney before not labeling their property as PUD. 112 Tyson Glover felt more time should be spent on the General Plan maps so the new council ;i members can have time to review them. He discussed 400 South and how it looks currently. There are V .'1 homes that front it the entire length. There are two undeveloped acres owned by the Robinetts. Mr. 115 Glover didn't feel they should be restricted to no homes fronting the street. He wasn't sure why they 116 wanted to designate 400 as a collector road. Councilmember Wright informed he had talked with Mr. 117 Robinett numerous times about the implications of 400 South going through the property he currently 118 owns. He is well aware. 119 Adopt an Ordinance Granting an Electric Utilitv Franchise and General Utilitv Easement to Rockv 120 Mountain Power: Postponed. 121 Discuss and Adopt an Ordinance to Change the Use Regulations of the Citv Code (Auto Repair): 122 Councilmember Wright discussed his proposed word changes in regard to auto repairs. He consulted with 123 Planning Commissioner Chair Lev! Roberts and Planning Commission Member Cindy Schaub to get their 124 opinion on the planning commission's intent. They verbally gave their blessing on his proposal. 125 Councilmember Huntly felt it was overly restrictive to only allow a fixed car on the property for two days. 126 Mr. Wright explained that these auto repair situations will be in residential areas. The Planning 127 Commission was also concerned about the look of the vehicles. Ms. Huntly asked for a two-week 128 allowance to give more generosity to those who are trying to make a living. Mayor Rasmussen pointed 129 out It's hard to administer this type of situation when someone is repairing and selling cars. 130 Commissioner Schaub said the gentleman who recently applied for a CUP is flipping cars. They were 131 concerned it may end up looking like a used car lot, in a residential zone. 132 Jason Thompson said if it's a buy and flip business then there needs to be a limit. If its repairs, a 133 different set of questions would need to be asked. 134 Councilmember Clausen suggested no longer than 10 days for a car sitting out. Councilmember '! Milbank acknowledged the time will probably be stretched. He noted the ordinance shouldn't be tailored J'i to one specific individual. River Heights City Council Meeting,12P/21 137 Councilmember Gallup read the conditions on Landon Meacham's Conditional Use Permit. 138 Councilmember Milbank pointed out his location is back behind storage buildings and out of view. 139 Councilmember Wright read from the city code concerning street parking of recreational vehicles. 140 Councilmember Wright moved to "Adopt Ordinance 11-2021, An Ordinance to Change the Use 141 Regulations In the City Code of River Heights, Utah as presented with a change in the footnote subscript 142 2that a vehicie being transported to and from the premises, be parked outside of the building for no 143 more than 14 consecutive calendar days." Councilmember Clausen seconded the motion, which carried 144 with Clausen, Gallup, Huntly, Milbank and Wright in favor. No one opposed. 145 Discuss and Adopt the General Plan: Mayor Rasmussen's intent was to adopt at least one map 146 tonight and put off the document adoption until a later meeting. He felt they weren't ready to do it all in 147 one meeting. Councilmember Wright agreed he could use more time to review the document. He has 148 been spending time with the engineer on getting the maps changed with the items they discussed at the 149 last meeting. He pointed out the written narrative, pertaining to the maps, may need to be adjusted 150 based on their discussion tonight. 151 Councilmember Wright began a discussion on the Land Use Map by reading a response from the 152 city attorney regarding a spot zone question from the last meeting. He basically said the General Plan 153 designations would be okay to be shown in a checkerboard fashion since they are not creating real zones 154 and didn't feel the city would be at risk to do so. Councilmember Milbank asked if, by so doing, they were 155 giving a citizen their way. Councilmember Huntly replied that because the Jablonski/Johnson property is 156 located along the river she didn't think it was considered a spot zone. Zoning the entire area as a PUD 157 would result In a high density overall. She didn't think the city needed to maximize PUD zoning. She saw 158 the property as geographically distinct. Councilmember Clausen agreed. Councilmember Milbank 159 pointed out the transportation map, which showed a road going through his property and asked if the city 160 was going to listen to those property owners. 161 Mike Jablonski clarified he was not asking for anything more than what they already have and 162 have always had. It is the best interest of future generations that the property remain as is. 163 Councilmember Wright reported that he visited with Dixie Wilson about their property at 100 East 164 700 South. She told him they had previously considered rezoning their property as commercial. They 165 hadn't done it up to this point because they didn't want to pay higher property taxes before they were 166 ready to have their property developed. Mr. Wright preferred to pull the commercial label off the 167 property for now until they can make the change in the document. Another public hearing may need to 168 be held before they label it on the maps. 169 Discussion was held on the Transportation Map. Councilmember Milbank wasn't sure why they 170 accommodate traffic In the way that they do. The road lines through his property have an immediate 171 effect on his property. He felt it unfair to entertain and prioritize a citizen request on the 172 Jablonski/Johnson property without allowing it for all. Councilmember Wright clarified the intent of the 173 Planning Commission was to preserve an easement for future roads. It didn't mean it would end up this 174 way. He understood Mr. Milbank's concern. It is ultimately the council's decision on whether the 175 connections to 700 and 800 South are worth it. Councilmember Milbank suggested waiting for another 176 10 years, when the General Plan Is revised again, to make the road designations. Mayor Rasmussen saw it 177 as a protection for the landowner to know the future plans, so they would know where to place a house. 178 It would prevent having to infringe on people's properties in the future. 179 Councilmember Clausen asked, when 400 South is made a through street would the whole road 180 need to be ripped up and widened because it's designated as a collector road? Councilmember Wright 181 felt they should relook at their definition of a collector street. Mayor Rasmussen reminded there are COG 182 funds for collector roads. River Heights City Council Meeting, 12/7/21  Tyson Glover felt the zoning map should be established and then go back to the transportation 184 maps. The city engineer can produce a transportation model, which would help them make better 185 recommendations. Councilmember Milbank agreed that a study would make it seem less like decisions 186 were being made on a whim by the Planning Commission. Mayor Rasmussen suggested if a road isn't 187 needed in the future, they should still preserve a right of way for whatever the future holds. 188 Councilmember Wright felt the council should adopt only the Land Use and Sensitive Area maps 189 until they work through the other maps by gathering more Information. 190 Councilmember Wright discussed the changes on the proposed trails. The Annexation Map hadn't 191 changed. 192 Councilmember Wright moved to "adopt the General Plan Land Use Map, General Plan Land Use 193 and Sensitive Area Map, with the removal of the commercial designation on the property located at the 194 Intersection of 100 E 700 S, and the Annexation Declaration Map, all dated December 2021." 195 Councilmember Clausen seconded the motion, which carried with Clausen, Gallup, Huntly, Milbank and 196 Wright in favor. No one opposed. 197 Review of the General Plan document will take place later. 198 Repeal of River Heights Citv Ordinance 6-2021 (Moratorium): Councilmember Wright felt that 199 because the R-PUD ordinance, and the waterway setback had been adopted and now the General Plan 200 Land Use Map approved, the moratorium could be lifted. 201 Councilmember Wright moved to "adopt Ordinance 12-2021, Repeal of River Heights City 202 Ordinance 6-2021." Councilmember Clausen seconded the motion, with Clausen, Gallup, Huntly, 203 Milbank and Wright In favor. No one opposed. Mayor Rasmussen asked the group if they wanted to meet on December 21 to make some headway on the General Plan. They all agreed to not have another meeting In December. Mayor 206 Rasmussen asked the outgoing council to give their comments to the incoming council. Professional Office to a superscript 1 Add:"83. Auto Repair^". Show as conditional "C" In the residential "R" and agricultural "A" zones and permitted in the commercial "C" zone. Change the note under 82 to be under 83 and read,"(Lines 84-90 intentionally left blank)" Change the notes at the end of the table to read: "^Only a structure that is residential in appearance and maintains the character of the existing neighborhood in style and heights can be used for a professional office in a residential zone. I ilLHEgro a sAitm OTY pYwlYiirh liP CENTER PARK H SCUM 3 □ SCALE: 1 -600' ANNEXATION OECLARATION AREA pmnn CITY BOUNDARY ANNEXATION DECLARATION MAP DECEMBER 2021 mmi F0R5GR£N FSTASi ISHE0 1 ft 82  Ordinance 12-2021 REPEAL OF RIVER HEIGHTS CITY ORDINANCE 6-2021' WHEREAS,on August 3,2021,the City ofRiver Heights, Cache County, State ofUtah,passed and adopted Ordinance 6-2021 -because of the critical need to identify and establish appropriate easements, rights-of-way, for public utility lines and to establish standards and practices that protect health, safety and welfare of the resident of the City of River Heights, and update any necessary ordinances, which facilitate appropriate and orderly future development of land within the city boundaries; and, WHEREAS,the City Council detenriined and found that there was a compelling countervailing public interest in imposing a temporary land ordinance in the form ofa moratorium on any construction or development in certain areas ofthe City ofRiver Heights until such easements or rights-of-way can be established, and necessary ordinances can be adopted; WHEREAS, the City Council imposed a moratorium up to six months on subdivision applications and any land use applications related to subdivision to allow time for adequate master planning and a comprehensive review and revisions ofthe applicable ordinances pursuant to Utah Code Ann. Section 10-9a-504 of the following areas located within River Heights City; The lands between 100 East and 400 East, and between 300 South and 700 South, much of which is referred to as the Riverdale area; The lands currently zoned Agricultural adjacent to 800 South and the currently-zoned Commercial area between 100 East and 600 East; The lands between 600 East and 800 East and approximately 700 South and to the city boundary line to the south. This property is often referred to as the Lois Weston Family property and property owned by The Church of Jesus Christ of Latter-day Saints; and Parcel 02-025-0015 between 700 East and 750 East north of 600 South referred to as the Todd Weston Family property. WHEREAS,River Heights City's needs set forth in Ordinance 6-2021 and identified above no longer requires the moratorium to remain in place. NOW, THEREFORE, BE IT ORDAINED, by the Council of River Heights City, Cache County, State of Utah, as follows: 1. Effective immediately upon enactment ofthis ordinances River Heights City Ordinance 6-2021 passed and adopted on August 3, 2021 implementing a moratorium for up to six months is hereby repealed. 2.
