No item will be heard before its scheduled time, but may be heard later in the meeting. City Planning Commission action on all items may be appealed to the City Council within ten calendar days for zoning and map cases. Contact the Planning Division for further information. State law restricts the City Planning Commission from taking action on an item unless it has been included on an agenda and posted at least 72 hours in advance of a meeting, or unless the matter falls within one of the narrow exceptions. Consequently, any item not listed on this agenda will normally have to be delayed until the item can be made part of a posted agenda. Additionally, significant changes to a project made subsequent to posting of the agenda and not addressed in the City Planning Commission staff report will result in continuance of that item in order to allow for adequate review by the Commission. The City of Riverside wishes to make all of its public meetings accessible to the public. Further discussion of any matter beyond 15 minutes will be continued to following the public hearing calendar or scheduled for a later agenda. If there is no one from the audience wishing to speak, the Commission will move to the next order of business. 9:00 A.M.--PUBLIC HEARINGS This portion of the Planning Commission Agenda is for all matters where staff and public participation is anticipated. Individual audience participation is limited to 3 minutes. 2 PLANNING CASES P15-0535 AND P16-0048: The applicant requests approval of a Conditional Use Permit and Design Review for a two-phase hotel development which includes; a 5-story 112 room Hampton Inn Hotel and surface parking lot during phase 1 development; and a 6-story 147 room hotel and 5-level parking structure during phase 2 development, located on the southwesterly corner of the intersection of Fifth and Market Streets in the DSP-RC – Downtown Specific Plan – Raincross District, in Ward 1. The Community & Economic Development Department has determined that this proposal meets the Streamlining for Infill Projects for the California Environmental Quality Act (CEQA) review pursuant to Section 15183.3 as the project constitutes an infill project. It is recommended that the City Planning Commission recommend to the City Council adoption of a Mitigated Negative Declaration in conjunction with these cases. The Planning Division of the Community & Economic Development Department is recommending that the Planning Commission recommend that the City Council determine that this proposal is categorically exempt from further California Environmental Quality Act (CEQA) review pursuant to Section 15302 (Replacement or Reconstruction) and Section 15311 (Accessory Structures). The Planning Division of the Community & Economic Development Department is recommending that the Planning Commission recommend that the City Council determine that this proposal does not have the potential to cause a significant effect on the environment because all impacts were considered in a prior environmental analysis that included preparation of an Environmental Impact Report (EIR) for the March ALUCP. On November 13, 2014, the Riverside County Airport Land Use Commission (lead agency) adopted Resolution No. 2014-01 certifying the Final EIR (State Clearinghouse #2013071042). The proposed modifications are intended to be consistent with the City’s “Streamline Riverside” Initiative, which stems from the City’s “Business Ready Riverside” Program, which is aimed at identifying and implementing strategic changes in expanding the City’s “readiness” for facilitating new business and investment. Specifically, the proposed amendments include, but are not limited to: 1) revisions to the Permitted Use and Incidental Use Tables; 2) revisions to the approval/appeal authority for various planning case types; 3) procedural changes related to the processing of non-legislative cases; 4) revisions to the Wireless Telecommunications Facilities Code; 5) revisions to the Planned Residential Development Permit Code; and 6) Clarification of certain definitions, including, but not limited to, Schools, Banquet Halls and those relating to Wireless Telecommunications. The Planning Division of the Community & Economic Development Department is recommending that the Planning Commission recommend that the City Council determine that this proposal is categorically exempt from further California Environmental Quality Act (CEQA) review pursuant to Section 15061 (b)(3), as it can be seen with certainty that there is no possibility that this proposed amendment to the Zoning Code will have a significant effect on the environment.
