CALL TO ORDER
Chair McDowell called the meeting to order at 2:30 p.m.
REVIEW OF THE MINUTES
Phil Burkhalter made a motion to approve the minutes, which was seconded by Vonn Lambert.
The motion passed by common consent.
APPLICATIONS:
File #BOA20-02-01, 15 Oak View Drive. Requests the western side setback be reduced from seven feet
to two feet to allow for the construction of a new detached garage. Floyd County Tax Parcel J11W299.
Owner/Applicant: Charles Bannister. Brice Wood presented the application, staff report and
recommendation of approval. Bill Temple, realtor, was present to speak on behalf of the application, as
was applicant/owner Charles Bannister. There was no one present to speak in opposition. Phil
Burkhalter asked about the current side setback, which Brice identified as being 7 feet. Carol Hatch
asked if there was a house on the adjacent lot to the left. Brice confirmed that there is not a house on the
left side. Terry Williamson asked about why an entire neighborhood was created with lots that aren’t big
enough for an accessory structure. Brice explained that the unincorporated county has no minimum lot
sizes. Phil Burkhalter made a motion to approve, which was seconded by Vonn Lambert. The motion
carried with a 6-0 vote.
File #BOA20-02-02, 2198 Calhoun Hwy. Requests to reduce the minimum front lot width to 140 feet to
subdivide the parcel for a new lot. Floyd County Tax Parcel K12Z122. Owner/Applicant: Wendell &
Sharon Fincher. Brice Wood presented the application, staff report and staff recommendation of
approval. Sharon Fincher was present to speak on behalf of the application. Mitch King was present to
speak in opposition as an adjacent property owner. Mitch was concerned about the possibility of building
a driveway so close to his house and the lights and noise that it may create. Mitch also spoke about how
the property holds water. Wendell Fincher offered a rebuttal, saying that if the property was too wet then
they would be unable to build the house. Mitch King then said that the previous owner had installed a
septic tank in that area without any permits. During the public hearing, Assistant City Manager Patrick
Eidson questioned the existence of an unofficial junkyard and pond on the adjacent property. Phil
Burkhalter made a motion to approve, which was seconded by Will Byington. The motion passed 4-2,
with Chair McDowell and Terry Williamson as the dissenting votes.
STAFF REPORT:
Brice Wood reported that the Planning Staff is working on rewriting sections of the ULDC, which will
include allowances for additional variances, as well as an expedited variance process. Patrick Eidson and
Director Newell gave additional detail on this.
ADJOURNMENT:
There being no further business to bring before this body, the February 20, 2020, meeting of the
Board of Adjustments was adjourned by Chair McDowell, at 3:30 p.m.
