BOARD OF ADJUSTMENTS Zoom Meeting 2:30 P.M. May 21, 2020 MEMBERS PRESENT: Eric McDowell, Phil Burkhalter, Von Lambert, Jeff Williams, Terry Williamson MEMBERS ABSENT: Carol Hatch, Will Byington STAFF PRESENT: Brice Wood, Artagus Newell, Patrick Eidson, Brittany Griffin, Grace Gartman (intern) PUBLIC PRESENT: Keith Adams, Chuck Hardin, Aaron Silvey, Olivia Morley CALL TO ORDER Chair McDowell called the meeting to order at 2:30 p.m. REVIEW OF THE MINUTES The minutes were approved by 5-0 vote, after a motion to approve from Phil Burkhalter and a second from Jeff Williams. APPLICATIONS: File #BOA20-05-01, Requests front setback be reduced from 25’ to 18’ for the properties located at 0 Berryrun Drive and 0 Berryrun Drive, Rome, GA 30165. Floyd County Tax Parcels H13Y648G, H13Y648F. Owner/Applicant: SDH, Atlanta, LLC. Brice Wood presented the application, staff report and staff recommendation of approval. Keith Adams was present to speak on behalf of the application. There was no one present to speak in opposition. Terry Williamson did ask whether any of the neighbors had expressed any opposition. Wood explained that multiple neighbors had called and expressed interest but did not express opposition after hearing the details of the application. Terry Williamson made a motion to approve, which was seconded by Jeff Williams. The motion passed 5-0. File #BOA20-05-02, Requests to reduce the 20’ side setbacks to 5’ and the front landscape strip from 20’ to 0’. Floyd County Tax Parcel H13X149. Owner/Applicant: Steve Silvey. Brice Wood presented the application, staff report and staff recommendation of approval. Wood also presented an email from adjacent property owner Ronnie Wallace in opposition to the application. Aaron Silvey was present to speak on behalf of his father, Steve, as was their engineer, Chuck Hardin. There was discussion amongst the members regarding the requested side setback reduction. Silvey explained that his cleaning company uses chemicals that should not be allowed to freeze. Jeff Williams made a motion to approve, which was seconded by Phil Burkhalter. The motion passed 4-0 with Von Lambert abstaining. ADJOURNMENT: There being no further business to bring before this body, the May 21, 2020, meeting of the Board of Adjustments was adjourned by Chair McDowell, at approximately 3:23 p.m.
