Rome-Floyd Board of Adjustments Minutes Location: City Hall Commission Chambers Date: Thursday, February 15, 2024 Time: 2:30 PM PLEASE REFER TO THE VIDEO RECORDING FOR FULL DETAIL OF THE MEETING CALL TO ORDER Meeting convened: 2:30 p.m. led by Chair Clonts. Approval of Minutes from January 2024 Meeting Brown made a motion to approve the January 2024 minutes, which was seconded by Johnson. The motion passed by common consent. Approval/Modification of Agenda There were no modifications to the agenda. Abney made a motion to approve the agenda, which was seconded by Lignell. The motion passed by common consent. ROME/FLOYD ZONING VARIANCE APPLICATIONS: BOA23-07-07, for the property at 404 S Broad St., Rome, GA 30161, Floyd County Tax Parcel J14E227, being zoned Community Commercial (C-C), requests to reduce the front setback and landscape strip from 20’ to 0’ and to reduce the eastern setback and buffer requirement from 15’ to 0’. Director Wood presented the application, staff report, and staff recommendation. Chair Clonts opened the public hearing. Ernesto Criello was present to speak in favor of the application and to answer any questions. They would like a covered space for the children to play that will provide shelter from rain/heat and provide shade. No one was present to speak in opposition. 1 Chair Clonts closed the public hearing and opened the floor for discussion amongst the voting members. There were questions in regard to the size and final idea of what the project will be and it was noted that further information and detailed measurements would be needed. Johnson made a motion to deny without prejudice, which was seconded by Abney. The motion passed 6-0. MEMBER MEMBER MEMBER M - Motion S – Second AB – Abstained S Cameron Abney Y David Clonts M Jarrod Johnson Y Frank Brown Y Johnathan Harris Y Wendy Lignell BOA24-02-01, for the property at 206 Ave. C, Lindale, GA 30147, Floyd County Tax Parcel J16X329, being zoned Duplex Residential (D-R), requests an accessory structure that is closer to the public right-of-way than the principal structure and a fence in the front yard that is taller than 4’. Director Wood presented the application, staff report, and staff recommendation. Chair Clonts opened the public hearing. Anthony Tibbs was present to speak in favor of the application and to answer any questions. He explained that there is a pool on the property and that he needs to have this fenced in to be able to keep the pool. The fence would need to be 5’. Danny Bunch was present to speak in opposition. He was asked to take down his fence to 4’ and doesn’t think that it’s fair for the neighbor to be able to have one. Chair Clonts closed the public hearing and opened the floor for discussion amongst the voting members. Clonts made a motion to approve both requests on the condition that the taller fence not come closer to Avenue C than the exterior wall of the duplex that is closest to Avenue C and that the fence does not exceed 5’ in height, which was seconded by Brown. The motion passed 6-0. MEMBER MEMBER MEMBER M - Motion S – Second AB – Abstained Y Cameron Abney M David Clonts Y Jarrod Johnson S Frank Brown Y Johnathan Harris Y Wendy Lignell BOA24-02-02, for the property at 0 Huffaker Rd., Rome, GA 30165, Floyd County Tax Parcels H13X184C and H13X134, being zoned Light Industrial (L-I), requests to reduce the rear setback from 30’ to 10’ and to reduce the southern side setback from 20’ to 10’. Director Wood presented the application, staff report, and staff recommendation. Chair Clonts opened the public hearing. Matthew Hodges was present to speak in favor of the application and to answer any questions. No one was present to oppose the application. Chair Clonts closed the public hearing and opened the floor for discussion amongst the voting members. Lignell made a motion to approve, which was seconded by Johnson. The motion passed 6-0. MEMBER MEMBER MEMBER M - Motion S – Second AB – Abstained Y Cameron Abney Y David Clonts S Jarrod Johnson Y Frank Brown Y Johnathan Harris M Wendy Lignell 2 BOA24-02-03, for the property at 703 S Broad St., Rome, GA 30161, Floyd County Tax Parcel I14Z251, being zoned High Density Traditional Residential (H-T-R), requests to reduce the front setback from 20’ to 10’ and to reduce the landscape buffer from 20’ to 10’ on all frontages. Director Wood presented the application, staff report, and staff recommendation. Chair Clonts opened the public hearing. No one was present to speak in favor of the application. No one was present to speak in opposition. Chair Clonts closed the public hearing and opened the floor for discussion amongst the voting members. Abney made a motion to approve, which was seconded by Lignell. The motion passed 6-0.
