ROSEVILLE ZONING BOARD OF APPEALS COUNCIL CHAMBERS 29777 GRATIOT AVENUE ROSEVILLE, MI 48066 Tuesday, July 21, 2020 6:30 p.m. ROLL CALL: PRESENT: Mayor Robert Taylor Mayor Pro Tem Jan Haggerty Board Member: Charles Frontera Catherine Haugh Colleen McCartney Bill Shoemaker Steve Wietecha ABSENT: None OTHERS PRESENT: City Manager Scott Adkins City Clerk Richard M. Steenland City Attorney Tim Tomlinson Building Director Glenn Sexton Mayor Robert Taylor called the meeting to order at 6:30 p.m. I. ROUTINE MATTERS II. OLD BUSINESS 1. Public Hearing and Board Consideration for a variance to split a 100-foot lot into two (2) 50-foot lots on the property located at 19150 Voiland, Peter Daleo (Gold Leaf Building, LLC), petitioner (Tabled at the April 21, 2020 ZBA meeting) Petitioner Peter Daleo, appeared on behalf of this request. City Clerk Richard M. Steenland received a petition with 5 signatures in opposition The following individuals spoke:  Richard Dobbs – 19170 Voiland, is in favor. MAYOR PRO TEM JAN HAGGERTY moved, BOARD MEMBER CATHERINE HAUGH seconded to close the Public Hearing. MOTION CARRIED UNANIMOUSLY BOARD MEMBER CHARLES FRONTERA moved, BOARD MEMBER STEVEN WIETECHA seconded to approve the petitioners requested for a variance based upon the finding that the total area of the new lots will exceed the minimum requirement by over 30% with the following stipulation that them homes are to be built 1400 sq feet colonial. IT IS RESOLVED THAT, pursuant to the application and testimony of the petitioner, and the Zoning Board of Appeals having taken into consideration the nature of the land in question, buildings and other structures located thereon and adjacent thereto, the character of the neighborhood and its general physical development, together with the applicable zoning, and having given consideration to the health, safety and welfare of the area in question, and having considered all of the pertinent factors, it is the finding of this Zoning Board of Appeals that granting the following variance: ROSEVILLE CODIFIED CODE SECTION 370-60 – RESIDENTIAL LOTS IN R-1 DISTRICTS SHALL BE A MINUMUM OF 55’ WIDE FOR INTERIOR LOTS. PERMANENT PARCEL NO. 14-04-104-021 VAR. #0120 will be in harmony with the general purpose and intent of Roseville Codified Code Section 370-60 will be not injurious to the neighborhood or otherwise detrimental to the public welfare, and therefore, is hereby granted. MOTION CARRIED UNANIMOUSLY ZONING BOARD OF APPEALS (7-21-2020) 2 III. NEW BUSINESS 1. Public Hearing and Board Consideration for renewal of previously granted variance (#0619) to park recreational vehicle in front yard area on the property located at 17779 Common, Eric & Lisa Oleson, petitioners. Petitioners Eric & Lisa Oleson Petitioners, appeared on behalf of this request. City Clerk Richard M. Steenland received no correspondence. MAYOR PRO TEM JAN HAGGERTY moved, BOARD MEMBER CATHERINE HAUGH seconded to close the Public Hearing. MOTION CARRIED UNANIMOUSLY MAYOR PRO TEM JAN HAGGERTY moved, BOARD MEMBER CATHERINE HAGH seconded to approve the petitioners requested for a variance based on the practical difficulty that the access to the rear yard is prohibited by a tree located on the adjacent property with the following stipulations:  This recreational vehicle only  This property owner only  On approved surface IT IS RESOLVED THAT, pursuant to the application and testimony of the petitioner, and the Zoning Board of Appeals having taken into consideration the nature of the land in question, buildings and other structures located thereon and adjacent thereto, the character of the neighborhood and its general physical development, together with the applicable zoning, and having given consideration to the health, safety and welfare of the area in question, and having considered all of the pertinent factors, it is the finding of this Zoning Board of Appeals that granting the following variance: PARK RECREATIONAL VEHICLE IN FRONT YARD AREA OF PROPERTY ON THE PROPERTY LOCATED AT 17779 COMMON, ROSEVILLE MI 48066 PERMANENT PARCEL NO. 14-08-251-008 VAR. #0619 will be in harmony with the general purpose and intent of Roseville Codified Code Section 370-101 f will be not injurious to the neighborhood or otherwise detrimental to the public welfare, and therefore, is hereby granted. MOTION CARRIED UNANIMOUSLY 2. Public Hearing and Board Consideration for renewal of previously granted variance (#0819) to allow for a home occupation as a beauty shop/massage business at the property located at 16009 Martin, Grace Cook, petitioner. Petitioner Grace Cook, appeared on behalf of this request. City Clerk Richard M. Steenland received no correspondence. ZONING BOARD OF APPEALS (7-21-2020) 3 MAYOR PRO TEM JAN HAGGERTY moved, BOARD MEMBER CATHERINE HAUGH seconded to close the Public Hearing. MOTION CARRIED UNANIMOUSLY BOARD MEMBER BILL SHOEMAKER moved, BOARD MEMBER COLLEEN MCCARTNEY seconded to approve the petitioner’s request for a variance the property is located on Martin Road which is designed for greater traffic volume, only (1) parking space is needed for this home occupation which will be provided on the existing driveway with the following stipulation:  This approval will be for 2 years. ROLL CALL VOTE Board Member McCartney – Yes Board Member Haugh – Yes Mayor Pro Tem Haggerty – Yes Mayor Taylor – Yes Board Member Shoemaker – Yes Board Member Wietecha – No Board Member Frontera – No MOTION CARRIED IT IS RESOLVED THAT, pursuant to the application and testimony of the petitioner, and the Zoning Board of Appeals having taken into consideration the nature of the land in question, buildings and other structures located thereon and adjacent thereto, the character of the neighborhood and its general physical development, together with the applicable zoning, and having given consideration to the health, safety and welfare of the area in question, and having considered all of the pertinent factors, it is the finding of this Zoning Board of Appeals that granting the following variance: REQUEST TO ALLOW FOR BEAUTY SHOP AS A HOME OCCUPATION AT 16009 MARTIN, ROSEVILLE MI 48066 PERMANENT PARCEL NO. 14-18-254-050 VAR. #0819 will be in harmony with the general purpose and intent of Roseville Codified Code Section 370-14 N10 will not be injurious to the neighborhood or otherwise detrimental to the public welfare, and therefore, is hereby granted. MOTION CARRIED III. HEARING OF THE PUBLIC No one from the public wishes to be heard. ZONING BOARD OF APPEALS (7-21-2020) 4 IV.
