ROSEVILLE ZONING BOARD OF APPEALS COUNCIL CHAMBERS 29777 GRATIOT AVENUE ROSEVILLE, MI 48066 Tuesday, October 20, 2020 6:30 p.m. ROLL CALL: PRESENT: Mayor Robert Taylor Mayor Pro Tem Jan Haggerty Board Member: Charles Frontera Catherine Haugh Colleen McCartney Bill Shoemaker Steve Wietecha ABSENT: None OTHERS PRESENT: City Manager Scott Adkins City Clerk Richard M. Steenland City Attorney Tim Tomlinson Building Director Glenn Sexton Mayor Robert Taylor called the meeting to order at 6:30 p.m. I. ROUTINE MATTERS II. OLD BUSINESS 1. Public Hearing and Board Consideration for a variance to erect a free standing off premise billboard sign having less than 500-foot setback from residentially zoned property on the property located at Vacant 11 Mile Road (PP#14-17-376-078), Five Star Outdoor Media LLC (Joe Oram), petitioner. Petitioner Joe Oram, appeared on behalf of this request. City Clerk Richard M. Steenland received 3 letters in opposition. The following individuals spoke on this agenda items:  David Dugger, 17415 11 Mile Rd. Roseville Church of Christ, is opposed to agenda items 1,2,3 and 4.  Patricia Kinsey, 27138 Maple, is opposed to agenda items 1,2,3 and 4. MAYOR PRO TEM JAN HAGGERTY moved, BOARD MEMBER STEVEN WIETECHA seconded to close the public hearing. MOTION CARRIED UNANIMOUSLY BOARD MEMBER COLLEEN MCCARTNEY moved, BOARD MEMBER CATHERINE HAUGH seconded to deny the petitioners requested for a variance due to the fact that no undue hardship, unique circumstance or practical difficulty exists, or if it does, it was directly caused by the petitioner’s actions. My finding is based upon: 1. Any undue hardship, unique circumstance or practical difficulty that may exist is self created by the petitioner’s desire to erect an off-premise sign at this location 2. An off-premise sign at this location will not be in harmony with other structures in this area 3. An off-premise sign at this location is aesthetically inconsistent wit the area, especially in relationship to the view from residences in the area. IT IS RESOLVED THAT, pursuant to the application and testimony of the petitioner, and the Zoning Board of Appeals having taken into consideration the nature of the land in question, buildings and other structures located thereon and adjacent thereto, the character of the neighborhood and its general physical development, together with the applicable zoning, and having given consideration to the health, safety and welfare of the area in question, and having considered all of the pertinent factors, it is the finding of this Zoning Board of Appeals that granting the following variance: TO ERECT A FREESTANDING OFF-PREMISE BILLBOARD SIGN HAVING LESS THAN 500 FOOT SETBACK FROM RESIDENTIALLY ZONED PROPERTY ON THE PROPERTY AT VANCT 11 MILE ROAD, ROSEVILLE MI 48066 PERMANENT PARCEL NO. 14-17-376-078 VAR. #0520 will be in harmony with the general purpose and intent of Roseville Codified Code Section 3370-57c will be injurious to the neighborhood or otherwise detrimental to the public welfare, and therefore, is hereby denied. MOTION CARRIED UNANIMOUSLY ZONING BOARD OF APPEALS (10-20-2020) 2 2. Public Hearing and Board Consideration for a variance to erect a free standing off premise billboard sign greater than 15 degrees perpendicular to right-of-way on the property located at Vacant 11 Mile Road (PP# 14-17-376-078), Five Starr Outdoor Media (Joe Oram), petitioner Petitioner Joe Oram, appeared and requested this item be removed. 3. Public Hearing and Board Consideration for a variance to erect a free standing off premise billboard sign having a height greater than 50 feet on the property located at Vacant 11 Mile Road (PP#14-17- 376-078), Five Star Outdoor Media LLC (Joe Oram), petitioner. Petitioner Joe Oram, appeared and requested this item be removed. 4. Public Hearing and Board Consideration for a variance to erect a free standing off premise billboard sign greater than 300 square feet in area on the property located at Vacant 11 Mile Road (PP# 14- 17-376-078), Five Star Outdoor Media LLC ( Joe Oram), petitioner. Petitioner Joe Oram, appeared and requested this item be removed. III. NEW BUSINESS 1. Public Hearing and Board Conidiation for a variance to allow outdoor storage with front yard area that exceeds height of screening devise on the property located at 30615 Groesbeck, Michael Mione (GLPS Advanced Recycling), petitioner. Petitioner Michael Mione, appeared and requested City Clerk Richard M. Steenland received no correspondence. MAYOR PRO TEM JAN HAGGERTY moved, BOARD MEMBER CATHERINE HAUGH seconded to close the Public Hearing. BOARD MEMBER STEVEN WIETECHA moved, BOARD MEMBER COLLEEN MCCARTNEY seconded to approve the petitioners requested for a variance being there is no room in the rear yard, being a unique circumstance with the following stipulation:  Review in one year before the ZBA. IT IS RESOLVED THAT, pursuant to the application and testimony of the petitioner, and the Zoning Board of Appeals having taken into consideration the nature of the land in question, buildings and other structures located thereon and adjacent thereto, the character of the neighborhood and its general physical development, together with the applicable zoning, and having given consideration to the health, safety and welfare of the area in question, and having considered all of the pertinent factors, it is the finding of this Zoning Board of Appeals that granting the following variance: ALLOW OUTDOOR STORAGE WITHIN FRONT YARD AREA THAT EXCEEDS HEIGHT OF SCREENING DEVICE ON THE PROPERTY AT 30615 GROESBECK, ROSEVILLE MI 48066. PERMANENT PARCEL NO. 14-07-227-014 VAR. #0920 ZONING BOARD OF APPEALS (10-20-2020) 3 will be in harmony with the general purpose and intent of Roseville Codified Code Section 370-50 (A) 1 & 2 will be not injurious to the neighborhood or otherwise detrimental to the public welfare, and therefore, is hereby granted. MOTION CARRIED UNANIMOUSLY 2. Public Hearing and Board Conidiation for a variance to keep fence within the side yard located at 16325 Charleston, Dawn Perron, petitioner. Petitioner Dawn Perron, appeared and requested. City Clerk Richard M. Steenland received no correspondence. MAYOR PRO TEM JAN HAGGERTY moved, BOARD MEMBER STEVEN WIETECHA seconded to close the Public Hearing. BOARD MEMBER CHARLES FRONTERA moved, BOARD MEMBER COLLEEN MCCARTNEY seconded to approve the petitioners requested for a variance being a unique circumstance exists that the petitioner has concern for her family’s ability to privately enjoy the property. IT IS RESOLVED THAT, pursuant to the application and testimony of the petitioner, and the Zoning Board of Appeals having taken into consideration the nature of the land in question, buildings and other structures located thereon and adjacent thereto, the character of the neighborhood and its general physical development, together with the applicable zoning, and having given consideration to the health, safety and welfare of the area in question, and having considered all of the pertinent factors, it is the finding of this Zoning Board of Appeals that granting the following variance: ROSEVILLE CODIFIED CODE SECTION 134-7(A) 7(D) – FENCES SHALL NOT BE INSTALLED IN A SIDE YARD UNLESS REQUIEMENT IS WAIVED BY ABUTTING PROPERTY OWNER. PERMANENT PARCEL NO. 14-18-256-014 VAR. #1020 will be in harmony with the general purpose and intent of Roseville Codified Code Section 134-7(A) 7(D)will be not injurious to the neighborhood or otherwise detrimental to the public welfare, and therefore, is hereby granted. MOTION CARRIED UNANIMOUSLY 3. Public Hearing and Board Conidiation for a variance to keep more than 150 sf of building signage on the property located at 17580 Frazho, Tim Sawyer (U-Haul), petitioner. Petitioner Tim Sawyer, appeared and requested. City Clerk Richard M. Steenland received no correspondence. MAYOR PRO TEM JAN HAGGERTY moved, BOARD MEMBER COLLEEN MCCARTNEY seconded to close the Public Hearing. BOARD MEMBER STEVEN WIETECHA moved, BOARD MEMBER BILL SHOEMAKER seconded to approve the petitioners requested for a variance to keep more than 150 sf of building signage on the property located at 17580 Frazho with the exception the roll up doors need to be removed on the exterior of the building. ZONING BOARD OF APPEALS (10-20-2020) 4 IT IS RESOLVED THAT, pursuant to the application and testimony of the petitioner, and the Zoning Board of Appeals having taken into consideration the nature of the land in question, buildings and other structures located thereon and adjacent thereto, the character of the neighborhood and its general physical development, together with the applicable zoning, and having given consideration to the health, safety and welfare of the area in question, and having considered all of the pertinent factors, it is the finding of this Zoning Board of Appeals that granting the following variance: KEEP MORE HTAN 150 SF OF BUILDING SIGNAGE ON THE PROPERTY OF 17580 FRAZHO ROSEVILLE, MI 48066. PERMANENT PARCEL NO. 14-20-326-040 VAR. #1120 will be in harmony with the general purpose and intent of Roseville Codified Code Section 264(5) B 4(b) will be not injurious to the neighborhood or otherwise detrimental to the public welfare, and therefore, is hereby granted. MOTION CARRIED UNANIMOUSLY 4. III. HEARING OF THE PUBLIC No one from the public wishes to be heard. IV.
