PERRY/MAEVERS Proposed Ordinance 22-07 Amendment 3 to Chapter 27 – Roswell City Code Comprehensive Cannabis Ordinance ACTION REQUESTED: This is a Mayor initiated request to consider approval to advertise to hold a public hearing and consider the adoption of proposed Ordinance 22-07 amending Chapter 27, Article 12, of the Roswell City Code relating to cannabis. Proposed Ordinance 22-07 BACKGROUND: • On August 12, 2021, the Roswell City Council adopted Ordinance 21-09, which established a new section of the Roswell City Code relating to cannabis. • Council’s approval of Ordinance 21-09 created a general framework for Chapter 27, yet many sections were reserved for future provisions. • Resolution 21-59 establishing a schedule of fees for Cannabis related projects was passed by the City Council on September 9, 2021 Proposed Ordinance 22-07 BACKGROUND: • Amendment 1, Ordinance 21-10 establishing time, place, and manner in which Chapter 27 applies was approved by the City Council on October 14, 2021. • Amendment 2, Ordinance 21-13, establishing Operational Permits, Inspections, and Enforcement provisions was approved by the City Council on December 9, 2021. Proposed Ordinance 22-07 BACKGROUND: • Staff completed the first draft of the Cannabis Development Guide in October 2021 • Revised/Updated Applications for Cannabis Establishments were completed by mid-December 2021 • The Community Development Department has been ready to accept applications for Cannabis Establishments since January, 2022. Proposed Ordinance 22-07 BACKGROUND: • City staff is continuously monitoring for information and updates related to the processing of cannabis applications, and changes to the rules and regulations from the State of New Mexico. • City staff believes taking an incremental approach to the development of Chapter 27 is the optimal approach for both municipal administration and interested applicants as changes to State regulations are adopted. Proposed Ordinance 22-07 • Proposed Ordinance 22-07, as Amendment 3, creates, modifies, and enhances certain sections and subsections of Chapter 27. • The proposed ordinance will modify Article 12: Non- Conforming Uses, to create provisions for the approval of any previously approved Medical Marijuana establishment to begin operations as a Retail Cannabis Establishment upon presentation of an approved Cannabis Retailer License from the Cannabis Control Division of the New Mexico Regulation and Licensing Department as specified in the Cannabis Regulation Act. Proposed Ordinance 22-07 • Purpose of Proposed Ordinance 22-07 • The proposed ordinance will modify Article 12: Non- Conforming Uses, to provide for streamlined provisions which will allow legal non-conforming uses to operate as both a Recreational Cannabis Retailer and Medical Dispensary following receipt of an approved Cannabis Retailer License from the Cannabis Control Division (CCD) of the New Mexico Regulation and Licensing Department (NMRLD). Proposed Ordinance 22-07 • Amendments and Revisions to Article 12 • The proposed ordinance will modify Article 12: Non- Conforming Uses, Sec. 27-150 and Sec. 27-151.B. • Sec. 27-150. – Purpose will be amended to reflect the provisions to allow existing legal, non-conforming, uses to operate as both a Recreational Cannabis Retailer and Medical Dispensary • Sec. 27-151.B. – Authority to Continue will be revised to create and exception for existing medical dispensaries to engage in recreational cannabis sales Proposed Ordinance 22-07 • Additions to Article 12 • The proposed ordinance will modify Article 12: Non- Conforming Uses, creating Sec. 27-150.C. • Sec. 27-151.C. – Subject to the restrictions of Sec. 27-152, any legally permitted, non-conforming, medical dispensary, in operation as of January 1, 2022, that has applied for, and received an approved Cannabis Retailer License from the Cannabis Control Division (CCD) of the New Mexico Regulation and Licensing Department (NMRLD), may apply for an amended City Business Registration to allow for the commencement of Retail Sales of Recreational Cannabis in addition to the existing Medical Cannabis sales. Proposed Ordinance 22-07 • Beneficial Effects of Proposed Ordinance 22-07 • Cannabis Establishments legally operating within the City of Roswell will be able to begin sales of recreational cannabis immediately after providing proof that the establishment has received an updated license from the NMLRD/CCD and updating the establishment’s Commercial Business License Registration. • Applications to be filed with the Community Development Dept. only • For Existing Cannabis establishments, removes any requirement for Planning & Zoning Commission consideration • For Existing Cannabis establishments, removes City Council final decision–making authority (including variance requests). • Fees associated with cannabis Establishment approval reduced to Business License Registration only ($35) Proposed Ordinance 22-07 • Potential Concerns related to implementation of Ord. 22-07 • Staff will be limited in their analysis and due diligence conducted on projects related to cannabis to protect health, safety and welfare • Without the Zone Change, Conditional Use permit, or Variance applications, staff will be unable to propose appropriate operational standards related to time, place, and manner. • Without a requirement for a Variance, several of the existing cannabis facilities will be located within the required 300’ separation/setback area. • For existing cannabis facilities, neither the Planning and Zoning Commission nor City Council, will have the ability or authority to provide input regarding concerns related to public health & safety. • Fees for Dispensaries have made contact with the Community Development Department. ITEM NO. 20 (CORN/STARK) ARMSTRONG CONSULTANTS, INC. • Consider approval of Task Order G (a listed project) of the Professional Services Agreement with Armstrong Consultants, Inc. to update the Airport Master Plan and Airport Layout Plan. • The Airport Master Plan was updated in 2012. FAA recommends an update approximately every 10 years. • The cost of the project will be $721,052.38 including NMGRT which will be funded 95% by an FAA Grant with 5% to be split between the City and the State Aviation Div. REGULAR ITEM NO. 21 (CORN/CHRISTOPHER) FAITH GROUP, LLC. • Consider approval of contracting the research and generation of a new Airport Security Program (ASP) approved by the Transportation Security Agency by the Faith Group, LLC. • The Roswell Airport (ROW) is required by the Transportation Security Administration (TSA) to provide a new Airport Security Plan (ASP) to the TSA. • The Faith Group specializes in the design, development, and finalization of a TSA approved ASP including pertinent TSA Security Directives and TSA National Amendments required due to the imposed time constraints. • Currently this is under the sole source procurement process, the sole source protest period ends 04/23/2022. • The fee is $99,268.96 to be paid out of Air Center reserve funds which will require a budget adjustment.
