(Heldenbrand/Yntema) BACKGROUND: FINANCIAL CONSIDERATION LEGAL REVIEW: STAFF RECOMMENDATION: Attachments Draft Resolution 24-33 City Council 2 of 8 Roswell, NM  RESOLUTION 24-33 A RESOLUTION APPROVING ECONOMIC DEVELOPMENT AT THE ROSWELL AIR CENTER BY THE CITY OF ROSWELL WHEREAS, the purpose of the Local Economic Development Act (LEDA), N.M.S.A. 1978 §§ 5-10-1, et. seq. (the “Act”), is to provide public support for economic development to foster, promote, and enhance local economic development efforts; and WHEREAS, the legislature of the State of New Mexico appropriated funds to the New Mexico Economic Development Department (“EDD”) for economic development projects statewide pursuant to the Act (the “Appropriation”); and WHEREAS, the City of Roswell (the “City”) has adopted LEDA by Ordinance 11-05 which established the City’s Economic Development Plan that promotes economic development within Roswell; and WHEREAS, Section 5-10-15(A)(2)(c) of LEDA allows for the application of LEDA funds to provide extensions or improvements to infrastructure, excluding buildings, on government owned land not obtained through the issuance of industrial revenue bonds pursuant to the Industrial Revenue Bond Act or the County Industrial Revenue Bond Act in a municipality with a population of less than sixty thousand; and WHEREAS, the City plans to enlarge and extend the City's water and wastewater system at the Roswell Air Center ("Airport"); and WHEREAS, by enhancing the water supply system and increasing the fire flows and pressures to the development area this project will allow the City to attract aerospace and airport- related companies; and WHEREAS, the City wishes to accept the Funds, to enter into a Subward Agreement for CSLFRF Program funds with the EDD and to enter into an Intergovernmental Agreement with the EDD to allocate funds, as provided for in Ordinance 11-05, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL AS THE GOVERNING BODY OF THE CITY OF ROSWELL, NEW MEXICO, that: 1. The Project is hereby approved and the City is authorized to accept and expend related funds. 2. The Administration is authorized to enter into on behalf of the City a Subward Agreement and an Intergovernmental Agreement, in substantially the form attached, with the EDD for purposes of the Project. The ending cash balance for June 30, 2024 will be incorporated into Fiscal Year 2024-2025 Final Budget. FINANCIAL CONSIDERATION No financial consideration at this time. LEGAL REVIEW: No legal review is required at this time. BOARD AND COMMITTEE ACTION: This item will be heard at the Special City Council Meeting on July 17, 2024. Attachments Resolution 24-34 City Council 5 of 8 Roswell, NM  RESOLUTION 24-34 A RESOLUTION APROVING THE FINAL DFA 4TH QUARTER FINANCIAL REPORT FOR FISCAL YEAR ENDING JUNE 30, 2024 FOR THE CITY OF ROSWELL, NEW MEXICO WHEREAS, the governing body of the City of Roswell, State of New Mexico, has approved a budget for the fiscal year 2023-2024, ending June 30, 2024; and WHEREAS, the State of New Mexico Department of Finance and Administration (DFA) requires the FY23-24 4th Quarter Financial Report be approved by the governing body; and WHEREAS, the actual year-to-date revenue and expenditures for fiscal year 2023-2024 crosswalk the amounts to the DFA 4th Quarter Financial Report; and WHEREAS, it is hereby certified that the contents in this report are true and correct to the best of our knowledge and that this report depicts all funds for fiscal year 2023-2024 NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY ROSWELL, NEW MEXICO, that the herein referenced 4th Quarter Financial Report described as Exhibit “A” is approved. Attachments Resolution 24-35 City Council 7 of 8 Roswell, NM  RESOLUTION 24-35 A RESOLUTION ADOPTING AND APROVING THE CITY OF ROSWELL FISCAL YEAR 2024-2025 OPERATING BUDGET WHEREAS, the governing body of the City of Roswell, State of New Mexico, has previously developed a budget for the fiscal year 2024-2025; and WHEREAS, said budget was developed on the basis of need and through the cooperation between the City Manager, Departmental Staff and Elected Officials; and WHEREAS, the official meeting for the review of said budget were duly advertised in compliance with the State Open Meetings Act; and WHEREAS, it is the opinion of the Governing Body that the proposed budget meets the requirements as currently determined for fiscal year 2024-2025. NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY ROSWELL, NEW MEXICO, hereby adopts the Final Budget for fiscal year 2024-2025 ending June 30, 2025 hereinabove described and respectfully requests its approval from the Local Government Division of the New Mexico Department of Finance and Administration.
