Regular Meeting of the Legal Committee Held in the Conference Room at City Hall June 25, 2015 Notice of this meeting was given to the public in compliance with Sections §10-15-1 through §10-15-4 NMSA 1978 and Resolution 14-36. ROLL CALL The meeting convened at 3:03 p.m. with Chairman Perry presiding Councilors Mackey and Henderson. Councilor Denny joined at 3:04 p.m. Staff present: Jennifer Brady, Scott Stark, William Zarr and Elizabeth Stark-Rankins. Guests present: Ron Brown and Councilor Grant. APPROVAL OF AGENDA Councilor Mackey moved to approve the June 25, 2015 regular Legal Committee Meeting Agenda with the exception of taking regular items out of order. Councilor Henderson was the second. A voice vote was unanimous and the motion passed. APPROVAL OF MINUTES Councilor Mackey moved to approve the May 28, 2015 Legal Committee meeting minutes. Councilor Henderson was the second. A voice vote was unanimous and the motion passed. REGULAR ITEMS Recommend to full City Council that the Supplemental Lease Agreement (installation of improvement by Lessor) on Building No. 1050 – To FAA, in the amount of $1,235.16 (reimbursement by US Government) be placed on the Consent agenda for approval. Ms. Brady gave an update on current and future projects for the RIAC. Mr. Stark discussed the Supplemental Lease Agreement on Building No. 1050. Councilor Denny moved to recommend to full City Council that the Supplemental Lease Agreement (installation of improvement by Lessor) on Building No. 1050 – To FAA, in the amount of $1,235.16 (reimbursement by US Government) be placed on the Consent agenda for approval. Councilor Henderson was the second. A voice vote was unanimous; the motion passed. Recommend to full City Council that the Sixth Addendum to Lease Agreement (rent abatement) on Hangar No. 1083 – To Dean Baldwin Painting Limited Partnership, in an amount not to exceed $32,741.42 for 2 new exhaust fans in Bay 2 be placed on the Consent agenda for approval. Mr. Stark discussed the Sixth Addendum to Lease Agreement on Hangar No. 1083. Councilor Denny moved to recommend to full City Council that the Sixth Addendum to Lease Agreement (rent abatement) on Hangar No. 1083 – To Dean Baldwin Painting Limited Partnership, in an amount not to exceed $32,741.42 for 2 new exhaust fans in Bay 2 be placed on the Consent agenda for approval. Councilor Mackey was the second. A voice vote was unanimous; the motion passed. To consider Proposed Ordinance 15-05, which would amend Chapter 22 of the Roswell City Code to a new section 22-40 to authorize permit parking on designated streets, and to recommend to full City Council to authorize a public hearing on said ordinance. Mr. Zarr discussed Proposed Ordinance 15-05. The proposed ordinance is based on complaints of residents near certain high schools. The establishment of permit parking may be necessary in order to avoid parking congestion on nearby streets since parking is available to students on the school district sites. Councilor Mackey moved to recommend to full City Council to authorize a public hearing on Proposed Ordinance 15-05, which would amend Chapter 22 of the Roswell City Code to a new section 22-40 to authorize permit parking on designated streets. A voice vote was unanimous; the motion passed. To consider Proposed Ordinance15-10, which would amend section 3 of Article IV of the Roswell Subdivision Ordinance, entitled “Approval Process”, and to recommend to full City Council to authorize a public hearing on said ordinance. Mr. Zarr discussed Proposed Ordinance 15-10. Councilor Denny moved to recommend to full City Council to authorize a public hearing on Proposed Ordinance 15-10, which would amend section 3 of Article IV of the Roswell Subdivision Ordinance, entitled “Approval Process”.
