MINUTES: Consider approval of the March 26, 2019 P&Z Regular Meeting Minutes Commissioner Lessard MOTIONED to approve the minutes for the March 26, 2019 Regular Planning & Zoning Commission Meeting. Seconded by Commissioner Aguilar. The motion passed by a voice vote of five to zero. (Absent: Commissioner MacCornack and Commissioner Storey) F. PUBLIC HEARING ITEMS: 1. CASE 19-010 VAR: Chair Armstrong introduced Case 19-010, a request for a variance to allow carport to encroach in south street side yard setback. Commissioner Taylor made a MOTION to waive the Reading of the Finding of Facts and Land Use and Zoning Considerations with respect to Case 19-010. Seconded by Commissioner McDaniel. The motion passed by a voice vote of five to zero. (Absent: Commissioner MacCornack and Commissioner Storey) Chair Armstrong: Is there anyone wishing to speak in favor of Case: 19-010? In Favor: Philip Kloppenburg: Stated the southwest corner is the only place on the lot that the carport will work, and asked to utilize the lot. Against: None Mr. Morris: Staff recommends approval of the variance in an industrial area based on the configuration of the lot. Mr. Najar also reviewed the case and supports the variance. MOTION – 19-010 VAR Commissioner McDaniel made a motion to approve Case Number 19-010 based on Findings of Facts, the land use and zoning considerations, testimony material presented during the meeting. Seconded by Commissioner Aguilar. The motion passed by a voice vote of five to zero. (Absent: Commissioner MacCornack and Commissioner Storey) 2. CASE 19-011 ZOC: Chair Armstrong introduced Case 19-011, a request for a zone change to administratively rezone publicly owned properties in the city's jurisdiction. Mr. Morris: The code allows for the administrative change of publicly owned properties including the Old Municipal Airport (OMA) properties. There are no private properties included within these discussions. Staff is applying the text amendments this commission recommended and approved by City Council to implement the new zoning districts to show Page 2 of 3 the land uses the City has on the zoning map. This is a motion we talked about when the zoning districts were discussed. One of the Planning & Zoning Commission’s authorizations as written or provided for in the City Code allows the P&Z commission to rezone properties using an administrative type of process. You are applying the districts to the map for public properties only. MOTION – 19-011 ZOC Commissioner Lessard made a motion to accept the rezoning of publicly owned properties and the terminology for Case Number 19-011. Second by Commissioner McDaniel. The motion passed by a voice vote of five to zero. (Absent: Commissioner MacCornack and Commissioner Storey) G. NON-ACTION ITEM H. OTHER BUSINESS I. PUBLIC COMMENTS Larry Connolly: On the 14th of May, there will be a Forum at the Senior Center regarding Water Conservation. The ETZ and County are interested. Mr. Morris: May 2 at 5:30 at the Library, there will be a public meeting for the new Bicycle and Pedestrian Plan. This local plan will match with the Statewide Bike Plan and connect Bottomless Lakes with Bitter Lake National Wildlife Refuge. J. Chair Armstrong: The applicant has asked due to ETZ Authority, it's not necessary at this point to do this tonight. That doesn't mean it won't come up next month or in May. Mr. Morris: My understanding is the applicant wants to clear up any other cases with the ETZ before it comes back to city P&Z. Wanted it to know if they could leave. To table it means it could be taken off the table later. Armstrong: No, it will not be untabled again. Approval of the Agenda: Commissioner Taylor moved to approve the agenda as amended. MINUTES: Consider approval of the February 26, 2019 P&Z Regular Meeting Minutes Commissioner Aguilar MOTIONED to approve the minutes for the February 26, 2019 Regular Planning & Zoning Commission Meeting with an amendment to include the audience members on the sign in sheet. CASE 19-009 VAR: Request for variance to allow pole sign to encroach in the front yard setback and Right-of-Way. Legal Description: Not Available, UPC 4135060521164000000. Address: 2200 North Main Street – Denny’s Restaurant. (Owner: DENNY’S INC /Agent: Kevin Lukes, Franchise Signs). Chair Armstrong introduced Case 19-009, a request for a variance. Commissioner Storey made a MOTION to waive the Reading of the Finding of Facts with respect to Case 19-009. Seconded by Commissioner Lessard. The motion passed by a voice vote of six to zero. (Absent: Commissioner McDaniel) Chair Armstrong: Is there anyone wishing to speak in favor of Case: 19-009? In Favor: Kevin Lukes via telephone: We are proposing to replace existing Denny’s sign with an updated LED sign and smaller cabinet. The existing sign cabinet is old and dilapidated. It will cost just as much to replace the sign as it would to repair it. Against: None Bill Morris: This is a replacement of an old sign. The proposed sign reduces the cabinet from 20’ wide to 16’ wide. The current sign sits approximately 4’ in the Right-of-Way of US highway 285. City staff would like to move the sign completely out of the Right-of- Way. The sign is a reduction and the non-conforming component goes from a 4’ encroachment to a 2’ encroachment in the Right-of-Way. Staff acknowledges Denny’s efforts in trying to remodel. A variance would make this a conforming sign. Commissioner Taylor: The existing sign is 4’ in the right-of-way right now? Bill Morris: Yes Commissioner Taylor: The proposed sign reduces the encroachment to 2’ in the right-of- way. If the sign moved over 2’ more, there are no problems? Bill Morris: That was originally a request, but the LED relies on a two pole system. It would not be feasible to move the sign anymore. Merideth Hildreth: Even if the sign were even with the property line, it would still require a variance because the sign is still encroaching in the front yard setback. Commissioner Aguilar: Does NM Department of Transportation have anything to do with this? Page 3 of 4 Page 4 of 15 Bill Morris: NMDOT has a certain responsibility to this, but staff has not heard anything from NMDOT. City staff is trying to protect NMDOT right-of-way. Commissioner Storey: Isn’t the airspace under the jurisdiction of the NMDOT? Louis Najar: I would assume the sign already has an airspace encroachment, and the proposed sign reduces the encroachment. I don’t know if NMDOT is aware of the proposed sign, but they should be aware and have a cursory review. Look on page 51 of 52 in the packet, the proposed sign only has one anchor point. I would like to see some structural engineer drawings that show the sign will handle the wind load with one anchor point. Commissioner Lessard: Did the applicant not submit specs? Typically, the specifications will talk about maximum wind load. Merideth showed the specs to City Engineer Louis Najar for review. Louis Najar: The drawings are not part of your packet. The proposed sign will support up to 115mph wind load stamped by Tony Jacob, New Mexico license, 2/6/2019. My recommendation would be to approve recommendation of this variance upon concurrence with NMDOT. Chair Armstrong: You’re ok with the recommendation Bill? Bill Morris: Yes MOTION – 19-009 VAR Commissioner Storey made a motion to approve Case Number 19-009 for a variance on the sign as long as the applicant brings in approval from the New Mexico Department of Transportation.
