SWEARING IN: Commissioner Henderson swore in staff and members of the audience. D. APPROVAL OF THE AGENDA Consider approval of the February 22, 2022 Planning & Zoning Commission meeting agenda. Commissioner Lessard MOTIONED to approve the Tuesday, February 22, 2022 Planning & Zoning Commission agenda. SECONDED by Commissioner McDaniel. The motion passed by a voice vote of 7-0. 1 E. APPROVAL OF MINUTES: Consider approval of the February 22, 2022 Planning & Zoning Commission meeting minutes. Commissioner Henderson MOTIONED to approve the minutes from the February 22, 2022 Planning & Zoning Commission meeting with an amendment to change the phrase “voted to approve” to “moved to approve” in regard to cases 22- 008 CUP, 22-009 CUP, and 22-004 FPLAT. SECONDED by Commissioner Aguilar. The motion passed by a voice vote of 5-0 with Commissioner McDaniel and Commissioner Gutierrez recused from voting (both absent at the February 22, 2022 Planning and Zoning Commission meeting). F. PUBLIC HEARING ITEMS: 1. CASE 22-001 VAR: A request for approval of a variance to minimum lot size requirements in the R-2 zoning district at 914 N Ohio Ave. Subd: DEARR-FRIEND Block: 3 Lot: 1 AND:- Lot: 2 N 17' , Quarter: NW S: 32 T: 10S R: 24E DOC# 202109678 WD Chair Storey introduced Case 22-001 VAR Commissioner McDaniel MOTIONED to waive the reading of the findings of facts and land use and zoning considerations with respect to case 22-001 VAR. SECONDED by Commissioner MacCornack. The motion passed by a voice vote of 7-0. Mr. Spencer Aiken: Presented Case 22-001 VAR. The proposed Variance would allow the property owner to fully utilize the property at 914 N Ohio Ave. Without a Variance, the property owner is unable to further develop the property in the northeast corner of 914 N Ohio Ave. Chair Storey: Is there anyone wishing to speak in favor of Case 22-001 VAR? In Favor: Mr. Aaron Hollingshead: I am the property owner of 914 N Ohio Ave. I support this Variance and I think Spencer did a good job summarizing the rationale. Mr. Louis Najar: Does the sewer line at 914 N Ohio Ave connect to the sewer line on 10th St, or the sewer line in the alley? Mr. Aaron Hollingshead: I do not know. Mr. Louis Najar: The city does not want the sewer line at 914 N Ohio Ave to cross the property at 912 N Ohio Ave without an easement, in case maintenance is required in the future. I would be comfortable if the applicant could verify this with Terry Rains, the surveyor. If there is an easement on the summary plat, we can proceed forward with this Variance. Chair Storey: Would approval of this Variance tonight effect your concerns regarding an easement on the property? Mr. Louis Najar: No, the easement effects the property owners, not the city. Mr. Kevin Maevers: I recommend we read into the record a condition of approval, where the Variance can be approved on the condition the sewer line location at 914 N Ohio Ave is verified. Chair Storey: Is this easement a city issue? 2 Mr. Louis Najar: No, the easement is only an issue for the property owners of 914 and 912 N Ohio Ave. Our City Code states that every lot needs to have an independent sewer line. Mr. Aaron Hollingshead: I would be happy to contact the surveyor and get back in contact with the city after the sewer line location has been identified. Chair Storey: Is there anyone wishing to speak against Case 22-001 VAR? Against: None Motion – 22-001 VAR Based on land use and zoning considerations, finding of facts, surrounding land uses and the regulations established in the Zoning Ordinance and Subdivision Code, Commissioner Lessard MOTIONED to approve Case 22-001 VAR: A request for approval of a variance to minimum lot size requirements in the R-2 zoning district at 914 N Ohio Ave under the condition the location of the sewer line at 914 N Ohio Ave is verified by Rains Surveying. SECONDED by Commissioner MacCornack. The motion passed by a voice vote of 7-0. 2. CASE 22-005 FPLAT: A request for approval of THE OAKS SUBDIVISION UNIT 1 final plat to create 62 residential lots. 22.184 acres +/- south of Country Club Rd & east of Nevada Ave. Subd: EDEN ACRES UNIT 2 SUMMARY PLAT Lot: 2 S: 30 T: 10S R: 24E DOC# 202009093 REC(M). Commissioner MacCornack introduced Case 22-005 FPLAT. Chair Storey and Commissioner Lessard recused themselves from participating on Case 22- 005 FPLAT and Case 22-006 FPLAT and left the dais until the vote and discussions were completed. Commissioner McDaniel MOTIONED to waive the reading of the findings of facts and land use and zoning considerations with respect to Case 22-005 FPLAT. SECONDED by Commissioner Aguilar. The motion passed by a voice vote of 5-0 (Chair Storey and Commissioner Lessard recused). Mr. Spencer Aiken: Presented Case 22-005 FPLAT and Case 22-006 FPLAT simultaneously as the locations are directly adjacent. The Oaks Unit 1 and Unit 7 will help facilitate the development of single family homes, alleviating local demand. Recommended changes from the corresponding Preliminary Plats, heard at the January 2022 P&Z Commission meeting, have been accounted for. Commissioner Henderson: White Oak Dr, which runs horizontally past Nevada Ave to connect Unit 1 and Unit 7 of the Oaks, may be confusing. I recommend a sign in this area that identifies White Oak Dr. 3 Mr. Louis Najar: We would have signage that clearly identifies Mesa Oak Dr and White Oak Dr. Commissioner Henderson: Also, on Magnolia Lane, where it crosses White Oak Dr running horizontally, Alder Ave to the south may be confusing. Mr. Daniel Dattola: We met with the city before the completion of these Final Plats. We believe that the transition from Magnolia Lane to Alder Dr past White Oak Dr makes the most sense. Commissioner Henderson: One of the cul-de-sacs is called Elderberry Ct, and one is Twin Berry Ct. On Unit 7, there is a street called Cedar Lane. In the city, we have Cedar Ave and Cedar Circle, therefore, the street name Cedar Lane may be a bit confusing. Lastly, it appears there is only one way in and out of the subdivisions along Country Club Rd. Mr. Louis Najar: For the first phase of the project, we will only have access along Nevada Ave. During future developmental phases, Sorrento Dr from the east will connect the subdivisions to provide additional access. Commissioner Henderson: How will lots be given addresses, especially along Mesa Oak Dr and Magnolia Lane? Mr. Kevin Maevers: Street addressing is handled in the Planning and Zoning Office. Todd Verciglio, the city’s Real Property Manager, will handle the addressing. Some of the addressing in these proposed Final Plats is subject to change. Commissioner MacCornack: Is there anyone wishing to speak in favor of Cases 22-005 FPLAT and/or 22-006 FPLAT? In Favor: Mr. Larry Connolly: I am in favor of both Final Plats. Mr. Jim Mitchell: We are asking for approval of Units 1 and 7, and the whole project is still in progress as we move forward. Concerns regarding Sorrento Dr access will not be affected on these two proposed Final Plats. Ms. Judy Stubbs: I hope a traffic impact study will be done for these Final Plats, especially along Country Club Ave. The community directly adjacent to the east has a lot of children playing in the streets, so traffic calming measures will be important for this development. Mr. Kevin Maevers: These two Final Plats have many traffic calming measures, such as roundabouts, traffic humps, and short blocks under 600’. These measures will ensure the safety of residents in the area. We will do everything we can to ensure traffic safety is maintained. Commissioner McDaniel: Are there plans to make Country Club Rd a four lane highway in the future? Mr. Louis Najar: Country Club Rd is a primary arterial. Country Club Rd should be a four lane highway, but we have not had funding to make that happen. Commissioner MacCornack: Has a traffic impact analysis been conducted to identify potential improvements? Mr. Louis Najar: The city has not yet conducted a bonafide traffic study. 4 Commissioner MacCornack: Is there anyone wishing to speak against Case 22-005 FPLAT and/or 22-006 FPLAT? Against: None Motion – 22-006 FPLAT Based on the land use and zoning considerations, finding of facts, surrounding land uses and the regulations established in the Zoning Ordinance and Subdivision Code, Commissioner Henderson motioned to approve Case 22-006 FPLAT: A request for approval of THE OAKS SUBDIVISION UNIT 7 final plat to create 48 residential lots. 13.61 acres +/- south of Country Club Rd & west of Nevada Ave. SECONDED by Commissioner Gutierrez. The motion passed by a voice vote of 5-0 (Chair Storey and Commissioner Lessard recused). 5 Chair Storey and Commissioner Lessard returned to the dais. 4. NOMINATION OF P&Z COMMISSION MEMBERS TO FILL VACANCIES: The Planning & Zoning Commission will recommend three applicants for the role of Planning and Zoning Commissioner to the Mayor for appointment, for subsequent recommendation to the City Council. Commissioner Lessard, Commissioner Aguilar, and Commissioner MacCornack recused themselves from motioning on the nomination of P&Z Commissioner vacancies and left the dais until the vote and discussions were completed. Commissioner McDaniel motioned to nominate Saul Aguilar, Jana Lessard, and James MacCornack to serve on the Planning and Zoning Commission for one four-year term, and to forward the list of nominated candidates to the Mayor for recommendation to the City Council. Seconded by Commissioner Gutierrez. The motion passed by a voice vote of 4-0 (Commissioner Lessard, Commissioner MacCornack, and Commissioner Aguilar recused). G. OTHER BUSINESS 1.
