Commissioner Lessard MOTIONED to approve the Tuesday, February 22, 2022 Planning & Zoning Commission agenda with an amendment to switch item two to item one, switch item three to item two, and switch item one to item three. SECONDED by Commissioner Henderson. The motion passed by a voice vote of 4-0 with Commissioner Aguilar, Commissioner McDaniel and Commissioner Gutierrez absent. E. APPROVAL OF MINUTES: Consider approval of the January 25, 2022 Planning & Zoning Commission meeting minutes. Commissioner Henderson MOTIONED to approve the minutes from the January 25, 2022 Planning & Zoning Commission meeting as presented. SECONDED by Commissioner MacCornack. The motion passed by a voice vote of 4-0 with Commissioner Aguilar, Commissioner McDaniel and Commissioner Gutierrez absent. F. PUBLIC HEARING ITEMS: 1. CASE 22-008 CUP: A request for approval of a Conditional Use Permit for Major Home Occupation for in-home childcare. 25 Forest Drive. Subd: NORTH PLAINS PARK 3 Block: 7 Lot: 12 BK: 685 PG: 1097 SWD. Chair Storey introduced Case 22-008 CUP. Commissioner Lessard MOTIONED to waive the reading of the findings of facts and land use and zoning considerations with respect to Case 22-008 CUP. SECONDED by Commissioner MacCornack. The motion passed by a voice vote of 4-0 with Commissioner Aguilar, Commissioner McDaniel and Commissioner Gutierrez absent. Commissioner Aguilar joined the meeting. Mr. Spencer Aiken: Presented Case 22-008 CUP. The proposed CUP will allow a maximum of 12 children to be enrolled in the at-home daycare program. As the drivepad at the property is large and traffic circulation will not be negatively impacted, Staff recommends approval of this case. Chair Storey: Is there anyone wishing to speak in favor of Case 22-008? In Favor: Ms. Jesully Minjares: I am in favor of this proposed CUP as it would provide my mother and me the opportunity to enroll additional children into our at-home daycare program. Chair Storey: Is there anyone wishing to speak against Case 22-008? Against: 2 Ms. Eva Palmer: I was concerned about traffic congestion. However, after learning that only one additional child is planned to be included into the current program, I do not see a problem concerning approval of this proposed CUP. Motion – 22-008 CUP Based on the land use and zoning considerations, findings of facts, and testimony heard tonight, Commissioner Lessard MOTIONED to approve Case 22-008 CUP: A request for approval of a Major Home Occupation Conditional Use Permit to operate an in-home childcare program at 25 Forest Dr. SECONDED by Commissioner MacCornack. The motion passed by a voice vote of 5-0 with Commissioner McDaniel and Commissioner Gutierrez absent. 2. CASE 22-009 CUP: Request for approval of a Conditional Use Permit for Major Home Occupation for in-home childcare. 1613 S Washington Ave. Subd: SOUTH HIGHLANDS EXT C Block: 5 Lot: 9 N 15.6' AND:- Lot: 10 S 62' , DOC# 202006029 QCD. Chair Storey introduced Case 22-009 CUP. Commissioner MacCornack MOTIONED to waive the reading of the findings of facts and land use and zoning considerations with respect to Case 22-009 CUP. SECONDED by Commissioner Henderson. The motion passed by a voice vote of 5-0 with Commissioner McDaniel and Commissioner Gutierrez absent. Mr. Spencer Aiken: Presented Case 22-009 CUP. The proposed CUP will allow a maximum of 12 children to be enrolled in the at-home daycare program. Staff recommends approval of this proposed CUP as the drivepad and drivepad ROW area provide sufficient space to avoid traffic congestion. Chair Storey: Is there anyone wishing to speak in favor of Case 22-009? In Favor: Ms. Margarita Esquibel: We envision a total enrollment of the childcare program of approximately six to eight. Chair Storey: Is there anyone wishing to speak against Case 22-009? Against: None Motion – 22-009 CUP Based on land use and zoning considerations, findings of facts, and testimony heard tonight, Commissioner Henderson MOTIONED to approve Case 22-009 CUP: A request for approval of a Major Home Occupation Conditional Use Permit to operate an in-home childcare program at 1613 S Washington Ave. SECONDED by Commissioner Lessard. The motion passed by a voice vote of 5-0 with Commissioner McDaniel and Commissioner Gutierrez absent. 3 3. CASE 22-004 FPLAT: A request for approval of a final plat for ENCHANTMENT WEST – EISENHOWER SUBDIVISION to create 10 residential lots with roadway and water improvements. 1000 – 1200 Block N Eisenhower Rd. Subd: ENCHANTMENT WEST SUBDIVISION SUMMARY PLAT NO 1 Tract: 1 & Tract 2 S: 36 T: 10S R: 23E BK: 505 PG: 507 WDJ & WDJT. Chair Storey introduced Case 22-004 FPLAT Commissioner Lessard recused herself from voting on Case 22-004 FPLAT and left the room until the vote and discussions were completed. Commissioner Aguilar MOTIONED to waive the reading of the findings of facts and land use and zoning considerations with respect to case 22-004 FPLAT. SECONDED by Commissioner MacCornack. The motion passed by a voice vote of 4-0 with Commissioner McDaniel and Commissioner Gutierrez absent (Commissioner Lessard recused). Ms. Merideth Hildreth: Presented Case 22-004 FPLAT. This proposed Final Plat will create 10 lots for residential development while the city is in demand of additional housing. The corresponding Preliminary Plat was approved at the January 2022 P&Z Commission meeting. We received one protest letter regarding this proposed case, however, Staff recommends approval. Chair Storey: Will you put in sidewalks at the time of street construction? Mr. Louis Najar: No, the developer of the residential lots will be responsible for the implementation of sidewalks. Chair Storey: Is there anyone wishing to speak in favor of Case 22-004 FPLAT? In Favor: Mr. Bill Dennis: I am in favor of this proposed Final Plat. Chair Storey: Is there anyone wishing to speak against Case 22-004 FPLAT? Against: None Motion – 22-004 FPLAT Based on land use and zoning considerations, findings of facts, and testimony heard tonight, Commissioner Henderson MOTIONED to approve Case 22-004 FPLAT: A request for approval of a Final Plat for the purposes of subdividing two tracts into 10 lots for residential development, roadway improvements, and water improvements on the 1000, 1100, and 1200 blocks segment of N Eisenhower Road. SECONDED by Commissioner Aguilar. The motion passed by a voice vote of 4-0 with Commissioner McDaniel and Commissioner Gutierrez absent (Commissioner Lessard recused). 4 G. OTHER BUSINESS 1. Staff Communications, Reports, Information, and Updates Commissioner Lessard rejoined the meeting. Mr. Kevin Maevers: Going forward, we will be paying more attention to the procedural aspects of our Planning and Zoning Commission meetings. We will be stepping up communication in our department. Also, every Wednesday morning at 7 a.m., I will be speaking on the Mike Winters show on the radio to discuss aspects of the Community Development department. H. PUBLIC COMMENTS Mr. Larry Connolly: When is the Community Development department moving into the new location? Also, we need to do a better job at finding an engineer to help Louis. We need to ask the City Council for help in finding another engineer. Mr. Kevin Maevers: We expect to move into the new building next month. I. ANNOUNCEMENTS J. Adjacent Existing Land Use and Zoning Direction: Land Use: Zoning: North Residential District R-1 South Residential District R-1 East Residential District R-1 West Residential District R-1 P&Z Case 22-008 CUP (25 Forest Dr) • The anticipated enrollment of Ms. Minjares’s daycare program is expected to change from seven to eight • Parent/guardian drop off and pick up times are scattered • The drivepad at 25 Forest Dr is larger than the average R-1 residential drivepad • These considerations yield a minimal impact on local traffic circulation along Forest Dr and adjacent streets P&Z Case 22-008 CUP (25 Forest Drive) • In an interview regarding at-home childcare programs with Nick Costales, Deputy Director of Field Services at the State of New Mexico’s CYFD, Nick stated that at-home childcare programs: • Allow parents/guardians opportunities to seek a care provider they know, and increases comfort level • Often provide greater flexibility • Furthermore, the city’s 2015 Comprehensive Plan notes that “more outlets for youths and support for at-risk youths” are needed to support local children in the community (pg. 15) P&Z Case 22-008 CUP (25 Forest Drive) Discussion of Correspondence Received • Two verbal protests received as of today’s date. CASE 21-018 ZOC: Cont’d from December 28, 2021 A request for a change in zoning from the R-2 Residential zoning district to C-2 Community Commercial zoning district on a portion of the property currently owned by the applicant, to facilitate financing for the development of a new Ford Automobile Dealership. Address: 2001 West 2nd Street Chair Storey introduced Case 21-018 ZOC Commissioner Lessard MOTIONED to waive the reading of the findings of facts and land use and zoning considerations with respect to case 21-018. SECONDED by Commissioner McDaniel. The motion (passed) by a voice vote of 7-0. Kevin Maevers: Presented Case 21-018 ZOC, 21-019 ZOC and 22-001 FPLAT simultaneously. Skipped past the history section to emphasize the conditions of approval associated with the three zoning cases. Staff had initial discussions with Mr. Charles Currier, and the Planning and Zoning Commission recommended we continue the cases in the subsequent month to ensure all concerned parties agree with the proposed conditions of approval. Chair Storey: Is there anyone wishing to speak in favor of Case 21-018? In Favor: Mr. Hess Yntema: I was in opposition last month, but after seeing the final plats and conditions of approval, I withdraw my opposition and am in favor of the project. Mr. Charles Currier: I want to thank the Krumland Group and Mr. Maevers. Exhibit F, the conditions of approval, protect the neighborhood and address the concerns of the 4 people in the area. Speaking in regard to Cases 21-018, 21-019 and 22-001, everything looks good, and our agreement has been reached. My wife and I are withdrawing our protests as well, and we recommend the Commission approve these three items. Mr. Toby Gross: I am in favor of the project as it is a big project for Roswell. Mr. Mike Espiritu: The Krumland Auto Group is a major contributor to local economic development. I applaud the city staff for their work. The Krumland Auto Group will be expanding the local tax base with these three projects. Chair Storey: Is there anyone wishing to speak against Case 21-018? Against: None Motion – 21-018 ZOC Based on the land use and zoning considerations, finding of facts, and testimony heard at the meeting tonight, Commissioner Lessard MOTIONED to approve Case 21-018 a change of zoning from R-2 to C-2. SECONDED by Commissioner Henderson. The motion passed by a voice vote of 7-0. 2. The 2016 Comprehensive Master Plan’s Preferred Land Use Scenario Map indicates this property as commercial as it was initially zoned C-1 at the time of the map.
