Councilor Arnold presented information on the Lead program along with Kevin Barry from the NM Mounted Patrol and Division Chief Chaves for Roswell Fire Department, and their visit to Colorado to tour the program in place in Colorado. This item will stay on agenda for updates each month. 3. Animal Services Manager Shantel Mairot presented information on the year long Community Cat Program. Councilor Moore moved to send to Legal Committee with a recommendation to place on the consent agenda. Councilor Arnold was the second. BACKGROUND: Initiated by: Daniel Fuller The fire department applied for funding through the state for the hiring of new firefighters. This grant was approved and in order to receive the funds, a resolution stating acceptance of the money has to be drafted and turned into the DFA. Attachments Draft Resolution 24-XX Award Letter Public Safety Committee 6 of 77 Roswell, NM  RESOLUTION 24-XX A RESOLUTION TO THE NEW MEXICO DEPARTMENT OF FINANCE AND ADMINISTRATION FOR PARTICIPATION IN THE LAW ENFORCEMENT RECRUITMENT FUND (LERF) WHEREAS, the City of Roswell and the Department of Finance and Administration have entered into a grant agreement under the Law Enforcement and Recruitment fund approved in the 2023 legislative session. WHEREAS, the total grant allocation is Three Hundred and ninety three thousand seven hundred and fifty dollars and zero cents ($393,750.00), to be prorated as follows: 1. 100% up to $225,000 the first year, 2. 50% up to $112,500 the second year, and 3. 25% up to $56,250 the third year, WHEREAS, the allocated funds will only be used to perform activities described in the allocations, and the City will follow allocations reporting procedures. BACKGROUND: Initiated by: Toby Franco These structures constitute a public nuisance harmful to the public health, safety and general welfare. FINANCIAL CONSIDERATION: Resolution and notice will be served to owners requiring action within fifteen (15) days. Demolition by the City will proceed if no action is taken and a lien will be placed on the property for cost ranging from $3,000 to $30,000 for each property for removal. LEGAL REVIEW: The City Attorney has reviewed the current resolution. Resolutions must be adopted by a majority vote of the entire City Council. Attachments ATT 1 Resolution 24-XX Condemnations Exhibit Public Safety Committee 10 of 77 Roswell, NM  CITY OF ROSWELL RESOLUTION 24-XX A RESOLUTION REQUIRING THE REMOVAL AND/OR DEMOLITION OF CERTAIN DAMAGED AND DILAPIDATED BUILDINGS, STRUCTURES OR PREMISES; PROVIDING THAT THE CITY SHALL HAVE A LIEN FOR THE COST OF REMOVAL; PRESCRIBING THE PROCEDURE INCIDENT TO SUCH REMOVAL AND/OR DEMOLITION AND DECLARING CERTAIN PROPERTY TO BE IN SUCH STATE OF DISREPAIR, DAMAGE AND DILAPIDATION AS TO CONSTITUTE A DANGEROUS BUILDING AND A PUBLIC NUISANCE PREJUDICIAL TO THE PUBLIC HEALTH, SAFETY AND GENERAL WELFARE. WHEREAS, it is the opinion of the City Council of the City of Roswell, New Mexico, that those certain buildings or structures upon the premises located as follows and purportedly owned of record, or occupied by the parties hereinafter named, are and have become in such state of disrepair, damage and dilapidation as to be a menace to the public health, safety and general welfare of the inhabitants of the community; and further, that it is in the public interest to require the removal thereof, according to law, by reason of the condition or conditions set forth in Exhibit "A". NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL, THE GOVERNING BODY OF THE CITY OF ROSWELL, NEW MEXICO: 1. That the buildings or structures set forth in Exhibit "A" are declared to be in such state of disrepair, damage and dilapidation as to constitute a dangerous building within the purview of Roswell Municipal code section 16-12, as well as being a public nuisance prejudicial to the public health, safety and general welfare. That such dangerous buildings or structures set forth, if any, cannot reasonably be repaired so that they will no longer exist in violation of the terms of the ordinance. 2. The owners, occupants, if any, or agent in charge of said premises be, and they hereby are ordered and required to remove such dangerous buildings, or structures within a reasonable time thereafter not to exceed fifteen (15) days from the receipt of notice by certified mail or from date of publication of this resolution as hereinafter provided, and as the case may be. In the event such removal be not commenced by such owner, occupant or agent, or written objection thereto be filed with the City Clerk within ten (10) days after service of a copy of this resolution by certified mail or by publication, requesting a hearing, then and in such event, the City Manager is hereby authorized and directed to cause such dangerous buildings or structures to be removed at the sole cost and expense of the owner, owners or other parties having an interest in said properties, and further, that the reasonable cost of such removal shall be and become a subsisting and valid lien against such property so removed and the lot or parcel or land from which such removal was made and shall be foreclosed in the manner provided by law for the foreclosure of municipal liens. Alternatively, the City Manager may act pursuant to Article 3-18-5 (G) (NMSA, 1978), and cause the dangerous buildings or structures to be removed and give title to them or their components to the removing person or persons. In the event the owner or other interested party aggrieved shall file his protest within the time herein provided, requesting a hearing, on the matter, the City Council shall fix a date for hearing, at which time said Protestants shall be entitled to be heard in person, by agent or attorney, and the City Council shall consider evidence whether or not its previous action should be enforced or rescinded. If it shall be determined that the removal order should be enforced, and the owner(s) shall fail or neglect to comply with said decision of the City Council, they shall have a right of appeal to a court of competent jurisdiction by giving notice of such appeal to the City Council within the (10) days after the date of the City Council decision, together with his petition for court review duly filed with the Clerk of the Court within thirty (30) days of the date of the decision complained of. 4. Upon the adoption of this resolution, it shall be the duty of the City Building Inspector to notify the owner, occupant or agent in charge of such building or structure of the adoption of this resolution by serving a copy thereof upon him by certified mail, return receipt requested; and in the event such owner, occupant or agent cannot be found or served within said City as herein above provided, such notice may be served by posting a copy of said resolution upon the premises complained of, followed by legal publication of said resolution one time in a newspaper of general circulation within the city. The total amount was $100,000.00 which was obtained, deposited and transferred to RPD account. The money requested, which is only $90,000, will be used to purchase cameras and equipment for the Real Time Crime Center. The money will be reimbursed by the State Homeland Security Grant Program (SHSGP) grant. FINANCIAL CONSIDERATION: Monies used from our account will be reimbursed by the grant and placed back into our account. Total activities 2252 2605 2214 7071 ACCOMPLISHMENTS • I was only able to get one Advanced Courtroom Class completed and 2nd day was canceled due to flood. • Almost all of Patrol has completed the Annual training for this month. • ENSF was completed with minor issues. PLANS FOR NEXT MONTH • Patrol is continuing to conduct traffic details in problem areas and intersections. • OT will still be posted for the STEP/ENDWI/BKLUP. • Get in more units and get them out on the street. ISSUES AND CONCERNS • Vehicles are still an issue, but due to the flood, losing 9 vehicles has put a major stress on Patrol and its units. I know vehicles are coming, but with 9 down and with the 5 in the academy graduating this Thursday, we will be very thin or no spares. Some of the Dodge Durangos are having issues with radiator hoses, oil coolers, battery issues and recalls are now coming in for the new Durangos. I know we are getting more, but Patrol needs more to fully staff patrol with a good fleet. 4 Public Safety Committee 41 of 77 Roswell, NM  • Patrol Officers are not signing up for overtime details other than Airport detail/chief’s overtime. I believe this is due to our very young Division and wanting to have some life after work, not just work, but then again Airport Detail does not require reports and traffic tickets. • Patrol lost Officer G. Stello (3-yr officer) to an out-of-state agency due to higher salary. Officer U. Jimenez (5½-yr officer) is in background with Grand Prairie, TX (sitting #3 in the hiring processes) and Officer M. Sedillo (4½-yr officer) is starting the testing process with same agency due to a higher salary. This agency is hiring 19 in total. We lost Traffic Officer S. Taylor (2-yr officer) to ECSO due to higher salary and they are still looking at taking other officers. We also lost Officer Medrano who could not get through FTO and Officer M. Juarez resigned. If the above two leave RPD, it will bring the total officers leaving count to 14 with 97% of their departure because of higher pay. This does not include all are FTOs, general instructors, SFST instructor, DRE certified and CDR/EDR certified. Just to name a few we are losing. I have talked with these officers and I can tell you they are not living outside of their means, but with the increase of water taxes, electrical taxes, insurance taxes, groceries taxes, medical bills etc., they are struggling to keep up with life. Some of these officers work overtime and side jobs and still can’t get ahead or are barely making ends meet. RPD does not see lateral transfers due to the city refusing to be competitive with other agencies. I can see other officers leaving in the near future due to this. SWAT On 10-14-24, the SWAT Team was called out to respond to Cloverleaf Trailer Park in reference to an armed barricaded subject. As team members were arriving on scene an opportunity presented itself to use less lethal bean bags round on the suspect while he was outside. Officer Castillo deployed the rounds and we were able to rush in and take the suspect in to custody. He was arrested and the scene was turned back over to patrol. On 10-22-24, the SWAT Team was called out around 0530 in reference to subjects with warrants refusing to exit an apartment at 716 E. Third. The search warrant was in reference to a homicide investigation. Team members entered the residence and deployed OC vapor in to a bedroom. A short time later a male and female exited and were taken in to custody. On 10-22-24, the SWAT team was called back out around 1600 hours in reference to executing two search warrants for CID. The team split in two and we hit 716 E. 3rd Apt B and 605 Redwood all in reference to the homicide. Several persons were detained without incident and both scenes were turned over to CID. 5 Public Safety Committee 42 of 77 Roswell, NM On 10-22-24, at 2042 hours the SWAT Team was called back out in reference to a search warrant at 110 S. Lea. The potential homicide suspect was believed to be inside. The north door of the residence was breached and cleared with the robot. No persons were located inside and the scene was turned over to CID. Training: Members of the team competed in the TTPOA SWAT competition in Houston Texas. The other training was canceled due to most of the team being on admin. leave. Gonzalez participated in the Mesa Middle School Career on Wheels event. They interacted with students from the Mesa Middle School and answered questions that students had prepared for them. 9 Public Safety Committee 46 of 77 Roswell, NM October 26 Sgt. Nguyen and Officer Fontanez participated in Drug Take Back at Walgreens (1200 S. Main St). This was the second time where the Roswell PD and Walgreens collaborated in efforts to collect any expired and unused drugs. The total weight that was collected was 69 lbs. TRAININGS: October 1 & 4: Annual/Biennium Training were conducted downstairs in the training room. These trainings are mandatory in order for officers to maintain their certifications. October 15: Courtroom Testimony class was held at Municipal Court and instructed by Joshua Nairn-Mahan. The training was to improve testimony for officers who haven’t had experience testifying in court. October 30: Sgt. Nguyen instructed an 8-hour shotgun refresher training for officers that currently issued a shotgun for duty use. ACADEMY: Five Recruit Officers (Juanita Hurtado, Andres Arebalos, Codi Dilley, Eduardo Padilla and Jonah Gamboa) are currently attending the NMLEA. They are all expected to graduate November 7. NEIGHBORHOOD WATCH (OFFICER H. GONZALEZ): 10/3 Attended the Neighborhood Watch meeting for the 1700 North Delaware block at the NMMI Police Department conference room. Jim Tucker, the Neighborhood Watch Captain for the 1500 block West Alameda St., was our guest speaker. He shared insights on how the program has improved safety in his neighborhood and discussed actions they’ve taken to enhance their 10/8 Met with Lena Howelton to discuss starting a Neighborhood Watch program in her area. I provided her with a Neighborhood Watch handbook and guidance on how to start the program. 10/11 Met with Jenifer Sinn to discuss starting a Neighborhood Watch program in her neighborhood. Supplied her with a Neighborhood Watch handbook and information on initiating the program. 10/18 Met with Jim Burress from Parks and Recreation to discuss upcoming events he would like me to attend. 10 Public Safety Committee 47 of 77 Roswell, NM Special Investigations Div./Chaves County Metro Narcotics Task Force New Activities – 32 new activities were generated this month. Agents executed 2 search warrants, made 12 controlled buys of narcotics, seized 4 firearms, made 12 arrests, and had 5 activities that were classified as “Other.” SID personnel were involved in 2 separate Officer Involved Shootings (OIS’s) this month. Personnel were off numerous days this month due to the OIS, as well as vacation time used. Despite the limited days worked, Agents were still able to make 12 arrests and seize almost 2 pounds of Methamphetamine this month. Criminal Investigations Division Wednesday 10-2-2024 Det. Barrientos obtained a search warrant for 306 E. Country Club #4 for a forgery investigation. Thursday 10-3-2024 Det. Ness obtained several search warrants for various social media accounts on two separate cases. Sunday 10-6-2024 Det. Rullan was called out a shots fired call which involved subjects from a residence shooting at a vehicle as it drove by, and subjects inside the vehicle shooting back. He obtained a search warrant for 400 S. Kansas and 500 S. Kansas. This investigation is still ongoing. Tuesday 10-8-2024 Det. Rullan obtained search warrants for two vehicles involved in the shots fired incident from 10-6-24. Thursday 10-10-2024 Detectives from CID responded to the Relief Route between S. Main and S. Sunset for an officer involved shooting. This investigation was handled by New Mexico State Police. Tuesday 10-15-2024 Several members of the Criminal Investigations Division were involved in an officer involved shooting and placed on administrative leave. The investigation of this incident was handled by New Mexico State Police. 11 Public Safety Committee 48 of 77 Roswell, NM Tuesday 10-22-2024 Detectives responded to the area of Orchard and 3rd for a homicide. Joseph Russell was located deceased in the roadway. It was determined that Mr. Russell was involved in a fist fight with Robert Garcia. During the course of the fight, Robert Garcia’s son Perry Garcia, and Perry’s girlfriend Theresa Carillo, became involved. Perry Garcia struck Mr. Russell at least two times in the head with a baton or similar type weapon, causing significant injury. Theresa Carillo then shot Mr. Russell once in the chest, killing him. After the shooting, Cruzito Valenzuela disassembled the murder weapon and attempted to hide it, although it was recovered during a search warrant. Det. Juarez worked this homicide and obtained the following arrest warrants: Theresa Carillo – 2nd Degree Murder and Tampering with Evidence Perry Garcia – 2nd Degree Murder Robert Garcia – Tampering with Evidence Cruizito Valenzuela – Tampering with Evidence and Felon in Possession Saturday 10-26-2024 Det. Ness was called out for a battery/missing person. Manuel Lemos had gotten into a domestic with his girlfriend, Samantha Brouillette. After battering her, Manuel then kicked Ms. Brouillette out of his vehicle. Ms. Brouillette still has not been accounted for and is in NCIC as a missing person, however, Det. Ness has talked to several people who have been in contact with Ms. Brouillette. Ms. Brouillette appears to be dodging law enforcement due to the fact that she has a warrant for her arrest. Det. Ness obtained an arrest warrant for Manuel Lemos for Battery Against a Household Member. Monday 10-28-2024 Det. Castillo obtained an arrest warrant for Zachary Thompson for Aggravated Burglary and Conspiracy to Commit Aggravated Burglary. Det. We also provided Fire education for over 2500 kids during National Fire Prevention Week. And of course we had the significant flooding that contributed to around 20 vehicle fires, many of these fires were found during the November month. During this month we also implemented new codes for our inspections software which have proven to be a huge asset but does come with its own learning curve… One example is the missing inspections performed during the fair, resulting in the significantly low numbers, these inspections will be found and accounted for. We had received a call from a concerned citizen wanting a welfare check done on some dogs tied near a mobile home. Officers went out to assess the situation and were informed this family was just in need of some help after loosing almost everything they owned during the flood on 10/19/24. Officers wanted to step in and help with their dogs as much as they can, donating dog beds, food, blankets, and toys. 9 Public Safety Committee 75 of 77 Roswell, NM  KENNEL WORKERS Last Month Activity- Kennel workers continue to work hard and clean every day! TRAINING We have our new hire Tyler Kuehn who started with us on 10/14/2024 making us fully staffed. It was a Boo-Tiful day!  On 10/31/24 we joined Tadpoles Daycare for a Trunk & Treat Event. We had such a great time interacting with the kids and families.
