BOARD OF ADJUSTMENT MINUTES September 22, 2014 The Russellville Board of Adjustment met in its Regular Meeting, Monday, September 22, 2014, at 5:00 p.m. in the City Hall Council Chambers. Members Present: Chairman Blake Tarpley, Jim Sims, and Wesley White Members Absent: Secretary Aldona Standridge and Jim Davenport Visitors/Officials Present: City Planner David Harris, City Attorney Trey Smith. Alderman Randy Horton, Planning Assistant Lequitta Jones, Building Official Brian Holstein, Jim Lynch/City Corp, and Bill W Conley. The First Order of Business was a request to review and approve the minutes of the June 30, 2014 Special Called Meeting. Member Sims made the motion to approve the minutes as written. The motion was seconded by Member White and passed unanimously. The Second Order of Business was a Public Hearing requesting review and approval of a variance from Section 5.2.11 of the Zoning Code to allow two freestanding signs at 702 Weir Road in a C-2 District. Submitted by Bill Conley, on behalf of Fiser Tractor. (14.09.3607) Planner Harris said the Zoning Code (ZC) limits businesses to a single freestanding sign per street frontage, but that two freestanding signs had been on the subject property for years. Because of how long the signs had been present, the City considered them to be legally nonconforming, even though a search of City files yielded no paperwork verifying that the second sign had ever received approval. However, the Zoning Code also dictates that if the second sign is removed by any means the 'grandfathered' approval for it is lost, and the property owner must receive BOA approval for a variance to the Zoning Code to re -erect the second sign. Planner Harris said he did not have a problem with the new sign. It will be a visual improvement over the old sign, and meets all other Zoning Code requirements. Additionally, the subject property is quite large, so a second sign should not visually overload the site. Mr. Harris asked that Board members consider granting the requested relief. Member Sims made the motion to approve the variance to allow two freestanding signs. The motion was seconded by Member White and passed unanimously.
