BOARD OF ADJUSTMENT MINUTES November 26, 2018 The Board of Adjustment held its regular monthly meeting on Monday, November 26, 2018, at 5:00 p.m., in the Council Chambers at City Hall. Members Present Chairman Lannis Nicholson Vice-Chair Wendell Miller Steve Hubbard Members Absent Secretary Karen Yarbrough Rob Caldwell Alderman Brown (non-voter) Visitors Present: Mayor Horton, Planner James Walden, City Attorney Trey Smith, Planning Assistant Lequitta Jones, Jim Lynch/City Corp, Zane Bryson/City Corp, Public Works Director Kenneth Duvall, Fire Marshal Richard Setian, Building Official Brian Holstein, Floodplain Manager Ben Gray, and Steven Cawiezell. Welcome Visitors The First Order of Business was a request to review and approve the minutes of the September 24, 2018 meeting. Member Miller made the motion to approve the minutes as written. The motion was seconded by Member Hubbard and passed unanimously. The Second Order of Business was a public hearing requesting a two-foot variance to allow an 8- foot privacy fence from the 6-foot height requirement for property located at 2402 West 8th Street. Submitted by Steven Cawiezell. (BOA.18.11.3646) Planner Walden said this request is to approve a 2-foot variance to increase the height of the rear yard privacy fence from 6 feet to 8 feet. A precedent exists of generally being lenient towards variances dealing privacy fences. The existing privacy fence is not high enough to provide privacy to the occupants, denying them enjoyment of their property similar to others in the area. The approval would not likely result in harm on adjacent property or harm the public welfare. The staff recommends approval. Member Miller made the motion to approve the request as submitted.
