BOARD OF ADJUSTMENT MINUTES January 28, 2019 The Board of Adjustment held its regular monthly meeting on Monday. January 28, 2019 at 5:00 p.m., in the Council Chambers at City Hall. Members Present Chairman Lannis Nicholson Secretary Karen Yarbrough Steve Hubbard Members Absent Vice-Chair Wendell Miller Vacant Visitors Present: Mayor Richard Harris, Contract Planner Juliet Richey, City Attorney Trey Smith, Planning Assistant Lequitta Jones, Jim Lynch/City Corp, Zane Bryson/City Corp, Public Works Director Kenneth Duvall, Building Official Brian Holstein, Floodplain Manager Ben Gray, and Dave Garza of Barrett & Associates. Welcome Visitors The First Order of Business was a request to review and approve the minutes of the December 17, 2018 regular meeting. Member Hubbard made the motion to approve the minutes as written. The motion was seconded by Member Yarbrough and passed unanimously. The Second Order of Business was a request for a sidewalk waiver on a portion of East Main Street/State Hwy 64 and State Hwy 324. ARDOT refused allowing the improvements, which limits the ability for construction of the sidewalks for the proposed expansion at Conagra Brands Plant, 3100 East Main Street. (File: DV.18.10.156) The Third Order of Business was a request for a sidewalk waiver on a portion of East Main Street/State Hwy 64 and State Hwy 324. ARDOT refused allowing the improvements, which limits the ability for construction of the sidewalks for the proposed expansion at Phil Wright Autoplex, 3200 East Main Street. (File: DV.18.11.157) (Note: Second Order of Business and Third Order of Business were discussed together.) Planner Richey said per comment and email from ARDOT, no sidewalks will be allowed within the right-of-way for Conagra and Phil Wright Autoplex. The City recommends waiver of the requirement entirely, including the fee in lieu option. The City Staff will pursue discussions with ARDOT regarding sidewalk requirements for future projects. Member Hubbard made the motion to approve both sidewalk waivers for Conagra and Phil Wright Autoplex. Member Yarbrough seconded the motion and passed unanimously.
