BOARD OF ADJUSTMENT MINUTES November 25, 2019 The Board of Adjustment held its regular monthly meeting on Monday, November 25, 2019 at 5:00 p.m., in the Council Chambers at City Hall. Members Present Chairman Wendell Miller Vice Chairman Scott Sanders Secretary Justin Cothren Don Jacimore Members Absent John Choate Visitors Present: Mayor Richard Harris, City Planner Sara Jondahl, City Planning Assistant Lequitta Jones, Public Works Director Kenneth Duvall, City Engineer Glenn Newman, Ben Gray Floodplain Manager, Jim Lynch/City Corp, Zayne Bryson, and Dave Garza of Barrett & Associates. Welcome Visitors The First Order of Business is a request to review and approve the minutes of the October 28, 2019 meeting. Member Sanders made the motion to approve the minutes as written. The motion was seconded by Member Jacimore and passed unanimously. The Second Order of Business was a request to approve a non-conforming structure encroaching the 25-foot front yard setback allowing for an expansion, located at 204 Marina Road. Submitted by Dave Garza of Barrett and Associates on behalf of Jose Amaya. (BOA.19.11.3654) Planner Jondahl said this request is to allow an addition in compliance with the setback requirements to a house that is non-conforming due to the front yard setback regulation in an R-2. The application is to build an addition on the rear of the structure in a location that meets current setback requirements. City Planner Jondahl said it’s her recommendation to approve this variance request and allow the applicant to move forward to build an addition to their single-family home. Dave Garza of Barrett & Associates on behalf of Jose Amaya said this house was built in approximately 1885 on an irregular shaped lot. The house was built between the highway and the railroad. The house predates the annexation of the property and also the zoning code. So, we are asking for a variance to allow the expansion. Member Sanders made the motion to approve the request as submitted. The motion was seconded by Member Jacimore and passed unanimously.
