BOARD OF ADJUSTMENT MINUTES May 2, 2024 @ 5:00 p.m. The Board of Adjustment held a meeting on Thursday May 2, 2024 at 5:00 p.m. Members Present Wendell Miller, Chairman Don Jacimore, Vice Chairman Wayne Cummings Josh Stroud Members Absent Justin Cothren, Secretary Visitors Present: City Planner Sara Jondahl, Planner I Victoria Marchant, Planning Assistant Caden Lemley, Welcome Visitors The First Order of Business is a request to review and approve the minutes of the Board of Adjustment April 4, 2024. Member Cummings made a motion to approve the minutes as written. The motion was seconded by Member Stroud and passed unanimously. The Second Order of Business is a Variance from Article 3.1.2 (1.) of the Zoning Code requesting an accessory building closer to the front property line than the plane of the primary structure’s front facade located at 1820 Marina Road. Submitted by Kirk and Dana Warren. (VARI-0324-000504). Planning Assistant Lemley stated that this application is for a variance for an accessory structure closer to the front property line than the primary structure’s front façade. He stated that existing conditions are that located at 1820 Marina Road within the Marina Heights, this is a single family home surrounded by other single family homes and vacant lots. He stated that it is an R-1 (Single Family Residential) zoned property surrounded by other R-1 zoned properties. Planning Assistant Lemley stated that the application is to allow the construction of an accessory structure that is closer to the front property line than the plane of the primary structure’s front façade. He stated that Staff has found the applicant has demonstrated that special conditions exist as there will be little to no visual impact due to their home and the proposed accessory structure being setback over 300ft from the road, and their property is obstructed from neighboring homes by wooded areas. He stated that the applicant has met all of the other variance requirements. It is staff’s recommendation that the Board of Adjustment approve this variance request based on the findings below: 1. The applicant has demonstrated that special conditions exist; and 2. The applicant has met all of the other variance requirements. Member Stroud motioned to approve the Variance requisition.
