Planning & Zoning Commission Meeting ACTION Minutes REGULAR MEETING ACTION MINUTES FEBRUARY 3, 2025 The Planning and Zoning Commission of the Town of Sahuarita met in the Sahuarita Council Chambers, 375 West Sahuarita Center Way, Sahuarita, AZ 85629 on Monday, February 3, 2025. 1. CALL TO ORDER The meeting was called to order at 6:00 P.M. by Chair Ferguson. 2. PLEDGE OF ALLEGIANCE 3. APPROVAL OF MEETING MINUTES FOR JANUARY 6, 2025 MOTION was made to approve the minutes as presented. STUDY SESSION: PRESENTATION AND DISCUSSION ON THE 10-YEAR GENERAL PLAN UPDATE (Case No. SA7-24-00001). Orlanthia Henderson, Planning & Zoning Manager presented Matt Klyszeiko with Michael Baker International who presented a detailed update on the General Plan on “What We’ve Done,” “What We’ve Heard,” and “What’s Next.” Commission Members participated throughout the presentation with discussion. Larry Myers, Assistant Planner, gave the staff presentation. There was minimal discussion from Commission Members. Chair Ferguson opened the public hearing. There were no public speakers. Chair Ferguson closed the public hearing. MOTION was made to recommend approval of Zoning Code Text Amendment case number SA8-25-00001 to the Town Council. RESULT: APPROVED MOVER: Aaron Escamilla, Commissioner SECONDER: Daniel Millet, Vice Chair AYES: Mark Ferguson, Lori Brown, Daniel Millet, Aaron Escamilla 6. COMMUNITY DEVELOPMENT DIRECTOR’S REPORT: Community Development Director Casadei shared a few announcements with the Commission. 7. The Town has contracted with Michael Baker International, Inc. for professional planning services to update the Town’s General Plan. The General Plan Update is a multi-year process that is expected to span into 2026. At the beginning of the process, the Town approved a public participation plan that identifies key community stakeholders and proposes outreach methods that include community workshops, mobile studios and youth workshops. Representatives from Michael Baker International will provide an update on the latest efforts to gather community feedback, including information about the second community survey and the next steps. The attached information has been provided by Michael Baker International and will be part of a project update and study session. Sahuarita Center Way Sahuarita, AZ 85629 sahuaritaAZ.gov Planning & Zoning Commission Staff Report Case No. SA8-25-00001 Commission Meeting Date: February 3, 2025 Agenda Item No. 6 PREPARED BY: Larry Myers, Assistant Planner REVIEWED BY: Anna Casadei, AICP, Community Development Director RECOMMENDATION: Staff recommends approval of the Text Amendment SUBJECT: Public hearing: Zoning Code Text Amendment to the Standards for Major Amendments to the General Plan STC 18.89.100 LOCATION: N/A APPLICANT: Town of Sahuarita PROPOSAL: Amendments to the town code are required to bring it into conformity with House Bill 2482 that was signed by the Governor into law in April 2022. This measure now requires that all major amendments to a municipal general plan be presented at a public hearing within 12 months of when the major amendment is filed, rather than within the same calendar year. This amendment will ensure consistency and compliance with State law. 1 of 3 Case No. SA8-25-00001 February 3, 2025 COMMUNITY DEVELOPMENT 375 W. Sahuarita Center Way Sahuarita, AZ 85629 sahuaritaAZ.gov BACKGROUND: Arizona HB 2482 was signed by Governor Doug Ducey into law in April 2022. Before the 2022 legislation, state statute only allowed municipalities to process major General Plan amendments one time per calendar year, in the same year as filed. This measure now requires that all major amendments to a municipal general plan be presented at a public hearing within 12 months of when the major amendment is filed, rather than within the same calendar year. This amendment brings the zoning code’s General Plan major amendment process into compliance with ARS 9-461.06(H). DISCUSSION: The current town code and the prior state statute state all major amendments to the general plan proposed for adoption by the governing body of a municipality shall be presented at a single public hearing during the calendar year the proposal is submitted. Because of this, town code requires all applications for major amendments to the general plan be made between January 1st and April 30. The amendments are then processed and taken to public hearing before the end of the calendar year. The 2022 legislation significantly eases the process for a major general plan amendment by removing the “same calendar year” requirement. PUBLIC INPUT: A display ad was published in the Green Valley News on January 19, 2025. No comments have been received to date. REQUIRED ACTION: Conduct a public hearing to determine if this code amendment is in the best interest of the Town. RECOMMENDATION: Staff recommends that the Planning and Zoning Commission forward a recommendation of approval of the Zoning Code Text Amendment to the Town Council. 2 of 3 Case No. SA8-25-00001 February 3, 2025 COMMUNITY DEVELOPMENT 375 W. RECOMMENDED MOTION: I move to forward a recommendation of approval of Zoning Code Text Amendment case number SA8-25-00001 to the Town Council. ATTACHMENTS: 1. Major amendments are processed in accordance with the procedure for original adoption of the general plan, per STC 18.89.080. A “major amendment” means a substantial alteration of the municipality’s land use mixture or balance as defined in the general plan (refer to the introduction). B. Public Hearing and Adoption shall be in accordance with ARS 9-461.06. 1. The Planning and Zoning Commission shall hold two or more public hearings at different locations within the town. Action by the commission shall be transmitted to the town council. All applications for major amendments must be considered concurrently by the planning and zoning commission and at the same hearing before the town council. 1. Applications may be filed with the planning and building department between January 1st and April 30th of each year. 2. All major amendments to the general plan proposed for adoption by the governing body of a municipality shall be presented at a single public hearing during the calendar year the proposal is made. 2. All major amendments to the general plan shall be presented to the town council at a public hearing held within twelve months after the proposal is made. 3.
