MEETING MINUTES
November 8, 2022

TOPIC DISCUSSION/ACTION

3. Eric Stone – Vapor Outlet, Appeal Mr. Stone appeared for an appeal hearing and withdrew his appeal.
of violation of Regulation #24 J. Schiller advised Mr. Stone that he has a right to appeal an order of the
Board but should there be a violation in the future the Board has no
discretion and that the penalty is prescribed in the regulation.
D. Greenbaum informed the Board that Joyce Redford will be officially
starting in Salem on December 1, 2022.
S. Moore asked about Delta-8 products and why they are not regulated.
J. Redford explained they are regulated but no one is enforcing this. These
products should be regulated by MDAR. How they get the THC out of
Hemp to make the Delta products they have to synthetically modify it. The
farm bill removed Hemp from being a controlled substance, but it was
meant to make clothes, shoes and the like, not to be manipulated into
something else. There is a serious issue with these products. Additional
discussion took place about CBD and other substances like Cratom.
J. Redford informed the Board that she would be working with the City
Solicitor in Lynn to write draft model regulations for cities and towns to
adopt for the enforcement against the sale of marijuana-based products.
4. Regulation Concerning Deceptive J. Schiller explained Assistant City Solicitor Vickie Caldwell was supposed

Services Pregnancy Centers making a motion to table this until a future meeting that she could attend.

5. Chairperson Communications J. Schiller updated the board on the status of the vending machines for
emergency contraceptives and other public health items. He brought up
some of the concerns regarding these machines, such as, what child will be
coming to City Hall to access these machines? J. Schiller asked would it be
possible to do an outdoor kiosk and it was explained that due to
temperature control on some products this would not be feasible.
D. Greenbaum explained that a representative of the company for the
machines the City would like to purchase explained how they work. There
is a need for electricity and Wi-Fi so in a building is probably the best
solution.
6. Public Health Announcements
/Reports/Updates
a. Public Health S. Darmody informed the Board that the school family flu/COVID clinics
Nurse Report are going well and that the regional group is holding COVID booster
clinics in Beverly, Danvers, and Salem.
S. Moore asked about the bi-valent COVID boosters for young adults,
those under 12 years of age. She tried to register her daughter for a booster
through the schools and kept getting information from the schools. When
she checked all the appointments were full. S. Darmody explained that
when people tried to sign up ahead of time it said the appointments were
full.
b. Health Agent Report D. Greenbaum advised the Board of his upcoming time off.
J. Schiller asked should the Mayor win the election what that would mean
for the Board. Would any member whose term is expiring need to be
reappointed?
D. Greenbaum explained that he did not foresee any changes until after the
new administration was elected. J. Schiller stated he would like to ensure
that the Board remains intact.
D. Greenbaum recommended that once the interim Mayor and a new
administration are in place, he and Dr. Schiller meet with them to discuss
the status of the Board of Health.
D. Greenbaum provided the board with the current expiration dates of their
terms.
