City of Salem, Massachusetts “Know Your Rights Under the Open Meeting Law, M.G.L. c. 30A ss. 18-25 and City Ordinance Sections 2-2028 through 2-2033.” The City Council Committee on Ordinances, Licenses and Legal Affairs co-posted with the Committee of the Whole met remotely via Zoom on Wednesday September 9, 2020 at 6:00 P.M. for the purpose of discussing the matters(s) listed below. Notice of this meeting was posted on September 3, 2020 at 11:07 A.M. (This meeting is being recorded) ATTENDANCE All members of the Committee present. Councillors McCarthy and Riccardi from Committee of the Whole present. Also present are Lt. David Tucker, Traffic & Parking Director David Kucharsky, Assistant Traffic & Parking Director Nick Downing. Madore notes that this is a draft ordinance to codify the annual October resident parking rather than adopt it as an order on an annual basis. Kucharsky and Downing: this draft ordinance consolidates and reconciles the numerous amendments on October resident parking that have been adopted in the past several years. C. Madore moves to amend Warren Street to northerly side only, seconded by C. Prosniewski, voted 5-0, motion passes. C. Sargent moves to amend Margin Street to add even side only, seconded by C. Dibble, voted 5-0, motion passes. C. Sargent would like residents who are eligible for October parking to receive a guest pass, noting that there are many with family that would like to visit during October. C. McCarthy guest passes this would overwhelm street parking when the program is already overburdened. C. Sargent moves to add to Sec. 2 in the draft ordinance “one temporary guest pass shall be issued if requested in accordance with City Ordinance Section 75C, seconded by C. Dibble, voted 4-1, motion passes. C. Sargent moves to amend Sec. 4 to lower October resident parking fines from $50 to $30, the motion was not seconded. C. Dibble moves to refer order #245 out to full Council as amended, seconded by C. Morsillo, voted 5-0, motion passes. #532 Amending Traffic Ordinance Ch. 42, Sec 75 Resident Sticker Parking Program co-posted COW Kucharsky and Downing: The proposed amendments would achieve the following: allow the Traffic & Parking Commission to set policies and procedures on resident sticker parking program in coordination with the Ward Councillor; allow university students who are residing in Salem to become eligible for resident sticker parking (currently only available to Salem State University students); and limit visitor parking permits to 2 per household. Councillors Sargent and Dibble does not want the Traffic & Parking Commission to adopt policies and procedures for resident sticker parking program since that should be under the jurisdiction of the City Council. Kucharsky clarifies that at present there are no policies that guides designation of resident sticker parking zones. The Commission would like to create such policies that would ultimately be reviewed and adopted by the Council. C. Morsillo asks if the Commission would be adopting these as internal policies and procedures. Kucharsky confirms. C. Sargent moves to add “shall review policies and procedures” to page 2, seconded by C. Dibble, voted 2-3, the motion does not pass. C. Morsillo moves to keep the matter in Committee, seconded by C. Dibble, voted 5-0, the motion passes. #241 Amending Traffic Ch. 42 Secs. 75, 51 & 56 relative to Gedney Street and Holyoke Square C. Morsillo moves to refer the matter to the full Council for adoption for first passage, seconded by C. Prosniewski, 5-0, motion passes. #424B Amending Traffic Ch. 43 secs 57C, 51B, 74 & 56 relative to Holyoke Square and Gedney Street C. Morsillo moves to refer the matter to the full Council for adoption for first passage, seconded by C. Prosniewski, 5-0, motion passes. #83 Ordinance Amending Traffic Ch. 42, Sec. 13 – Service Zone – Hawthorne Blvd. (repeal and replace co-posted with COW C. Dibble moves to refer the matter to the full Council for adoption for first passage, seconded by C. Morsillo, 5-0, motion passes. #84 Ordinance Amending Traffic Ch. 42 Sec 56 – Parking Meters – Hawthorne Blvd. (repeal and replace) co-posted with COW C. Dibble moves to refer the matter to the full Council for adoption for first passage, seconded by C.
