CITY OF SALEM SEPTEMBER 10, 2020 CITY COUNCIL REGULAR MEETING A Regular Meeting of the City Council is being held remotely on Thursday, September 10, 2020 at 7:00 P.M. for the purpose of transacting any and all business. Notice of this meeting was posted on September 8, 2020 at 9:52 A.M. This meeting is being taped and is live on S.A.T.V. All Councillors were present. Council President McCarthy presided. Councillor Turiel moved to dispense with the reading of the record of the previous meeting. It was so voted. President McCarthy requested that everyone please rise to recite the Pledge of Allegiance. Appearing in favor was Dave Flewelling from Comcast. He stated this was to provide service to 83 Bridge Street. No one appeared in opposition. Councillor Madore moved that the hearing be closed. It was so voted. Councillor Madore moved that the conduit be granted by Roll Call Vote. Eleven Councillors Voted in the affirmative none in the negative. The matter carries. (#320) – APPOINTMENT OF THOMAS FUREY TO THE PLANNING BOARD Held from the last meeting, the Mayor’s appointment of Tom Furey 36 Dunlap St., as a member to the Planning Board with a term to expire June 25, 2025 was confirmed by a unanimous roll call vote of 11 yeas, 0 nays and 0 absent. Councillor Riccardi requested that a City Seal be sent to Matthew Veno. It was so voted. ORDERED: That the following temporary traffic recommendation Chapter 42, Section 75, “Parking Prohibitions Towing Zone (Resident Sticker), take effect from October 1, 2020 to November 1, 2020 and Ch. 42, Sec. 17A “Schedule of Fines” during the month of October 2020 shall be $50 Monday – Sunday and that fine will cover all parking violations for Parking Prohibitions Towing Zone (Resident Sticker Parking – Ch. 42 Sec. 75) for either year round or temporary streets: Residents of certain streets shall be granted eligibility for temporary resident permit parking, and certain streets shall be designated as temporary resident permit parking streets, from October 1 to November 1, 2020. Eligible residents will have a temporary resident parking permit sent to them in the mail and must display the permit following the written instructions included with said permit. Temporary resident permit parking signage will be installed on said streets. Whereas, the City of Salem had and continues to have one of the highest unemployment rates throughout the peak of the COVID pandemic, driven in part by the steadily increasing percentage of Salem jobs being in the restaurant and service industries, many of which pay lower wages, while Salem residents lose opportunities for higher paying clean industry jobs, and Whereas, many Salem residents are distressed by the present local housing crisis, specifically due to an outright lack of adequate Senior Housing and a shortage of low and middle-income affordable housing. Rather than prioritizing correction of these shortcomings, City Hall continues to permit and encourage growing numbers of luxury apartments and luxury condos, built in large part to be occupied by people moving to Salem from Boston and the Boston Area seeking lower costing housing when compared to Boston. This activity results directly in the rapid increases of rents in Salem. Salem’s rents are also being increased to mitigate costs of our ever increasing tax bills, and while luxury apartments hurt our tax base, clean industry businesses would help stabilize this issue, and help keep Salem’s taxes down and rents down with them. ORDERED: That the Committee on Government Services, Co-posted with the Committee of the Whole meet with Governor Baker’s staff, specifically Secretary Kennealy and/or his staff in the Executive Office of Housing and Economic Development for a workshop Secretary Kennealy said he would be happy to provide. This workshop would allow city of Salem staff, City Councillors, Mayor, Zoning Board of Appeals and Planning Board members learn of state programs, available technical assistance, and “tools in the tool box” to educate and assist the city of Salem in 1. JOBS: Recruiting clean industry businesses to be located specifically within Salem’s Business Park Development (BPD) zoned parcels and within other allowed zones, bringing higher wage jobs to Salem, instead of allowing these properties to be converted into even more luxury apartments, adding still more to the thousands of luxury apartments recently built and planned. 2. HOUSING: To promote and assist in the construction of a.) senior housing, b.) low income housing, and c.) truly affordable middle income housing that Salem residents are asking for and need. Some Salem residents would choose to reside within these units as the housing would be closer to and within their financial reach. Be it further ORDERED, that the Planning Director and Building Inspector attend, and that the Mayor, Salem Affordable Housing Trust Fund Board, Zoning Board of Appeals, and Planning Board members be invited. After discussion whether the first two paragraphs belonged with this order, Councillor Dibble motioned to strike the first two paragraphs, seconded by Councillor Turiel. It was so voted. ORDERED: That the Italian Flag be displayed at Riley Plaza for the month of October in honor of Italian-American Heritage and Culture Month and that the Mayor transmit this order to the appropriate department (pursuant to Ch. 2 Sec. 145 Ordering display of flags) Discussion took place regarding the dates that the flag should be raised. #396 – DISCUSS USE OF ELECTRONICS AND TEXTING DURING COUNCIL MEETINGS The following order introduced by Councillor Dibble was adopted with no discussion due to late file. ORDERED….That the Committee on Government Services, Co-posted with the Committee of the Whole, meet to discuss the possible text messaging and private communications during public City Council meetings and City Council committee meetings, including during the most recent regularly scheduled City Council meeting of Thursday, July 23, 2020, in context of the possible illegal and/or unethical communications by and between any City of Salem officials and determine: 1. If private communications during official City Council meetings are illegal and whether these types of private communications are a violation of Massachusetts state laws, City of Salem ordinances, and the rules of the City Council, and 2. To determine and recommend what action should be taken, if any, including requesting involvement of the Massachusetts State Ethics Commission. Be it further ORDERED, that city officials DO NOT delete these electronic communications, if any, that were made during City Council public meetings for possible investigation of wrongdoing, and that the City Clerk, City Solicitor, and Human Resources Director be ordered to attend and that the Mayor be invited.  11 CITY OF SALEM SEPTEMBER 10, 2020 CITY COUNCIL REGULAR MEETING #396A – DISCUSS TACTICS BY THE ADMINISTRATION AND BOARD MEMBERS The following Order (late file) introduced by Councillor Dibble was denied by a roll call vote of 4 yeas, 7 nays and 0 absent. Councillors Dibble, Dominguez, Flynn and Sargent were recorded in the affirmative and Councillors Hapworth, Madore, Morsillo, Prosniewski, Riccardi, Turiel and McCarthy were recorded in the negative. ORDERED….That the Committee on Government Services, Co-posted with the Committee of the Whole meet to discuss and recommend specific actions to be taken on the possible bullying, lying, and intimidation tactics by Mayor Kim Driscoll, sometimes by the Mayor herself, other times via proxy by certain city employees, certain board and committee members, and other Mayoral supporters. These improper tactics are often used against City Councillors who may disagree with the Mayor, or even simply have questions or concerns. Included in these was the outright recent bullying of At-Large Councillor Domingo Dominguez in respect to two recent poorly worded housing initiatives proposed by the Mayor. These matters were tabled, received from committee only to be put back into committee, and/or then again tabled but not acted on. These tactics were simply to delay the votes for numerous weeks, to allow for more time and for more bullying to take place in an attempt to try to force certain Councillors, especially Councillor Dominguez, to switch their votes. Further, the Mayor has repeatedly attempted to unethically and possibly illegally pressure Councillors to allow the Mayor to “win” on every single issue, often without compromise by the Mayor, and often without questions allowed. In addition, the Government Services Committee is ordered to discuss potential bullying tactics of a member of Salem’s No Place for Hate committee and determine what action, if any, should be taken against the committee member. Be it further ORDERED, that the City Clerk, City Solicitor, Salem Police Chief or designee, and Human Resources Director be ordered to attend, and that the Mayor and No Place for Hate committee be invited to attend. #397 – (#349) – APPROPRIATION OF $130,000.00 FOR PIONEER VILLAGE RELOCATION PROJECT Councillor Turiel offered the following report for the Committee on Administration and Finance co-posted with Committee of the Whole. Article I is hereby amended by adding the following: Section 17B – Municipal Parking Lot Made Available for Local Youth Fundraising Salem youth organizations are authorized to staff the parking lot at 297 Bridge Street and collect a parking fee of $20.00 per vehicle per day on Saturdays and Sundays in October, as well as the second Monday of October and October 31. Organizations seeking to staff the lot shall submit their request to the Traffic and Parking Director no later than August 31. The Director will seek to allow as many organizations that qualify as possible to be granted at least one date to staff the parking lot. If fewer organizations submit requests than dates available, the extra dates shall be distributed to organizations that have indicated a desire or ability to staff the lot on more than one date. If more organizations submit requests than available dates, every attempt will be made to accommodate as many organizations as possible, including having multiple organizations staff the lot on busier and more heavily trafficked dates.
