PUBLIC DISCLOSURE Pursuant to California Government Code section §54957.1, there was no reportable actions on closed session matters. PUBLIC HEARING ID#19-498 Salinas Police Officers Association Received report from Donna Williamson, Liebert Cassidy Whitmore, regarding the Memorandum of Understanding between the City of Salinas and the Salinas Police Officers Association which expired on December 31, 2018. The City and SPOA conducted negotiating sessions in 2018 and 2019. On April 2, 2019, the City declared impasse after the parties were unable to reach an agreement for a successor MOU and subsequently, the parties attended mediation and factfinding. Ms. Williamson presented the City’s last, best, and final offer to the Salinas Police Officers Association. The motion carried by the following vote: Ayes: 6- Councilmember Barrera, Councilmember Cromeenes, Councilmember Davis, Councilmember De La Rosa, Councilmember Villegas and Mayor Gunter Noes: 1- Councilmember McShane Enactment No: RES 21705 ID#19-478 Salinas United Business Association (SUBA) FY 2019-2020 Annual Levy of Assessment and Ordinance Regarding the Collection of Assessments for the SUBA Business Improvement Area (BIA) City of Salinas Page 2 City Council Meeting Minutes - Unofficial September 10, 2019 Received report from Planning Manager Lisa Brinton, a requirement by California Streets and Highways Code Section 36535, “Parking and Business Improvement Area Law of 1989”, to hold a public hearing to receive testimony and consider the levy the annual assessment in the SUBA BIA. The Annual Report and its proposed budget for FY 2019-2020 was presented and constitutes the levy of assessment for the fiscal year. Staff also proposed and ordinance amendment change in efforts to improve the BIA assessment collection rate and make it more efficient to process annual assessments. Lupe Covarrubias Martinez, SUBA Cesar Lara, Building Healthy Communities/TEAMSTERS/Central Coast Labor Council Fernando Samayoa, SUBA Secretary MOTION: Motion was made by Councilmember Davis to approve a Resolution authorizing the levy and collection of the annual assessment in the SUBA BIA for Fiscal Year 2019/20 and directed staff to amend the ordinance removing the City from the collection of assessment process for consideration at a future date. Motion was second by Councilmember McShane. Upon motion by Councilmember Davis, second by Councilmember McShane, Resolution to levy and collect the annual assessment in the Salinas United Business Association ("SUBA") Business Improvement Area ("BIA") for Fiscal Year (FY) 2019-2020 was approved. The motion carried by the following vote: Ayes: 6- Councilmember Barrera, Councilmember Cromeenes, Councilmember Davis, Councilmember De La Rosa, Councilmember Villegas and Mayor Gunter Noes: 1- Councilmember McShane Enactment No: RES 21706 ID#19-470 U.S. Department of Housing and Urban Development (HUD) Consolidated Annual Performance and Evaluation Report (CAPER) for Fiscal Year 2018-19 Received report from Planning Manager Christopher Valenzuela highlighting the Consolidated Annual Performance and Evaluation Report (CAPER) which provides the community with a concise statement regarding HUD funds available for activities undertaken, and an evaluation of the City’s progress in carrying out goals and objectives and the FY 2018-19 Annual Action Plan (AAP). Upon motion by Councilmember McShane, second by Councilmember Cromeenes, Resolution approving the Fiscal Year (FY) 2018-19 Consolidated Annual Performance and Evaluation Report (CAPER) and authorizing submittal to United States Department of Housing and Urban Development (HUD) was approved. Received report from Samuel Klemek, Battalion Chief/Fire Marshal regarding the 2019 Fireworks Season After Action. He reported statistical information related to sale of “Sane-nSane” fireworks, as well as an evaluation of outreach and enforcement efforts related to illegal fireworks use. Staff continues to work to find ways to help combat the issue of illegal fireworks and minimize the impacts to all residents. He added there was a decrease in the number of complaints received through the various reporting resources and enforcement teams noted a significant decrease in illegal fireworks activity city-wide. ID#19-469 2019 California Department of Housing and Community Development Senate Bill 2 - Planning Grants Program Notice of Funding Availability Application Submittal Upon motion by Councilmember Cromeenes, second by Councilmember Davis, Resolution approving a California Department of Housing and Community Development (HCD) Resolution authorizing application submittal and receipt of 2019 California Department of Housing and Community Development (HCD) Senate Bill 2 (SB 2) Planning Grants Program; and a City of Salinas (City) Resolution authorizing application submittal and receipt of 2019 HCD SB 2 Planning Grants Program were approved. The motion carried by the following vote: Ayes: 6- Councilmember Barrera, Councilmember Cromeenes, Councilmember Davis, Councilmember McShane, Councilmember Villegas and Mayor Gunter Absent: 1- Councilmember De La Rosa Enactment No: RES 21713 ID#19-488 League of California Cities’ Voting Delegates Upon motion by Councilmember Cromeenes, second by Councilmember Davis, appointment of Mayor Joe Gunter as the voting delegate and Councilmember Gloria De La Rosa as the alternate voting delegate for the annual League of California Cities' business meeting on policy resolutions was approved. The motion carried by the following vote: Ayes: 6- Councilmember Barrera, Councilmember Cromeenes, Councilmember Davis, Councilmember McShane, Councilmember Villegas and Mayor Gunter Absent: 1- Councilmember De La Rosa COUNCILMEMBERS’ REPORTS, APPOINTMENTS AND FUTURE AGENDA ITEMS Councilmember Davis conditionally appointed Diana Garcia to the Police Community Advisory Committee pending receipt of her application. Councilmember Barrera announced the El Grito Horse Parade taking place on September 14. Councilmember Cromeenes commended the Salinas Police Department for their work. Councilmember Villegas appointed Marcelino Rocamora to the Planning Commission and commended Mr. Rick Giffin for his service on the commission. Councilmember McShane reported that he attended a drug and alcohol prevention training with Valley Health Associates. He added that Monterey Bay Community Power added 10 new jurisdictions and will be increasing their rebates from 3% to 5% in the following years. He commended the work being done in the Chinatown area and requested adding trash receptacles in the area. In closing, he thanked Public Works staff for addressing the median landscaping and tree related issues. Mayor Gunter commended Lew Bauman upon his retirement from the County of Monterey. He reported that he attended the Valley Mayor’s meeting and discussed cannabis operations throughout the County. He encouraged the community to attend the El Grito Festival and other community events.
