PUBLIC HEARINGS HOME Investment Partnership Program - American Rescue Plan (HOME-ARP) Allocation Plan, continued to October 4, 2022 CONSIDERATION ID#22-447 An Ordinance Amending Article XVI of Chapter 20 Received report from City Engineer Adriana Robles regarding vendor ordinance City of Salinas Page 1 City Council Meeting Minutes - Unofficial August 23, 2022 amendments to address concerns brought forward to City Council during the vendor program update on April 12, 2022. The proposed Vendor Ordinance Amendments provide vendors a comprehensive program tailored for vendor business needs while ensuring community health and safety. Amendments include: 1) expanding the hours of operation for roaming food trucks from four (4) to six (6) hours; 2) restricting nonmotorized pushcarts and ice cream truck vendors from operating within a two hundred-foot distance from schools; and 3) establishing the frequency of occupation for designated food truck locations and the revocation process. The following audience members commented on the report: Luis Xago Juarez Jose Urquiz, El Volcan (Spanish translation provided by FAST Services) Introduced Ordinance amending Article XVI of Chapter 20 of the Salinas Municipal Code updating the regulations governing food trucks, ice cream trucks, nonmotorized pushcarts and street vendors (Vendor Ordinance) and recommended additional modifications for final approval on September 6, 2022. ID#22-449 An Ordinance Adding Sections to Chapter 27 of the Salinas Municipal Code Pertaining to Military Equipment Received report from Sergeant James Godwin regarding Assembly Bill 481codified in Government Code sections 7070 through 7075 which requires law enforcement agencies to obtain approval from the applicable governing body prior to the funding, acquisition, or use of “Military Equipment”. The Salinas Police Department seeks Salinas City Council adoption of a Military Equipment policy. Military Equipment tools have been utilized by SPD and other law enforcement agencies to enhance community and officer safety. The Ordinance was introduced on April 26, 2022. ID#22-459 Commercial Cannabis Taxation Recommendation Report Received report from Community Development Director Megan Hunter and SCI City of Salinas Page 2 City Council Meeting Minutes - Unofficial August 23, 2022 Consulting Group Kyle Tankard. They reported that on February 15, 2022, City Council directed staff to hire a consultant to complete a report on recommended taxation rates after hearing testimony of multiple cannabis business owners concerned about long-term financial viability of the industry in the City. The City contracted with SCI Consulting Group which completed the report and found that Salinas’ local cannabis industry “remains viable, relatively stable with the likelihood of a reasonable, limited growth over time”. The report also concluded that the City’s “current rates, rate structure, number and types of businesses are generally appropriate and well within California norms”. While tax revenues are leveling out, the report noted that there is potential for more growth as more permitted businesses become operational. As it relates to current taxation rates, SCI Group recommended the following: - Maintain the existing gross receipts tax rate of 5% on retail businesses. - Reduce the existing tax to a rate between 2.5% and 3% on manufacturing businesses. - Reduce the existing tax to a rate between $7 to $10 per square foot of canopy on cultivation businesses The following audience members commented on the report: Brad Palmer, Cannacruz Jen Montenegro, Lowell Farms Mark, Lowell Farms Daniel Valez, Cannacruz Gant Palmer, Cannacruz Received report regarding the Commercial Cannabis Taxation Recommendation Report.
