CONSENT AGENDA
THE FOLLOWING ORDINANCES, RESOLUTIONS AND OTHER ITEMS MAY BE ACTED UPON BY
ONE MOTION. NO SEPARATE DISCUSSION OR ACTION ON ANY OF THE ITEMS IS NECESSARY
UNLESS DESIRED BY A COUNCIL MEMBER OR A CITIZEN, IN WHICH EVENT THE ITEM SHALL BE
CONSIDERED IN ITS NORMAL SEQUENCE AFTER THE ITEMS NOT REQUIRING SEPARATE
DISCUSSION HAVE BEEN ACTED UPON BY A SINGLE MOTION.
1. Consider approval of Ordinance 2024-46, on the second of two readings, creating a
designated permit area under Section 82.189 of the San Marcos City Code authorizing
parking by permit only at all times for the area consisting of the west side of the 600 block
of Sturgeon Drive from River Road to Clair Street; amending the traffic register to reflect
such designated permit area; including procedural provisions; and declaring an effective
date.
2. Consider approval of Ordinance 2024-49, on the second of two readings, annexing into the
city approximately 51 acres of land (including adjacent right-of-way), generally located on
the southern side of FM-110/East McCarty Lane and the northern side of Old Bastrop
Highway, approximately 1,600 feet west of the intersection between Old Bastrop Highway
and SH-123 (Case No. AN-24-07); including procedural provisions; and declaring an

effective date.
3. Consider approval of Ordinance 2024-47, on the second of two readings, amending the
Official Zoning Map of the city in Case No. ZC-24-06 by rezoning approximately 36.91
acres of land, generally located on the southern side of FM -110/East McCarty Lane and
the northern side of Old Bastrop Highway, approximately 1,600 feet west of the intersection
between Old Bastrop Highway and SH-123, from Future Development “FD” District to
Character District-4 "CD-4", or, subject to consent of the owner, another less intense
zoning district classification; including procedural provisions; and declaring an effective
date.
4. Consider approval of Ordinance 2024-48, on the second of two readings, amending the
Official Zoning Map of the city in Case No. ZC-24-07 by rezoning approximately 9.9 acres
of land, generally located on the southern side of FM-110/East McCarty Lane,
approximately 2,500 feet west of the intersection between FM-110 and SH-123, from
Future Development “FD” District to Commercial "CM" District, or, subject to consent of
the owner, another less intense zoning district classification; including procedural
provisions; and declaring an effective date.
5. Consider approval of Resolution 2024-192R, approving the installation of a permanent
stained glass public art piece at the San Marcos Public Library; authorizing the City
Manager, or her designee, to sign any documents or take other steps as necessary to
procure such installation; and declaring an effective date.
6. Consider approval of Resolution 2024-193R, approving an agreement with Halff
Associates, Inc., for professional services associated with development of the Quail Creek
Preliminary Design Report for the former Quail Creek Country Club property located at
2701 Airport Highway 21 in the estimated amount of $222,530.00; authorizing the City
Manager, or her designee, to execute the agreement on behalf of the city; and declaring an
effective date.
7. Consider approval of Resolution 2024-194R, approving a Change in Service to the
agreement with Tyler Technologies, Inc., to renew MobileEyes Inspection software for use
by the fire department in the estimated annual amount of $16,800.00 for a total contract
amount of $84,000.00, and authorizing up to four one-year renewals; authorizing the City
Manager, or her designee, to execute the appropriate documents to implement the
Change in Service on behalf of the city; and declaring an effective date.
8. Consider approval of Resolution 2024-195R, approving a settlement agreement with
Walton Texas, LP and David Tuckfield providing for the release of land in Caldwell County
east of the city from the Cotton Center Development agreement and MUD Consent
Agreement and providing for the payment of $50,000.00 to the city upon such release; and
declaring an effective date.

9. Receive a staff presentation and hold a Public Hearing to receive comments for or against
Ordinance 2024-50, annexing into the City approximately 30.69 acres of the following road
rights-of-way located in Hays County, Texas; Centerpoint Road as it runs from Hunter Road
to Interstate Highway 35; McCarty Lane as it runs from Hunter Road to Union Pacific
Railroad; Yarrington Road and Harris Hill Road, both as they run adjacent to the Whisper
Development; Posey Road and Old Bastrop Highway, both as they run adjacent to the
Trace Development (Case No. AN-24-06); including procedural provisions; and declaring
an effective date; and consider approval of Ordinance 2024-50, on the first of two
readings.
10. Receive a staff presentation, hold a Public Hearing regarding, and discuss the possible
adoption on October 15, 2024 of the “Vision SMTX Comprehensive Plan” as the
Comprehensive Plan of the City of San Marcos, including the Preferred Scenario Map
therein as the future land use map of the City, to replace the previous Comprehensive Plan,
“Vision San Marcos: A River Runs Through Us” and the associated Preferred Scenario
Map; and provide direction to the City Manager.
NON-CONSENT AGENDA
11. Consider approval of Ordinance 2024-51, on the first of two readings, reappointing a
Presiding Municipal Court Judge for the San Marcos Municipal Court of Record for a term
of two years; and declaring an effective date.
12. Consider approval of Resolution 2024-196R, awarding an Indefinite Delivery Indefinite
Quantity (IDIQ) Master Contract to Texas Materials Group for street overlay services in the
estimated annual amount of $2,500,000.00; authorizing the City Manager, or her designee,
to execute the agreement on behalf of the city; declaring an effective date.
13. Consider approval of Resolution 2024-197R, approving an Indefinite Delivery Indefinite
Quantity (IDIQ) Master Contract with Linetec Services, LLC., for electric distribution
maintenance and construction services in an annual amount not -to-exceed $1,800,000.00
per year for three years, with the option to renew for up to two additional years; authorizing
the City Manager, or her designee, to execute the agreement on behalf of the city; and
declaring an effective date.
14. Consider approval of Resolution 2024-198R, approving the reissuance of revenue bonds
in a principal amount not to exceed $25,550,000.00 by the New Hope Cultural Education
Facilities Finance Corporation for a residential senior living project known as the Villas Del
San Xavier Senior Residences and located at 2621 South 1-35 in San Marcos; and
declaring an effective date.
15. Discuss and consider appointments to fill vacancies on the following Boards and
Commissions; and provide direction to Staff.
A) Animal Shelter Advisory Committee
B) Citizen Utility Advisory Board
C) Parks and Recreation Board
