(City Clerk) B) Approval, denial, amendment, or revision of a Perpetual Flood Protection Levee Easement with Tulsa County Drainage District No. 12 to allow an easement in an area in which the levee already exists and confirm the existing structure as it relates to 8620 W. 21st St. S., Sand Springs, Oklahoma. (Public Works) C) Approval, denial, amendment, or revision of Tum-Key Emergency Repair Rehabilitation of the 200 H.P., 3.18 MGD Pump and Motor No. 2 by Ruhrpumpen, Inc. at the estimated rehabilitation cost of $87,328.00 (Sand Springs 60% is $52,396.80) as it relates to the Skiatook Raw Water Conveyance System. MINUTES Sand Springs Municipal Authority June 27, 2022 – Following City Council Sand Springs Municipal Building 100 East Broadway Street – Council Chambers, First Floor Sand Springs, Oklahoma 74063 www.sandspringsok.org MEMBERS PRESENT: Chairman Jim Spoon (2-0) Vice Chairman Beau Wilson (1-1) Trustee Cody Worrell (2-0) Trustee Matt Barnett (2-0) Trustee Mike Burdge (2-0) Trustee Brian Jackson (1-1) ALSO PRESENT: City Manager Michael S. Almy ABSENT: Trustee Nancy Riley (1-1) The Sand Springs Municipal Authority met in regular session on June 27, 2022, in the Council Chambers of the Sand Springs Municipal Building pursuant to the regular meeting notice and agenda filed with the City Clerk’s office and posted at 10:30 a.m. on June 23, 2022, on the display board located at the front entrance of the Sand Springs Municipal Building (City Hall), 100 East Broadway Street, Sand Springs, Oklahoma 74063. 1. Call to Order Chairman Spoon called the meeting to order at the noted time of 6:58 p.m. 2. Roll Call Chairman Spoon called for an individual roll call with members replying in the following manner: Trustee Jackson, here; Trustee Barnett, here; Trustee Burdge, here; Chairman Spoon, here; Vice Chairman Wilson, here; Trustee Riley, no response; Trustee Worrell, here. It was noted for the record that Trustee Riley was absent from said meeting. MUNICIPAL AUTHORITY MINUTES JUNE 27, 2022 PAGE 2 3. Consent Agenda (A-G) Chairman Spoon informed Trustees that all matters listed under Consent Agenda to be considered by Trustees are to be routine and will be enacted by one motion. Consent Agenda items are vetted through various committees prior to consideration by Trustees. Chairman Spoon noted that questions or clarification on the Consent Agenda item may be addressed prior to taking action. Chairman Spoon requested if Trustees had questions or needed clarification on the Consent Agenda item or whether any item needed to be considered separately. There being none, Chairman Spoon called for a motion regarding Consent Agenda Items No. 3A through 3G. A motion was made by Vice Chairman Wilson and seconded by Trustee Worrell to approve Consent Agenda Items No. 3A through 3G: A) The minutes of the May 23, 2022, regular Municipal Authority meeting. B) The Fiscal Year 2023 insurance renewal with Oklahoma Municipal Assurance Group (OMAG) in the amount of $9,778, with the Sand Springs Municipal Authority portion of 60% or $5,867, as it relates to the Municipal Property Protection Plan (MPPP) for the Skiatook Raw Water Conveyance System. C) The Municipal Property Protection Plan (MPPP) Renewal for Fiscal Year 2023 in the amount of $130,166 with Oklahoma Municipal Assurance Group (OMAG) for property coverage. D) The Municipal Liability Protection Plan (MLPP) Renewal for Fiscal Year 2023 in the amount of $163,570 with Oklahoma Municipal Assurance Group (OMAG) for liability, vehicle, and equipment coverage. E) An Agreement with Metropolitan Environmental Trust (M.e.t.) in the amount of $34,066 as it relates to the Fiscal Year 2023 recycling program operation in Sand Springs, Oklahoma. F) The Oklahoma Municipal Assurance Group (OMAG) Fiscal Year 2023 premium in the amount of $517,306 as it relates to the Workers’ Compensation Plan for employees. MA Water Utility Fund: Increase: Depreciation $205,000 Decrease: Ending Unrestricted Net Assets $205,000 MA Wastewater Utility Fund: Increase: Depreciation $ 65,000 Loss on Assets $ 45,105 Interest on Other Debt $ 1,663 Administrative Fees $ 781 Decrease: Ending Unrestricted Net Assets $112,549 MA Airport Fund: Increase: Depreciation $ 8,000 Bad Debt Expense $ 2,100 Decrease: Ending Unrestricted Net Assets $10,100 Chairman Spoon called for the vote recorded as follows: Trustee Worrell, aye; Vice Chairman Wilson, aye; Chairman Spoon, aye; Trustee Burdge, aye; Trustee Barnett, aye; Trustee Jackson. The motion carried 6-0-0. 4. Award of Bid No. 1110 – Refuse Disposal Location Public Works Director Derek Campbell requested Council’s approval of the Award of Bid No. 1110, Refuse Disposal Location, to American Environmental Landfill Inc. for disposal of Municipal Solid Waste as follows: $25.00 per ton for disposal of Compacted non-hazardous material; and $30.50 per ton for the disposal of Uncompacted non-hazardous material. Following a brief discussion, a motion was made by Vice Chairman Wilson and seconded by Councilor Burdge that the Award of Bid No. 1110, Refuse Disposal Location, to American Environmental Landfill Inc. for disposal of Municipal Solid Waste as follows: $25.00 per ton for disposal of Compacted non-hazardous material; and $30.50 per ton for the disposal of Uncompacted non-hazardous material, as presented, be approved. Details: All three easements are attached; city staff has reviewed the results of the district surveys and has confirmed that the granting of the easements is consistent with existing usage. Project #: Levee Improvements Parcel: Sand Springs Municipal Authority - 072 PERPETUAL FLOOD PROTECTION LEVEE EASEMENT KNOW ALL MEN BY THESE PRESENTS: THAT the Sand Springs Municipal Authority, an Oklahoma Public Trust with the City of Sand Springs as its sole beneficiary, its successors and assigns, hereinafter called the “Grantor,” for and in consideration of the sum of Ten Dollars and 00/100 ($10.00), receipt of which is hereby acknowledged, and for and upon other good, valuable and sufficient consideration, does hereby grant, bargain, sell, convey and dedicate unto Tulsa County Drainage District No. 12, which is organized and operating under the laws of the State of Oklahoma, its successors and assigns, hereinafter called the “Grantee,” a perpetual and assignable right and easement over, under, and across the following described real estate and premises situated in the City of Sand Springs, Tulsa County, Oklahoma, as described on the attached Exhibit “A,” hereinafter called the “Subject Property,” for the use of the Grantee to construct, maintain, repair, operate, patrol, and replace a flood protection levee and pump station, including all appurtenances thereto, and including the right of ingress and egress through Grantor’s property to and from the Subject Property, and all right, title and interest in and to any soil or earthen material within the boundaries of the Subject Property, incidentally removed during the use of this Perpetual Flood Protection Levee Easement, reserving, however, to its owners and assigns, all such rights and privileges in the land as may be used without interfering with or abridging the rights and easement hereby acquired; subject, however, to existing easements for public roads and highways, public utilities, railroads, and pipelines.
