Smith, At-large Tuesday, July 19, 2016 5:15 PM Council Chambers 5:15 Work Session Information Items 1. 16-302 The City Council and Administration will tour the Sandy Museum located at 8744 South 150 East. Agenda Planning Calendar Review Chairman Stephen Smith briefed the Council on the upcoming events on the Agenda Calendar. The next scheduled City Council Meeting will be held on Tuesday, August 9, 2016. Council Member Business Scott Cowdell recommended that the City Council send a proclamation to the GOP supporting the stand against Pornography. The Council supported Mr. Cowdell's proposal. Chris McCandless would like a tour of the new Hale Centre Theater scheduled for the City Council within the next two weeks. He reported on the Tourism Committee presentation. Senator Neiderhauser will continue to support and push for support on Sandy's Child Endangered resolution. Steve Smith would like to see the ten year long term financial plan analysis extended to all city funds. He would like the GASB analysis extended to other departments to determine the condition of infrastructure in the City. He would like to see this happen in the next budget year. He would also like to create a policy from the City Council that requires newly adopted ordinances and resolutions be made availible to the public within 30 days of the change. He believes it is the City Council's responsibility to provide public access to this information. The City Council supported his recommendations. He will bring these items back for discussion at the August 9th Council Meeting. Chairman Stephen Smith adjourned work session. Mayor's Report Assistant CAO Scott Bond represented Mayor Dolan who was excused. Mr. Bond reported on some of the meetings attended by the Mayor. Scott Ellis reported on the algae bloom in Utah Lake and Jordan River. Council questions followed. Scott Earl updated the Council on the heat, humidity, and wind effects on the parks, golf course, and sprinkling patterns. He noted that the Urban fishery is also being monitored for algae. No problems have been sighted. Smith welcomed all those in attendance. Community Development Director Mike Coulam offered the opening prayer. The Sandy City Police Color Guard presented the flag ceremony and led the audience in the pledge. Jim McClintic will present a patriotic slideshow developed for the Sandy Exchange Club and the Proudly We Hail Award. Mike Coulam introduced Building Inspector/Plans Examiner Jim McClintic who prepared a slide presentation that was presented to the Sandy Exchange Club. Jim McClintic noted that the message of this presentation is to teach youth respect for the flag. Citizen Comments a. Earl Bramble, Sandy resident, addressed problems and eviction notices that residents are having at the Parkway Mobile Home Park, 9300 South 480 East. He asked for the Council's support. Chairman Stephen Smith noted that the residents would need to seek separate legal assistant. The City has no authority over landlord/tenant issues. b. Steve Van Maren, 11039 Lexington Circle, believes that more attention, care, and diligence needs to be given to the Council minutes. They have become brief, less accurate, with items being taken out of order. c. Linda Smith, Parkway Mobile Home resident, has been dealing with the owner of the mobile home park. Residents are dealing with trees, water that is being turned off, and a wall with overgrown trees against the freeway and railroad tracks. They asked for help from the City to keep them maintained. Chairman Smith referred Ms. Smith to the Community Development Director Mike Coulam regarding the trees and any other problems that may fall within the City code. Steve Fairbanks clarified that the City has limited authority and cannot enter into civil matters. Citizen comments was closed. Special Recognitions 2. 16-300 Swearing In Ceremony for Deputy Police Chief Bill O'Neal Chief Kevin Thacker introduced Captain Bill O' Neil who was sworn in as the new Sandy City Deputy Police Chief. Deputy City Recorder Wendy Downs performed the swearing in. Sandy City, Utah Page 3 Printed on 8/16/2016 City Council Meeting Minutes July 19, 2016 3. 16-301 Recognizing June Davidson's 100th Birthday Councilman Steve Fairbanks read and presented a Proclamation honoring Centenarian June Davidson, who turned 100 years old in June. Mr. Fairbanks stated that this is not an honor that occurs that often. Mr. Fairbanks mentioned the proclamations from Orrin Hatch and Governor Gary Herbert. A video was shown. Consent Calendar 4. 16-304 Approval of the July 12, 2016 City Council Minutes. Attachments: Meeting Minutes July 12, 2016 Kris Coleman-Nicholl made a motion to approve the July 12, 2016 City Council minutes as presented; motion seconded by Chris McCandless. The motion carried unanimously. 7:05 Public Hearing 5. ZONE-04-16- Mr. David Cannell, with Fratelli Ristorante requesting the City Council 005076 approve a rezone of approximately 0.66 acres from the SD(PO/R [R5.7]) “Special Development District” to the CC “Community Commercial District located at approximately 1420 E Sego Lily Drive. Attachments: Council Request.pdf Ordinance 16-29 Staff Report & Public Comment.pdf Planning Commission Minutes Public Hearing Notice 8-12-16 E-mail from Mr. Paul Godot, Fratelli Rezone Possible Solution Special Development Zone Mike Wilcox updated the Council on the Fratellie rezone. He reported that there would need to be a renotice for the public hearing. A motion was made to table the public hearing to the August 9th City Council meeting. Chairman Smith opened the public hearing. There were no comments. Council discussion followed. A motion was made by Steve Fairbanks, seconded by Linda Martinez Saville , to table the consideration of the Fratelli Rezone to rezone approximately 0.66 acres from the SD(PO/R [R5.7] "Special Development District" to the CC "Community Commercial District located at approximately 1420 East Sego Lily Drive to the August 9, 2016 City Council meeting. Smith Council Items 6. 16-262 Overlay zone discussion. Mike Coulam reported on the overlay zone and how it is used. Council discussion followed. It was determined that the City Council would hold further discussion on the DDOZ overlay zone at an upcoming work session. 7. 16-299 Council Member Cowdell recommending the City Council amend the Election of Council Officers policy to separate the Vice Chair and Planning Commission liaison assignments. Attachments: Proposed Amendment to Election of Council Officers Policy Scott Cowdell recommended that the elected Vice Chairman have the option of being the liaison to the Planning Commission, and that it not be mandatory. Council discussion followed. Michael Applegarth requested that the policy that was included in the packet for the election of Council officers, encapsulating most of Scott Cowdell's motion, be put in the final policy for clarification, then bring it back on the Consent calendar for approval. Chairman Smith asked that this item be put on the August 9, 2016 consent calendar. A motion was made by Scott Cowdell, seconded by Linda Martinez Saville, that the appointment of the Vice Chair as the Planning Commission liaison be at the Vice Chair's discretion and that should the Vice Chair decline the appointment, it would then go through an appointment process to determine the liaison. Question on the Motion: Maren Barker expressed concern over suggesting an appointment of a liaison without knowing a mechanism for appointment. Steve Smith noted that the mechanism used by the Council is to have the members make their interest known on serving as the liaison to the Planning Commission. The Council will then vote or confirm the appointment. Attachments: Resolution 16-50C Resolution 16-06C Committee meeting dates times The Council discussed appointments to the various Citizen Committees. A motion was made by Scott Cowdell, seconded by Chris McCandless, to adopt Resolution 16-50C, appointing Council members to serve on various Citizen Committees. Smith 9. 16-199 City Council Office recommending that the City Council elect a new Vice Chair. Attachments: Separate Vice Chair and Planning Commission The City Council took 3 ballot votes to elect a Vice Chairman to the Sandy City Council. Councilwoman Maren Barker was voted in as the Vice Chair. To elect new officers by ballot vote. Completion of reports and other items not held in the Work Session. No Reports were given.
